AGENDA ITEM 6B <br />STAFF ORIGINATOR: John Powell, City Engineer <br />COUNCIL MEETING DATE: October 25, 1999 <br />TOPIC: Public Hearing — First Reading, Approve Ordinance No. 17-99, <br />Easement Vacation, Oak Brook Peninsula. <br />VOTE REQUIRED: 4/5 Vote Required <br />BACKGROUND: <br />The Rice Creek Watershed District(RCWD) had previously indicated we would receive <br />their recommendation on this matter no later than October 18, 1999. After reviewing <br />the attached memo from the RCWD engineer, it is apparent they do not yet have a <br />definitive position on this request and have asked that the applicant prepare and submit <br />additional data. A recommendation on this matter from the RCWD is required before <br />City staff is able to prepare a recommendation. We are requesting that the Public <br />Hearing be continued until November 8, 1999. <br />This matter has also been placed on the agenda for the Environmental Board meeting <br />to be held on October 27, 1999. <br />OPTIONS: <br />1. Continue the Public Hearing to the November 8, 1999, City Council meeting. <br />2. Hold the public hearing for the first reading without a staff recommendation. <br />RECOMMENDATION: <br />Staff recommends Option No. 1, continuation of the Public Hearing. <br />
