On April 28, 2003, the City Council of Lino Lakes considered second reading of <br />Ordinance No. 09-03. <br />Councilmember Carlson introduced second reading of Ordinance No. 09-03 and moved <br />its adoption: <br />CITY OF LINO LAKES <br />ORDINANCE NO. 09-03 <br />ORDINANCE CONVEYING EASEMENT INTEREST <br />TO ANOKA COUNTY <br />(see attached legal description) <br />WHEREAS, the City Council of Lino Lakes has received permanent easement <br />for highway right-of-way, drainage, utility, and bikeway purposes over, under and across <br />a portion of property adjacent to County Road J as a result of a Minor Subdivision for <br />Warren Bachman of 1487 Ash Street, as outlined in Resolution No. 02-96; and <br />WHEREAS, the easement was received for highway right-of-way purposes for <br />Ash Street (County Road "J"/CSAH No. 32), which is a County Road, and <br />WHEREAS, an easement for right-of-way purposes for a County Road should be <br />held by the County, and <br />WHEREAS, Ordinance No. 09-03 seeks to transfer such easement to Anoka <br />County, and <br />WHEREAS, three-fifths of all members of the City Council concur in this <br />ordinance. <br />NOW, THEREFORE THE CITY COUNCIL OF LINO LAKES ORDAINS: <br />Section 1. That the attached legally described easement interest be conveyed to <br />Anoka County for road right-of-way purposes. <br />Section 2. This Ordinance shall be in full force and effect from and after 30 days <br />following its passage and publication, in accordance with the City Charter. <br />The motion for the adoption of this Ordinance was duly seconded by Councilmember <br />Dahl, and upon roll call vote, the following voted in favor thereof: <br />Councilmembers Dahl, Reinert, Bergeson, Carlson and O'Donnell. <br />The following voted against the same: <br />None. <br />Whereupon said Ordinance was declared passed and adopted. <br />
