CITY OF LINO LAKES <br />RESOLUTION NO. 06 — 90 <br />RESOLUTION CLARIFYING MOTION OF SEPTEMBER 25, 1989 ORDERING <br />IMPROVEMENT AND PREPARATION OF PLANS FOR SECOND AVENUE <br />WHEREAS: a resolution of the City Council adopted the twenty <br />fifth day of August, 1988, fixed a date for a <br />Council hearing on the proposed improvement of <br />Second Avenue beginning at Lake Drive north to Elm <br />Street, <br />AND WHEREAS: ten days' mailed notice and two weeks' <br />published notice of the hearing was given, and the <br />hearing was held thereon on the twenty sixth day of <br />September, 1988, at which all persons desiring to <br />be heard were given an opportunity to be heard <br />thereon, <br />AND WHEREAS: the matter was considered at the November 28, <br />1988 Council meeting and action on this matter was <br />delayed, <br />AND WHEREAS: a motion was made at the September 25, 1989 <br />regular Council meeting by Council Member Bisel to <br />proceed with the Second Avenue improvement and this <br />motion was duly seconded by Council Member Reinert <br />and passed unanimously, <br />AND WHEREAS: this motion was not made part of a resolution <br />ordering the improvement and the plans and <br />specifications for the improvement as required by <br />State Statutes No. 429, <br />NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />LINO LAKES, MINNESOTA: <br />1. Such improvement is hereby ordered as proposed in the <br />Council resolution adopted August 25, 1988. <br />2. Mr. Darrell Schneider of TKDA is designated as the <br />Engineer for this improvement. He shall prepare plans <br />and specification for the making of such improvement. <br />Adopted by the Council this 12th day of March, 1990. <br />PAGE 1 <br />
