• FIRST AMENDMENT TO DEVELOPMENT AGREEMENT Turnberry Crossing Second Addition This First Amendment to the Development Agreement dated March 28, 2005, is hereby entered into by and between the City of Lino Lakes, 600 Town Center Parkway, Lino Lakes, Minnesota 55014, and Hokanson Construction and Development Company, Inc., successor to Bison Development, Inc., 9174 Isanit Street N.E., Blaine, Minnesota 55449 ("Developer") this day of , 2015. Recitals 1. The City and the Developer entered into a Development Agreement for the construction of the planned unit development known as Turnberry Crossing. 2. The original development plan for Turnberry Crossing contemplated the construction of two-story duplexes. • 3. Only three of the originally planned duplexes were constructed by Developer. • 4. In order to better respond to the current housing market, Developer seeks to alter the development plan by substituting one-story duplexes for the two-story duplexes. 5. The proposed one-story duplexes have a larger footprint than the original two-story duplexes. 6. Developer seeks to replat Turnberry Crossing in order to increase the footprint of the 11 proposed one-story duplex sites. The proposed replat is known as Turnberry Crossing Second Addition, legally described as Lots 1 through 11, and 24, Block 1, Turnberry Crossing, Anoka County, Minnesota (final plat attached as Attachment A). 7. The City Council passed Resolution No. 15-46, Approving Amendment to Conditional Use Permit for PUD Development Stage Plan/Preliminary Plan, on May 11, 2015, and Resolution No. 15-66, Approving the PUD Final Plan/Final Plat, is proposed for approval on June 22, 2015. Agreement 1. Recitals. The above Recitals are incorporated herein as if fully set forth. 2. Amendment. The original Development Agreement shall govern the development of Turnberry Crossing Second Addition except to the extent provided by this First Amendment.
