SECTION 00 73 05 SUPPLEMENTARY CONDITIONS These Supplementary Conditions amend or supplement the Standard General Conditions of the Construction Contract (No. C-700, 2002 Edition) and other provisions of the Contract Documents as indicated below. All provisions, which are not so amended or supplemented, remain in full force and effect. The terms used in these Supplementary Conditions will have the meanings indicated in the General Conditions. Additional terms used in these Supplementary Conditions have the meanings indicated below, which are applicable to both the singular and plural thereof. ARTICLE 1 - DEFINITIONS AND TERMINOLOGY SC -1.01.A.45 Add the following language at the end of the definition: The Work is considered Substantially Complete when Elevated Tank No. 1 is disinfected successfully, filled with water and is fully operation and allowed to be placed in service. The driveway, grading, and seeding/sodding shall also be in place. SC -1.02 Add the following new paragraph immediately after Paragraph 1.02.E: F. The Specifications are written in imperative mood and streamlined form. This imperative language is directed to the Contractor, unless specifically noted otherwise. The words "shall be" are included by inference where a colon (:) is used within sentences or phrases. ARTICLE 2 - PRELIMINARY MATTERS SC -2.01.8 Delete Paragraph 2.01.6 in its entirety and insert the following in its place: B. Evidence of Insurance: Before any Work at the Site is started, Contractor shall deliver to Owner, with copies to Engineer and to each additional insured identified in the Supplementary Conditions, certificates of insurance, on forms acceptable to Owner, which reflect the proper evidence of insurance which Contractor is required to purchase and maintain in accordance with Article 5. ARTICLE 5 - BONDS AND INSURANCE SC -5.01 Add the following new paragraph immediately after Paragraph 5.01.0: D. Separate performance and payment bonds should be submitted utilizing EJCDC Form Number 00610 and 00615 (2007 Editions) or a similar bond form, if approved by Owner. SC -5.03.A Delete Paragraph 5.03.A in its entirety and insert the following in its place: A. Contractor shall deliver to Owner, with copies to each additional insured identified in the Supplementary Conditions, certificates of insurance, on duplicate forms acceptable to Owner, which provide evidence that Contractor has purchased and is maintaining the insurance which Contractor is required to purchase and maintain.
