Council Member Reinert introduced the <br />following resolution and moved its adoption: <br />CITY OF LINO LAKES <br />RESOLUTION NO. 78 - 90 <br />A RESOLUTION ADOPTING THE CITY OF LINO LAKES MEDICAL AND DAY <br />CARE EXPENSE REIMBURSEMENT PLAN. <br />WHEREAS, it has been proposed to the Lino Lakes City Council <br />that the City provide a Section 125 Pre -Tax Premium Plan to <br />the City's employees thus providing the City and employees <br />with certain tax advantages; and <br />WHEREAS, the City Council has determined that it is their <br />desire to approve the recommendation establishing a Pre -Tax <br />Premium Plan: <br />NOW, THEREFORE BE IT RESOLVED, by the City Council of the <br />city of Lino Lakes that the City of Lino Lakes Pre -Tax <br />Premium Plan be and the same is adopted effective January 1, <br />1991; <br />BE IT FURTHER RESOLVED that a designated finance employee of <br />the City of Lino Lakes is hereby authorized to make such <br />contributions from the funds of the City as are necessary to <br />carry out the provisions of said plan any time; and <br />BE IT FURTHER RESOLVED in the event that any conflict arises <br />between the provisions of said Plan and the Employee <br />Retirement Income Security Act of 1974 (ERISA) or any other <br />applicable law or regulation (as such law or regulation may <br />be interpreted or amended), the City shall resolve such <br />conflict in a manner which complies with ERISA or such law or <br />regulation. <br />Passed by the Lino Lakes City council this 3 day of <br />l44/0 -1.4-444,1u4_, , 1990. <br />Marilyn'Anderson, Clerk -Treasurer <br />The motion for the adoption of the foregoing resolution was <br />duly seconded by Council Member Bohjanen and <br />upon vote being taken thereon, the following voted in favor <br />thereof: I� <br />Harold L. Bise ,hMayor <br />Neal, uether, Bisel, Reinert, Bohjanen. <br />The following voted against same: None. <br />Whereupon said resolution was declared duly passed and <br />adopted. <br />
