Subd. 2. Administration: Conditional Use Permits. <br />A. General Statement. Certain uses, while generally not suitable in a particular <br />zoning district, may under some circumstances be suitable. When such <br />circumstances exist, a conditional use permit may be granted. Conditions may <br />be applied to issuance of the permit and an annual review of the permit shall be <br />required. The permit shall be granted for a particular use and not for a particular <br />person or firm. Conditional use permits may be granted in accordance with this <br />subdivision for any use or purpose for which such permits are required or <br />permitted by this ordinance or as listed as a conditional use for the zoning <br />districts provided in Sections 5 through 9 of this ordinance. <br />B. Procedure. <br />1. The person applying for a conditional use permit shall fill out and submit to <br />the Zoning Administrator a "Land Use Application Form" together with a <br />fee as established by City Council resolution. The request for conditional <br />use permit shall be placed on the agenda of the Planning & Zoning Board <br />according to the City's deadline and meeting schedule. The request shall <br />be considered officially submitted and the application approval time line <br />commences when all the information requirements are complied with. <br />2. A public hearing on the conditional use permits shall be held by the <br />Planning and Zoning Board or the City Council. <br />3. At least ten (10) days prior to the public hearing; notice of the purpose, <br />time and place of such public hearing shall be published in the official <br />newspaper of the City and mailed to the property owners within three <br />hundred fifty (350) feet of the property in question. Failure of any property <br />owner to receive the mailed notification shall not invalidate the <br />proceedings. <br />4. The applicant or his representative must appear before the Planning and <br />Zoning Board in order to answer questions concerning the proposed <br />conditional use. <br />5. Site and building plans consistent with the requirements established in <br />Section 2, Subd. 5.B shall be provided prior to Planning and Zoning Board <br />review. <br />6. The Zoning Administrator shall instruct the appropriate staff persons to <br />prepare technical reports where appropriate and provide general <br />assistance in preparing a recommendation of the action to the City <br />Council. <br />Lino Lakes Zoning Ordinance Administration <br />2-4 <br />
