r� considerations alone and when a reasonable use for <br /> the property exists under the terms of the <br /> ordinance. <br /> (D) That granting the variance requested will not <br /> confer on the applicant any special privilege that <br /> would be denied by this ordinance to other lands, <br /> structures, or buildings in the same district. <br /> (E) That the proposed actions will not unreasonably <br /> diminish or impair established property values <br /> within the neighborhood. <br /> (F) That the proposed actions will be in keeping with <br /> the spirit and intent of the ordinance. <br /> (2) Procedure: <br /> The city shall decide upon requests for variance by approving <br /> or denying the same in part or in whole. The procedure for <br /> granting variances is as follows: <br /> (A) A person desiring a variance shall fill out and <br /> submit to the city planner or his/her designee a <br /> "Zoning Form", together with a fee as required in <br /> Section 9 of this ordinance and all related <br /> n material to document said hardship. <br /> (B) The application shall be referred to the design <br /> review board which shall submit a recommendation to <br /> the city council. <br /> (C) The petitioner or representative may appear before <br /> the design review board in order to present <br /> information or to answer questions. <br /> (D) The city council may grant the variance if it has <br /> been established that a hardship exists. The city <br /> council shall, on all variance applications whether <br /> granted or denied, record a finding of fact. Such <br /> findings shall be recorded in writing and shall <br /> state the city council's reasons for such action. <br /> (E) Following approval of the variances a certified <br /> copy thereof including a legal description of the <br /> property shall be filed with the county recorder or <br /> registrar of titles. <br /> City of Lino Lakes Zoning Ordinance <br /> ADOPTED 7/13/92 <br /> 63 <br />
