G <br />STAFF ORIGINATOR: Mary Kay Wyland <br />DATE: December 13, 1999 <br />TOPIC: Second of Ordinance No. 23 - 99 Vacating Document <br />#1128982 and #1148602, Trail Easements for Fox Trace <br />And <br />Accepting New Trail Easement Document <br />VOTE REQUIRED: 4/5Th <br />This is the second reading of Ordinance No. 23-99 vacating two trail easement documents <br />recorded for the development known as Fox Trace. These easements were recorded in <br />July and December of 1994 prior to the exact trail location. Since that time, the trail has <br />been constructed, accurately defined and a permanent easement recorded on October 19, <br />1999. The Council held a Public Hearing on Monday, November 22' approving the First <br />Reading of this Ordinance and accepted the new Trail Easement Document. <br />Staff would recommend approval of the Second Reading of Ordinance No. 23 - 99 <br />Vacating Document #1128982 and #1148602 (Fox Trace Trail Easements) as they are not <br />necessary and have been replaced with a new document. This new document was <br />recorded with Anoka County on October 19, 1999. <br />OPTIONS: <br />1. Approve Second Reading of Ordinance No. 23 - 99 <br />2.
