Council Member <br />Elliott <br />moved its adoption: <br />introduced the following resolution and <br />CITY OF LINO LAKES <br />RESOLUTION NO. 94 - 54 <br />RESOLUTION VACATING THE EAST 10 FEET OF SHERMAN LAKE ROAD ADJACENT <br />TO PHEASANT HILLS EAST <br />WHEREAS, Contractor Property Developers Company, developer of <br />Pheasant Hills Preserve, 4th Addition, has requested that <br />a portion of Sherman Lake Road be vacated as shown on the <br />attached map and described as follows: <br />That part of Sherman Lake Road as shown on Pheasant Hills <br />Preserve 4th Addition, Anoka County Minnesota, described <br />as follows: <br />Commencing at the southwest corner of Outlot C, said <br />Pheasant Hills Preserve, 4th Addition; thence easterly, <br />along the south line of said Outlot C, 14.69 feet to <br />the point of beginning of the parcel to be described; <br />thence easterly, along said south line 10.00 feet to <br />the corner of said Pheasant Hills Preserve 4th <br />Addition; thence southerly, 376.42 feet to the corner <br />of said Pheasant Hills Preserve, 4th Addition; thence <br />westerly, along said south line of said Pheasant Hills <br />Preserve 4th Addition 10.00 feet; thence northerly to <br />the point of beginning and there terminating. <br />WHEREAS, that portion of Sherman Lake Road as described above has <br />been reviewed by the City Engineer and no adverse future <br />problems were noted, and <br />WHEREAS, a public hearing was held on August 8, 1994 before the <br />City Council in the city hall after due published and <br />posted notice had been given by the Clerk -Treasurer on <br />July 21, 1994 and July 28, 1994 and all persons <br />interested were given an opportunity to be heard; and <br />WHEREAS, at least four-fifths of all the members of the City <br />Council concur in this resolution, <br />NOW THEREFORE, BE IT RESOLVED, that the portion of Sherman Lake <br />Road described above and shown on the attached map is hereby <br />vacated. <br />Adopted by the Council of the City of Lino Lakes this 8th day of <br />August, 1994. <br />
