General Considerations is a new section recommended by the DNR as guidance for communities in reviewing variance and conditional use applications. §1103.12 Nonconformities This is a new section, Nonconformities was previously located in 1103.06 subpart 4 Nonconforming uses. Language was amended and added in this section. The following is a summary of the changes made in this section: 1) Continuance of nonconformities • Refined existing language regarding expansion or alteration of nonconforming structures (e.g. Buildings and structures within the Floodway District may not be enlarged or expanded) • Adds requirement that any addition or structural alteration of a nonconforming structure must be protected to the regulatory flood protection elevation • Refines existing language regarding maximum lifetime cost of alterations and additions of nonconforming structures ■ Adds language on substantial damage, repetitive losses and substantial improvements for nonconforming structures §1103.13 Penalties and Enforcement This is a new section, Penalties and Enforcement was previously located in 1103.02 subpart 9 Penalties. Language was amended in this section.
