Council Member Elliott introduced the following resolution and <br />moved its adoption: <br />CITY OF LINO LAKES <br />RESOLUTION NO. 92 - 137 <br />RESOLUTION DETERMINING THE NECESSITY FOR AND AUTHORIZING THE <br />ACQUISITION OF CERTAIN PROPERTY BY PROCEEDINGS IN EMINENT DOMAIN <br />WHEREAS, the City Council has heretofore determined that it is in <br />the public interest for the City of Lino Lakes to <br />construct a project known as Apollo Drive Improvements <br />for the benefit of the residents of the City of Lino <br />Lakes by construction of sanitary sewer, water, streets <br />and storm sewer; and <br />WHEREAS, the City Council has been advised that it is necessary to <br />obtain permanent and/or temporary easements for street <br />and utility purposes over certain properties owned within <br />the City in order to construct such improvement project, <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF LINO LAKES, <br />MINNESOTA, AS FOLLOWS: <br />1. The City Council hereby determines that acquisition of street <br />and utility easements are necessary for the construction of <br />the Apollo Drive improvement project as described above. <br />2. The City Attorney and City Engineer are authorized and <br />directed on behalf of the City to acquire all easements needed <br />for the construction of Apollo Drive Improvement Project by <br />the exercise of the power of eminent domain pursuant to <br />Minnesota Statutes, Chapter 117. The City Attorney is further <br />authorized to carry out the purposes of this resolution. <br />Adopted by the City Council this 23rd day of November, 1992. <br />19) <br />Marilyn <br />Vernon F.
