ARTICLE 6 - CONTRACTOR'S RESPONSIBILITIES <br />SC -6.08.A. Amend the first sentence of Paragraph 6.08.A by replacing the words "the <br />Supplementary Conditions" with the words "Division 1." <br />ARTICLE 10 - CHANGES IN THE WORK; CLAIMS <br />SC -10.05.B. Amend the first sentence of Paragraph 10.05.A by replacing the words "30 days" with <br />the words "10 days." Amend the third sentence of Paragraph 10.05.A by replacing the words "60 <br />days" with the words "30 days." <br />ARTICLE 13 - TESTS AND INSPECTIONS; CORRECTION, REMOVAL OR ACCEPTANCE OF DEFECTIVE WORK <br />SC -13.07.A. Amend the first sentence of Paragraph 13.07.A by striking out the words "one year" <br />and inserting the word "two years." <br />ARTICLE 14 - PAYMENTS TO CONTRACTOR AND COMPLETION <br />SC -14.02.B.5 Add the following new item immediately after Item 14.02.B.5.d: <br />e. Contractor's failure to make acceptable submittals in accordance with the <br />accepted schedules. <br />ARTICLE 16 - DISPUTE RESOLUTION <br />SC -16.02 Add the following new paragraphs immediately after Paragraph 16.01: <br />SC -16.02 Mediation <br />A. Owner and Contractor agree that they shall submit any and all unsettled claims or <br />counterclaims, disputes, or other matters in question between them arising out of, or <br />relating to, the Contract Documents, or the breach thereof -'to mediation by the <br />American Arbitration Association, or other person or entity mutually agreed upon by the <br />parties, prior to either of them initiating against the other a demand for arbitration <br />pursuant to Paragraph SC -16.03 or litigation, unless delay in initiating arbitration or litigation <br />would irrevocably prejudice 1 of the parties. The 30 day time limit within which to file a <br />demand for arbitration as provided in Paragraphs SC -16.03.B and SC -16.03.0 shall be <br />suspended with respect to a dispute submitted to mediation within that time limit, and <br />shall remain suspended until 10 days after the termination of the mediation. The mediator <br />of any dispute submitted to mediation under this Agreement shall not serve as arbitrator of <br />such dispute unless otherwise agreed. <br />SC -16.03 Arbitration <br />A. All claims or counterclaims, disputes, or other matters in question between Owner and <br />Contractor arising out of, or relating to, the Contract Documents, or the breach thereof <br />(except for claims which have been waived by the making or acceptance of Final <br />Payment as provided by Paragraph 14.09), not resolved under the provisions of Paragraph <br />SC -16.02, and which involve an amount in controversy not more than $100,000, will be <br />decided by binding arbitration in accordance with the Construction Industry Rules of the <br />American Arbitration Association then obtaining, subject to the limitations of this <br />Paragraph SC 16.03.
