Council Member Kuether <br />moved its adoption: <br />introduced the following resolution and <br />CITY OF LINO LAKES <br />RESOLUTION NO. 92 - 68 <br />RESOLUTION REGARDING EMERGENCY EASEMENT DOCUMENT ACCEPTANCE <br />WHEREAS, during the course of City improvement projects it becomes <br />necessary to acquire easements for streets, utilities and <br />drainage purposes for the benefit of the residents of the <br />City of Lino Lakes; and <br />WHEREAS, it is necessary that the City Council accept all grants <br />of easements to the City prior to the recording of <br />easement documents; and <br />WHEREAS, such acceptance must be affixed on the easement document <br />prior to acceptance by the Anoka County Recorder's <br />office; and <br />WHEREAS, there are certain emergency situations where it is <br />necessary to record easements with the City's acceptance <br />prior to the regularly scheduled Council meetings; and <br />WHEREAS, the City Council has the legal authority to delegate the <br />responsibility for acceptance of such easements to City <br />staff members; <br />NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: <br />1. That if, in the opinion of the City Engineer or the City <br />Attorney, an emergency situation arises so that an easement <br />must be accepted and recorded prior to the City Council <br />meeting, that the City Clerk may affix the acceptance on <br />behalf of the City and cause such easement document to be <br />recorded. That the City Council shall be informed of such <br />easement at its next regular scheduled Council meeting. <br />Adopted by the Lino Lakes City Council th's 27th day of April, <br />1992. <br />46 Ai <br />Mari yn <br />Vernon F. Reinert, Mayor <br />Anderson, Clerk -Treasurer <br />The motion for the adoption of the foregoing resolution was duly <br />seconded by Council Member Elliott and upon vote being taken <br />thereon, the following voted in favor thereof: Neal, Kuether, Reinert, <br />Elliott, Bergeson. <br />The following voted against same: None. <br />Whereupon said resolution was declared duly passed and adopted. <br />
