Council Member Bergeson <br />moved its adoption: <br />introduced the following Ordinance and <br />ORDINANCE NO. 06-97 <br />AN EMERGENCY ORDINANCE AUTHORIZING THE SALE OF PROPERTY <br />The City Council of the City of Lino Lakes hereby ordains as follows: <br />Legislative Findings of Fact <br />The City of Lino Lakes, Minnesota, has recently approved a Master Plan for the 75 -acre <br />Village within the Lino Lakes Town Center on I-3 5 W/Hwy 49 in Lino Lakes. This Master <br />Plan was developed to further the City's general plan of economic development within the <br />community. <br />The City has recently negotiated with a landowner to purchase a 13.6 -acre parcel within <br />the Village. The City finds it to be in its best interest to complete this land contract to <br />control the content, quality and pace of development within the Village. <br />The City also has facilitated the location of a Fairview Hospital Clinic on a portion of the <br />parcel it is acquiring. The schedule for construction of the clinic requires that the sale of <br />the property to Fairview Hospital and Healthcare Services and the issuance of a building <br />permit must transpire within the next 30 days. The location of the clinic in Lino Lakes is <br />viewed by the City as an improvement to the health and welfare of its citizens as well as a <br />critical component to the City's overall economic development plan. <br />Under Section 12.05 of the Lino Lakes City Charter, no real property of the City shall be <br />disposed of except by Ordinance. A City Ordinance requires two readings and a 60 -day <br />waiting period before the Ordinance can be enacted. The City finds that reasonable <br />measures must be taken to protect the public interest by enacting this Ordinance as an <br />emergency Ordinance under Section 3.06 of the City Charter: <br />I <br />The real property legally described as Lot 1, Block 1, The Village No. 1 (the "Property") <br />is to be owned by the City of Lino Lakes (the "City") upon closing on Monday, April 14, <br />1997. The city council for the City has determined that sale of the Property to Fairview <br />Hospitals is in furtherance of the Master Plan for the Village and will not be needed by the <br />City for any other public purpose. <br />
