ANALYSIS <br />Previously stated above, the residential property located at 6602 Pheasant Run doesn't have a <br />garage. Zoning ordinance § 1007.090 (2) (d), found below, requires a building setback of 40 feet <br />from the lot line of Birch Street. The existing house setback is 48 feet, which would only allow <br />for an 8 foot wide attached garage. However, in the same ordinance, § 1007.090 (3) (c), all <br />dwellings in Lino Lakes are required to have a double garage at a minimum. In order for the <br />property to be in compliance with Lino Lakes zoning ordinance a variance is required. <br />§ 1007.090 R-1, SINGLE FAMILY RESIDENTIAL DISTRICT. <br />(2) Lot and Yard Requirements. <br />(d) Building Setbacks. <br />1. From Streets (Principal and Accessory Buildings) <br />a. Local Street. Thirty (30) feet. <br />b. Collector or Arterial Street. Forty (40) feet. <br />(3) Building Requirements. <br />(c) All dwellings shall have a double garage at a minimum. <br />(d) All dwellings shall comply with the Design Construction Standards of § 1007.043. <br />SETBACK ANALYSIS ALONG CSAH 34BIRCH STREET <br />The applicant submitted two proposed plans with the land use application that can be found in <br />the attachments section. The setback required by the variance to construct the proposed double <br />garage would need to be 25 feet from the lot line, as requested by the applicant. After analyzing <br />building setbacks of other corner properties along Birch Street, staff has found that the setbacks <br />varied from 30 feet to 40 feet, but most of the properties did in fact meet the required 40 foot <br />setback. There was only one exception identified, which had a setback of 17 feet, located at 985 <br />Birch Street. <br />The right-of-way along this section of CSAH 34Birch Street is 120 feet wide and no additional <br />right-of-way is required in the future. <br />ACCESSORY BUILDING REGULATIONS <br />Accessory buildings are a permitted use in R-1, Single Family Residential Districts. These <br />structures shall meet the regulations of § 1007.043 General Building and Use Provisions and <br />§ 1007.090 (3) Building Requirements. <br />2 <br />
