Council Member Kuether introduced the following resolution and moved its adoption: CITY OF LINO LAKES LINO LAKES, MINNESOTA RESOLUTION NO. 36 - 90 RESOLUTION RELATED TO THE PRESERVATION OF THE NATURAL VALUES OF THE LAND AND DRAINAGE EASEMENTS ACQUIRED IN SECTION 19 NORTH AND WEST OF STATE TRUNK HIGHWAY NO. 49 WHEREAS, the Lino Lakes City Council has been notified by the Minnesota Department of Natural Resources that a permit (DNR Permit #90-6127) is required for the construction of Second Avenue through state protected wetland 2-591W in accordance with Minnesota Statutes, Chapter 105.42, WHEREAS, the Lino Lakes City Council has been notified by the Minnesota Department of Natural Resources in accordance with Minnesota Rules, part 6115.0190, subpart 5., that mitigation would be required for the filling of 2.5 acres of wetland, WHEREAS, WHEREAS, the construction of Second Avenue would necessitate the filling of approximately 2.5 acres of wetland, the perpetual preservation of the land contained in the drainage easements in the NW 1/4 of Section 19 in its natural state will satisfy the conditions needed to obtain a Department of Natural Resources permit for placement of roadfill in wetland 2-591W, WHEREAS, the easements left in their natural undisturbed state will provide all the amenities associated with natural wetland: NOW, THEREFORE, BE IT RESOLVED that the Lino Lakes City Council hereby approves the perpetual preservation of the land described below in undisturbed open space for the values typically associated with natural wetlands, such as wildlife habitat, aesthetics, biological productivity, water quality enhancement and storm water retention, and that the land in the easements described below shall be preserved without removal or cutting of vegetation, excavating, filling, or construction within the described easement that may adversely
