ORDINANCE NO. 09 - 96 <br />a license application for a pawnbroker, precious metal dealer or a Class A <br />secondhand goods dealer license. <br />2. Class B Secondhand Goods Dealer. A Class B secondhand goods dealer <br />license shall be issued by the City Clerk upon a positive recommendation <br />from the Chief of Police. In the event the Chief of Police recommends <br />denial, the application shall be submitted to the City Council for a <br />disposition in the same manner as an application for a Class A secondhand <br />goods dealer license. Failure of the City Clerk to grant the application or <br />submit it to the City Council within 30 days after receipt of the application <br />by the City Clerk shall be deemed a granting of the license. <br />3. Any falsification of on or material omission from a license application <br />shall constitute good and sufficient cause to deny the application. <br />614.08 Expiration of License. All licenses issued under this Chapter shall <br />expire as of midnight on December 31st of the year of issuance. <br />614.09 Renewal. An application for the renewal of an existing license <br />shall be made to the City Clerk prior to the expiration date of the license and shall be <br />made in such form as the issuing authority requires. Applications for renewal of a <br />pawnbroker, precious metal dealer and Class A secondhand dealer licenses shall be <br />submitted by the City Clerk to the City Council. Renewal of a Class B secondhand <br />dealer licenses shall be granted by the City Clerk unless the City Clerk, for good and <br />sufficient cause, determines there are grounds for denial in which case the City Clerk <br />shall submit the renewal application to the City Council. <br />614.10 Conditions for Approval of License. <br />1. No license under this Chapter shall be issued to an applicant who is a <br />natural person if such applicant: <br />(A) Is a minor at the time the application is filed; <br />(B) Has been convicted of any crime directly related to the occupation <br />licensed as prescribed by Minnesota Statutes, Section 364.03, <br />subd. 2, and has not shown competent evidence of sufficient <br />rehabilitation and present fitness to perform the duties of <br />pawnbroker, precious metals dealer, or secondhand goods dealer as <br />prescribed by Minnesota Statutes, Section 364.03, subd. 3; <br />(C) Is not a citizen of the United States or a resident alien; <br />(D) Is not of good moral character or repute; or <br />(E) Holds an intoxicating liquor license under this Code. <br />2. No license under this Chapter shall be issued to an applicant that is a <br />partnership if such applicant has any general partner or managing partner <br />who: <br />(A) Is a minor at the time the application is filed. <br />PAGE 7 <br />
