MEETING DATE: July 9, 2001 <br />TOPIC: Resolution 01-94, Final Plat <br />Behm's Farm Park Addition <br />ACTION REQUIRED: 3/5 vote <br />BACKGROUND <br />The City Council approved the preliminary plat for Behm's Farm Park Addition on May <br />29, 2001. We have received a request for approval of the final plat. <br />The City typically requires a number of things for a final plat approval. These include: <br />• Final plat must substantially conform to the approved preliminary plat. <br />• Development agreement must be completed, including financial securities. <br />• Title must be reviewed by City Attorney. <br />• Conditions of approval must be met. <br />The final plat conforms to the preliminary plat. No development agreement is necessary, <br />as all roads and utilities exist. The City Attorney has confirmed that no title work is <br />necessary for the plat approval because the City owns the property and will be selling it <br />to the developer. <br />The conditions of approval for the preliminary plat are as follows: <br />1. Ordinance 01-01 must be in effect (30 days after publication) before the final plat <br />can be recorded. <br />2. Ordinance 02-01 must be in effect (30 days after publication) before the final plat <br />can be recorded. <br />3. The developer must notify purchasers of residential lots of the existence of the <br />nearby Lino Air Park. The developer must provide to the City a copy of the <br />notification format to be used before final plat approval by the City. <br />The two ordinances were published June 18. They will be in effect July 18. The closing <br />(when the City will sell the land to the developer) has been arranged for July 20. The <br />City will not release the signed plat hardshells for recording until July 18. This <br />requirement is included in Resolution 01-94 approving the final plat. <br />
