CITY OF LINO LAKES <br />COUNTY OF ANOKA <br />ORDINANCE NO. 19-01 <br />AN ORDINANCE AMENDING CHAPTER 207, ADDING SECTION 207.37, <br />BACKGROUND INVESTIGATIONS, TO THE LINO LAKES CITY CODE <br />THE CITY COUNCIL OF THE CITY OF LINO LAKES DOES ORDAIN: <br />Section 207.37 is hereby amended to read (added portions are underscored) <br />Sec. 207.37 Background Investigations. <br />Upon the request of the City Administrator or designee, the Police Department <br />shall provide certain criminal history data on a person who has, may have, or <br />seeks to have access to a child under Minnesota Statute § 299C.61 and who is <br />employed by, volunteers with, or seeks to be employed by or volunteer with the <br />City or with a children's service provider utilizing City parks, buildings, or <br />facilities contained in the Minnesota Criminal Justice Information System. With <br />regard to employment, the data to be provided must only be about fmalists for <br />City positions of employment. These background checks shall be in accordance <br />with Minnesota Statutes 299C.60 to 299C.64 known as the "Minnesota Child <br />Protection Background Check Act". The City Administrator or designee must <br />obtain the consent of the fmalists before requesting the data, but an applicant's <br />failure to provide consent may disqualify the applicant from the prospective <br />position. <br />This Ordinance shall become effective immediately upon its passage by the City <br />Council. <br />Passed by the City Council this 8th day of October, 2001 <br />ergso , May6'r <br />Ann Blair, City Clerk <br />The motion for the adoption of the foregoing ordinance was duly seconded by Council <br />Member and upon vote being taken thereon, the following voted in favor: <br />The following voted against same: <br />Whereupon the ordinance was declared duly passed and adopted <br />
