Council Member Kuether <br />moved its adoption: <br />introduced the following resolution and <br />CITY OF LINO LAKES <br />RESOLUTION NO. 98-93 <br />RESOLUTION ADOPTING THE PERMANENT RULES OF THE <br />WETLAND CONSERVATION ACT <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LINO LAKES, ANOKA <br />COUNTY, MINNESOTA: <br />WHEREAS, the City of Lino Lakes is in the process of <br />preparing a Local (Surface) Water Management Plan (LWMP) for the <br />purposes of implementing the requirements of the 1991 Wetland <br />Conservation Act and other development needs in the City, <br />WHEREAS, the City wishes to become the Local Government Unit <br />(LGU) after completion of it's LWMP; and <br />WHEREAS, the local plan is scheduled for completion by <br />April 1, 1994; and <br />WHEREAS, the Minnesota Wetland Conservation Act of 1991 (WAC) <br />requires local government units (LGUs) implement this law by <br />adopting the rules and regulations promulgated by the Board of <br />Water and Soil Resources (BWSR) pertaining to wetland draining and <br />filling; and <br />WHEREAS, the LGU is responsible for making WCA determinations <br />for landowners; and <br />WHEREAS, the Rice Creek Watershed District and the Vadnais <br />Lake Area Water Management Organization previously assumed <br />responsibilities of LGU for wetland alterations within Lino Lakes, <br />MN under the interim rules and will continue to do so until the <br />LWMP is adopted. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF LINO LAKES, that it hereby accepts the responsibility as the LGU <br />for the WCA within the legal boundaries of Lino Lakes after the <br />City adopts the Local Water Management Plan, within the guidelines <br />as set forth by the WCA and rules. <br />Adopted by the Council this 13th day o December , 1993. <br />TEST: <br />Y - C�'LZ� L1�rL <br />Maril �G.
