Council Member Neal <br />adoption: <br />introduced the following ordinance and moved its <br />CITY OF LINO LAKES <br />ORDINANCE NO. 11 - 97 <br />AN EMERGENCY ORDINANCE AMENDING CHAPTER 403, INDIVIDUAL <br />SEWAGE TREATMENT SYSTEMS CHAPTER 70-80, MINNESOTA <br />POLLUTION CONTROL AGENCY WATER QUALITY DIVISION, <br />INDIVIDUAL SEWAGE TREATMENT SYSTEMS, VARIANCES. <br />The City Council of the City of Lino Lakes ordains that the Lino Lakes City Code is <br />amended by adding a chapter to read as follows: <br />SECTION 1. DECLARATION OF NEED FOR EMERGENCY ORDINANCE <br />Due to conditions existing on properties in need of septic repair wherein a further delay in <br />undertaking of repairs caused by the variance application process could result in harm to <br />the public peace, safety and health, as necessary to provide for an administrative variance <br />in certain limited circumstances. <br />SECTION 2. <br />Section 403.03 Permits, Subd. 4, Variances, is hereby added to Chapter 403 as follows: <br />Subdivision 4. Variances. Where conditions prevent the construction, <br />alteration, and/or repair of a water well or an individual sewage treatment system, on an <br />existing developed parcel of real property, the building official may reduce the property <br />line and building setbacks in system sizing requirements providing said reduction does <br />not endanger or unreasonably infringe on adjacent properties and with the concurrence of <br />the effected properties. <br />SECTION 3, EFFECTIVE DATE. <br />The effective date of the amended ordinance shall be June 9, 1997 and publication <br />according to the City Charter. <br />Passed by the City of Lino Lakes this 9th day of June, 1997 <br />
