Council Member Kuether introduced the following resolution <br />and moved its adoption: <br />CITY OF LINO LAKES <br />RESOLUTION NO. 92 — 53 <br />RESOLUTION TERMINATING THE PROPOSED RICE LAKE DRIVE IMPROVEMENT <br />PROJECT DESCRIBED IN THE NOVEMBER 21, 1991 FEASIBILITY REPORT <br />WHEREAS: The City Council received the feasibility report on the <br />proposed improvement named Rice Lake Drive Improvement <br />Project dated November 21, 1991, and <br />WHEREAS: a public hearing on the proposed improvement was held at <br />the City Hall on January 13, 1992 and all persons <br />desiring to be heard were heard at that time, and <br />WHEREAS: a neighborhood meeting was held with the residents on <br />March 19, 1992 to better inform the residents of the <br />scope and costs of the improvement and to see if <br />alternative and less expensive plans could be developed, <br />and <br />WHEREAS: a majority of the landowners plan to submit a petition <br />against the improvement because the cost of the <br />improvement would be excess, and <br />WHEREAS: the City Charter requires that if a majority of the <br />property owners file a petition against an improvement <br />the City shall not make such an improvement, <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />LINO LAKES, MINNESOTA: <br />The improvement known as the Rice Lake Drive Improvement is <br />hereby terminated. <br />Adopted by the Lino Lakes City Council this 13th day of April, <br />1992. <br />Vernon F. Anderson, Clerk -Treasurer <br />The motion for adoption of the foregoing resolution was duly <br />seconded by Council Member Neal and upon vote being taken <br />thereon, the following voted in favor thereof: Neal, Kuether, Reinert, <br />Elliott, Bergeson. <br />The following voted against same: none. <br />Whereupon said resolution was declared duly passed and adopted. <br />
