Council Member Kuether introduced the following resolution <br />and moved its adoption: <br />CITY OF LINO LAKES <br />LINO LAKES, MINNESOTA <br />RESOLUTION NO. 36 - 90 <br />RESOLUTION RELATED TO THE PRESERVATION OF THE NATURAL VALUES <br />OF THE LAND AND DRAINAGE EASEMENTS ACQUIRED IN SECTION 19 <br />NORTH AND WEST OF STATE TRUNK HIGHWAY NO. 49 <br />WHEREAS, the Lino Lakes City Council has been notified by <br />the Minnesota Department of Natural Resources that <br />a permit (DNR Permit #90-6127) is required for the <br />construction of Second Avenue through state <br />protected wetland 2-591W in accordance with <br />Minnesota Statutes, Chapter 105.42, <br />WHEREAS, the Lino Lakes City Council has been notified by <br />the Minnesota Department of Natural Resources in <br />accordance with Minnesota Rules, part 6115.0190, <br />subpart 5., that mitigation would be required for <br />the filling of 2.5 acres of wetland, <br />WHEREAS, <br />WHEREAS, <br />the construction of Second Avenue would necessitate <br />the filling of approximately 2.5 acres of wetland, <br />the perpetual preservation of the land contained in <br />the drainage easements in the NW 1/4 of Section 19 <br />in its natural state will satisfy the conditions <br />needed to obtain a Department of Natural Resources <br />permit for placement of roadfill in wetland 2-591W, <br />WHEREAS, the easements left in their natural undisturbed <br />state will provide all the amenities associated <br />with natural wetland: <br />NOW, THEREFORE, BE IT RESOLVED that the Lino Lakes City <br />Council hereby approves the perpetual preservation of the <br />land described below in undisturbed open space for the values <br />typically associated with natural wetlands, such as wildlife <br />habitat, aesthetics, biological productivity, water quality <br />enhancement and storm water retention, and that the land in <br />the easements described below shall be preserved without <br />removal or cutting of vegetation, excavating, filling, or <br />construction within the described easement that may adversely <br />
