Council Member introduced the following resolution and moved its adoption. <br />CITY OF LINO LAKES <br />RESOLUTION NO. 00-67 <br />RESOLUTION INITIATING THE PROCESS TO ADOPT A MORATORIUM ON <br />THE PERMITTING AND CONSTRUCTION OF NEW TOWER STRUCTURES <br />FOR THE PROVISION OF PERSONAL WIRELESS SERVICES <br />WHEREAS, the City of Lino Lakes is initiating a study of the demand for new towers <br />and the potential tower sites for provision of personal wireless services; and <br />WHEREAS, the purpose of the study is to determine how best to provide for the <br />provision of personal wireless services while minimizing the number of tower structures <br />and protecting the public health, safety, and welfare; and <br />WHEREAS, MN Statute 462.355 Subd. 4 authorizes a municipality to adopt an interim <br />ordinance for the purpose of protecting the planning process when conducting such a <br />study; <br />NOW, THEREFORE, BE IT RESOLVED that the City Council directs staff to initiate <br />the process for the adoption of an interim ordinance that establishes a moratorium on the <br />permitting and construction of new personal wireless services towers within the City. <br />FURTHERMORE, BE IT RESOLVED that the moratorium shall be in effect for ninety <br />(90) days after its effective date, as established by state law and the City Charter. <br />FURTHERMORE, BE IT RESOLVED that the moratorium applies only to new tower <br />structures, not personal wireless service antennae mounted on existing structures, nor <br />does it apply to amateur radio towers. <br />FURTHERMORE, BE IT RESOLVED that a public hearing on the interim ordinance <br />shall occur at the Planning & Zoning Board meeting of June 14, 2000. <br />Adopted by the Lino Lakes City Council this 22nd day of May, 2000 <br />Ry hel Gaustad, CMC, Clerk/Treasurer <br />J.
