Council Member Kuether moved its adoption: introduced the following resolution and CITY OF LINO LAKES RESOLUTION NO. 92 - 68 RESOLUTION REGARDING EMERGENCY EASEMENT DOCUMENT ACCEPTANCE WHEREAS, during the course of City improvement projects it becomes necessary to acquire easements for streets, utilities and drainage purposes for the benefit of the residents of the City of Lino Lakes; and WHEREAS, it is necessary that the City Council accept all grants of easements to the City prior to the recording of easement documents; and WHEREAS, such acceptance must be affixed on the easement document prior to acceptance by the Anoka County Recorder's office; and WHEREAS, there are certain emergency situations where it is necessary to record easements with the City's acceptance prior to the regularly scheduled Council meetings; and WHEREAS, the City Council has the legal authority to delegate the responsibility for acceptance of such easements to City staff members; NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: 1. That if, in the opinion of the City Engineer or the City Attorney, an emergency situation arises so that an easement must be accepted and recorded prior to the City Council meeting, that the City Clerk may affix the acceptance on behalf of the City and cause such easement document to be recorded. That the City Council shall be informed of such easement at its next regular scheduled Council meeting. Adopted by the Lino Lakes City Council th's 27th day of April, 1992. 46 Ai Mari yn Vernon F. The following voted against same: None. Whereupon said resolution was declared duly passed and adopted.
