Council Member Neal introduced the following resolution <br />and moved its adoption: <br />CITY OF LINO LAKES <br />RESOLUTION NO. 21 — 93 <br />RESOLUTION ORDERING IMPROVEMENT OF TRUNK WATER AND SEWER UTILITIES, <br />PHASE II, APOLLO DRIVE <br />WHEREAS, <br />WHEREAS, <br />WHEREAS, <br />WHEREAS, <br />a resolution of the City Council adopted the 9th day of <br />November, 1992, fixed a date for a Council hearing on the <br />proposed improvement of trunk water and sanitary sewer <br />utilities, Phase II, Apollo Drive, and <br />ten days' mailed notice and two week's published notice <br />of the hearing was given, and the hearing was held on the <br />9th day of December, 1992 at which time all persons <br />desiring to be heard were given an opportunity to be <br />heard thereon, and <br />the 60 day waiting period from the date of the public <br />hearing has lapsed as required by the City Charter, and <br />two (2) petitions were received from five (5) of the <br />eight (8) affected landowners opposing the proposed <br />assessments, and <br />WHEREAS, the City Charter requires that 51% of the affected <br />landowners must approve the proposed assessments, <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />LINO LAKES: <br />1. Such improvement is hereby ordered as proposed in the Council <br />resolution adopted on the 9th day of December, 1992 except <br />that the improvement will not be financed with property <br />assessments but with funding from the Lino Lakes Sewer and <br />Water Area and Connection Fund. <br />Adopted by the City Council this 26th day April, 1993. <br />Vernon F. Reinert, Mayor <br />ter, <br />Marilyn <br />Anderson, Clerk -Treasurer <br />The motion for adoption of the foregoing resolution was duly <br />seconded by Council Member Elliott and upon vote being taken <br />thereon, the following voted in favor thereof: Bergeson, Elliott, <br />Kuether, Neal, Reinert. <br />The following voted against same: None. <br />Whereupon said resolution was declared duly passed and adopted. <br />
