CITY OF LINO LAKES <br />RESOLUTION NO. 61 - 89 <br />RESOLUTION VACATING A PORTION OF EASEMENT FOR DRAINAGE DITCH, <br />LOT 3, BLOCK 12, SUNSET OAKS, 140 MARVY STREET, LINO LAKES, <br />MINNESOTA <br />WHEREAS: David Rouch, 140 Marvy Street, Lino Lakes, <br />Minnesota has petitioned the City to vacate certain <br />drainage easements from his lot described above and <br />shown on the attached map, and <br />WHEREAS: this request has been reviewed by the City Engineer <br />and the City Public Works Director and not adverse <br />future problems were noted, and <br />WHEREAS: a public hearing was held on September 11, 1989 <br />before the City Council in the city hall after due <br />published and posted notice had been given by the <br />Clerk on August 21, 1989 and August 29, 1989 and <br />all persons interested were given an opportunity to <br />be heard; and <br />WHEREAS: it appears that it will be for the best interest of <br />the City to vacate such portion of the drainage <br />ditch, and <br />WHEREAS: four fifths of all the members of the Council <br />concur in this resolution, <br />NOW THEREFORE, BE IT RESOLVED that the portion of the <br />drainage ditch described above and shown on the attached map <br />is hereby vacated. <br />Adopted by the Council of the City of Lino Lakes this 11th <br />day of September, 1989. <br />4!!, <br />Benjami G.
