CITY COUNCIL <br /> AGENDA ITEM 6B <br /> STAFF ORIGINATOR: Keith Dahl, Community Development Intern <br /> MEETING DATE: November 09, 2015 <br /> TOPIC: Consider 2nd Reading of Ordinance No. 11-15, Vacating <br /> Drainage and Utility Easements, Outlot C and Outlot D of <br /> NorthPointe <br /> *Council may vote to dispense with full reading of ordinance <br /> *Roll call vote is required for adoption of the ordinance <br /> VOTE REQUIRED: 4/5 <br /> INTRODUCTION <br /> Staff is requesting City Council consideration of the 2nd reading of Ordinance No. 11-15, <br /> vacating all of the drainage and utility easements, as dedicated in the plat of NorthPointe, <br /> according to the recorded plat thereof,Anoka County,Minnesota, lying over,under, and across <br /> Outlot C and Outlot D, of said plat. <br /> BACKGROUND <br /> NorthPointe is a PUD residential subdivision located northeast of the intersection of Birch <br /> Street and 20t"Avenue South/CSAH 54. The applicant has submitted a land use application <br /> requesting the vacation of drainage and utility easements of Outlot C and Outlot D, <br /> NorthPointe. <br /> The subject drainage and utility easements were originally dedicated to the City of Lino Lakes <br /> with the approval of NorthPointe 1"addition.However, identical easements were dedicated a <br /> second time with the approval of NorthPointe 3rd addition. Therefore,the applicant is <br /> requesting the drainage and utility easement be vacated that were dedicated to the City with the <br /> approval of NorthPointe lst addition. The easements lying over,under, and across Outlot C and <br /> Outlot D would be vacated by the City Council. <br /> On October 26,2015 City Council approved the lit reading of Ordinance No. 11-15. <br /> RECOMMENDATION <br /> Staff recommends adoption of Ordinance No. 11-15. <br /> ATTACHMENTS <br /> 1.
