Council Member Kuether <br />moved its adoption: <br />introduced the following resolution and <br />CITY OF LINO LAKES <br />RESOLUTION NO. 94- 05 <br />RESOLUTION APPROVING DEVELOPER'S REQUEST TO REALIGN THE <br />PARK TRAIL WITHIN THE SHORES OF MARSHAN LAKE SUBDIVISION <br />WHEREAS, the developer of the Shores of Marshan Lake Subdivision has requested <br />that the trail behind Lots 4 thru 12 of Block 5 be realigned closer to the lake, and <br />WHEREAS, several property owners abutting the trail also support realigning the trail <br />closer to the lake, and <br />WHEREAS, the Lino Lakes Park Board supports the proposed realignment, and <br />WHEREAS, the developer is responsible for obtaining all required new easements, and <br />WHEREAS, all additional costs due to the realignment will be borne by the developer. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />LINO LAKES, MINNESOTA, that the Council approves the realignment of the park trail <br />within the Shores of Marshan Lake Subdivision to the new location shown on the <br />attached exhibit. <br />BE IT FURTHER RESOLVED, that the Council will initiate vacation of the existing trail <br />easements on Lots 4 through 12 of Block 5 after the developer has completed <br />installation of the trail on the new alignment. <br />Adopted by the City Council of the city of Lino Lakes, this 14th day of February, 1994. <br />Vernon F.
