SECTION 8. CONTRACT FOR RESIDENTIAL REFUSE COLLECTION. <br />a. Subject to the provisions of this section, the council <br />shall be granted the authority to enter into a contract <br />to collect and dispose of all refuse originating from <br />residential property within the City by negotiation, bid <br />or otherwise. Commercial, business establishment and <br />demolition hauling shall not be affected by this <br />contract. <br />b. Terms. The contract shall be made for a term as <br />determined by city council in contract. <br />c. Contract Collector No person shall collect solid waste <br />from residential property within the city except the <br />licensed contract collector. No person shall permit solid <br />waste to be collected from his/her premises by any person <br />other than a licensed contract collector. <br />SECTION 9. DUTIES AND OBLIGATIONS OF THE LICENSED COLLECTOR. <br />A licensed solid waste and/or recyclable collector must comply <br />with the following operational requirements. Failure <br />to observe these provisions may be basis for suspension or <br />revocation of a license. <br />(A) The licensee shall operate in a manner consistent with <br />its application materials and shall provide notice to <br />the City within ten (10) days of any change in the <br />information, forms, or certificates filed as part of <br />the license application process. <br />(B) The licensee shall comply with all State, County, local <br />laws and regulations. <br />(C) No collection of solid waste, yard waste, and/or <br />recyclable materials shall be made except between the <br />hours of 7:00 a.m. and 6:00 p.m. Monday through Friday, <br />Saturdays 9:00 a.m. and 4:00 p.m. with the exception of <br />the following holidays falling on a weekday: <br />Thanksgiving Day, Christmas Day, New Years Day, <br />Memorial Day, July 4th, and Labor Day where the 7:00 <br />a.m. to 6:00 p.m. hours would apply on Saturdays, with <br />no collection on Sunday, except under extenuating <br />circumstances including poor weather conditions or <br />natural dis*sters. Customers shall be reasonably <br />notified of the specific day for the collection of <br />their garbage, refuse, and/or recyclable and the <br />licensee shall collect the materials on those days. <br />
