Council Member Bergeson introduced the following Resolution and <br />moved its adoption: <br />CITY OF LINO LAKES <br />RESOLUTION NO. 92 - 83 <br />RESOLUTION AUTHORIZING THE MAYOR AND THE CITY CLERK TO ENTER INTO <br />A JOINT POWERS AGREEMENT WITH ANOKA COUNTY FOR THE IMPROVEMENT OF <br />ASH STREET (COUNTY ROAD J) <br />WHEREAS: a resolution of the City Council adopted on the 9th day <br />of March, 1992, fixed a date for a Council hearing on the <br />proposed street improvement of Ash Street, <br />WHEREAS: ten days' mailed notice and two week's published notice <br />of the hearing was given, and the hearing was held <br />thereon on the 13th day of April, 1992, at which all <br />persons desiring to be heard were given an opportunity to <br />be heard thereon, and <br />WHEREAS: a petition from 14 of the 22 affected property owners was <br />received asking that the improvement not proceed as <br />planned and asking that they not be assessed, and <br />WHEREAS: the Lino Lakes City Charter requires that if a petition <br />from 51% or more of the affected property owners against <br />the assessment id filed with the City, the assessment <br />shall not be made, and <br />WHEREAS: it is the consensus of the City Council that the <br />improvement should be completed as proposed by Anoka <br />County, <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />LINO LAKES: <br />1. Assessment of the affected property owners shall not be made <br />at this time. <br />2. The Mayor and the City Clerk -Treasurer is hereby authorized to <br />enter into a Joint Powers Agreement with Anoka County for the <br />improvement and the Lino Lakes share of the cost shall be <br />$23,976.00.
