(7) A minor subdivision as allowed by the terms of <br /> this chapter. (Added by Ordinance 9-85, passed <br /> December 9, 1985. ) <br /> In any case in which compliance with the foregoing <br /> restrictions will create an unnecessary hardship and failure to <br /> comply does not interfere with the purpose of the subdivision <br /> regulations, the council may waive such compliance by adoption of <br /> a resolution to that effect and the conveyance may then be filed or <br /> recorded. Any owner or agent of the owner of land who conveys a <br /> lot or parcel in violation of the provisions of this section shall <br /> forfeit and pay to the city a penalty of not less than $100 for <br /> each lot or parcel so conveyed. The city may enjoin such <br /> conveyance or may recover such penalty by a civil action in any <br /> court of competent jurisdiction. <br /> (Section 1001. 16 amended by Ordinance 4-85, passed May 13, 1985. ) <br /> 1001. 17 Building Permits. No building permit shall be issued <br /> by the city with respect to any land, parcel or lot until the <br /> provisions of this chapter in regard to the subdividing of property <br /> have been met. <br /> 1001. 18 Variances. The planning commission may recommend <br /> variances from the requirements of this chapter in specific cases* <br /> which do not affect the general plan or intent of this chapter. <br /> The recommendations shall be transmitted to the council in writing, <br /> substantiating the reasons for the proposed variances. The council <br /> may approve the variances from the requirements of this chapter in <br /> cases which do not adversely affect the plan and spirit of this <br /> chapter or the comprehensive plan and there are special <br /> circumstances or conditions affecting the property such that strict <br /> application of the provisions of this chapter would deprive the <br /> applicant of the reasonable use of his land. <br /> 1001. 19 Minor Subdivisions. Except as hereinafter <br /> specifically provided, minor subdivisions shall conform to all <br /> standards, procedures and requirements applicable to all <br /> subdivisions under this Chapter. The procedures for review and <br /> approval of minor subdivisions are as follows: <br /> (1) Prior to formal application, sketch plans shall <br /> be reviewed b the zoning official. <br /> (2) Following formal application, the zoning official <br /> shall submit a written report to the planning and <br /> zoning commission on the minor subdivision <br /> proposal. <br /> (3) The zoning official shall request input by the <br /> city's planning, engineering, and legal <br /> consultants, as necessary.
