Saddle Club <br />Development Contract <br />August 25, 2014 <br />c. A Grading Permit application shall be submitted and approved by <br />City Staff prior to any grading or site work. <br />d. The Rice Creek Watershed District must review and issue a permit <br />for the project prior to building permits being issued by the city for <br />any new construction. <br />e. Conservation easements dedicated over wetland protection areas <br />via an Easement agreement. This document shall be approved by <br />RCWD and the City and recorded against the property and <br />recorded. <br />XIII. LAND USE CONTROLS -PLANNED UNIT DEVELOPMENT <br />a. Saddle Club is a Planned Unit Development (PUD) as approved by the City <br />Council by Ordinance No. 02-14 and Resolution No. 14-15. <br />b. The PUD provides the following flexibilities: <br />i. Minimum lot size (contiguous buildable area) of less than standard 10.800 <br />square feet. <br />ii. Reduced front and rear yard setback from 30 feet to 25 feet, <br />iii. Reduced road right of way from 60 feet to 50 feet. <br />iv. Reduced street width from 32 feet to 28 feet- and <br />XIV. VIOLATIONSBUILDING PERMITS <br />a. <br />In the event that Developer violates any of the covenants and agreements <br />contained in this Development Contract and to be performed by the Developer, <br />the City, at its option, inaddition to the rights and remedies as set out hereunder <br />may refuse to issue building permits and/or Certificate of Occupancies to any <br />property within the Subdivision until such time as such default has been corrected <br />to the satisfaction of the City. <br />XV. PARK DEDICATION <br />a. The City will require a combination of park improvements and cash in lieu of land <br />dedication. <br />b. The cost of the park improvements to be installed by the developer for a <br />boardwalk and trail is $50,436. <br />c.
