Council Member Bergeson introduced the following resolution and <br />moved its adoption: <br />CITY OF LINO LAKES <br />RESOLUTION NO. 94 — 38 <br />RESOLUTION VACATING A PORTION OF ROADWAY EASEMENT ALONG THE <br />SOUTHERN BORDER OF FOX TRACE <br />WHEREAS, R -Properties, Inc. has requested that the easement for <br />roadway purposes on the southern property line of the <br />subdivision of Fox Trace from Ware Road west to the <br />eastern property line of Lot 1, Block 1, Fox Trace (as <br />shown on the attached map) be vacated; and <br />WHEREAS, the vacation of the easement was made a condition to the <br />approval of the final plat of Fox Trace by the City <br />Council, and <br />WHEREAS, it appears that it will be for the best interest of the <br />City to vacate such portion of easement, <br />NOW, THEREFORE, BE IT RESOLVED, that the portion of roadway <br />easement shown on the attached map is hereby vacated. <br />Adopted by the Council of the City of Lino Lakes this llth day of <br />July, 1994. <br />Vernon F. Reinert, Mayor <br />j <br />Marilyn GJ Anderson, Clerk -Treasurer <br />the motion for the adoption of the foregoing resolution was duly <br />seconded by Council Member Elliott and upon vote being taken <br />thereon, the following voted in favor thereof: Bergeson, Elliott, Neal, <br />Reinert. <br />The following voted against same: none, Council Member Kuether was absent. <br />Whereupon said resolution was declared duly passed and adopted. <br />
