Council Member Bergeson <br />moved its adoption: <br />introduced the following resolution and <br />CITY OF LINO LAKES <br />RESOLUTION NO. 95 — 39 <br />RESOLUTION DETERMINING THAT PETITION TITLED "CITY CAP ON BUILDING <br />NEW HOMES" IS INSUFFICIENT AND DIRECTING THE CLERK—TREASURER TO <br />DELIVER A COPY OF THE PETITION, TOGETHER WITH A WRITTEN STATEMENT <br />OF ITS DEFECT(S) TO THE SPONSORING COMMITTEE <br />WHEREAS, <br />WHEREAS, <br />WHEREAS, <br />WHEREAS, <br />a petition titled "City Cap on Building New Homes" <br />was submitted to the Clerk -Treasurer on February 22, <br />1995, 5:00 P.M. and <br />the petition is asking that an ordinance titled <br />"City Cap on Building New Homes" be placed on a City <br />ballot so that the citizens of Lino Lakes can vote <br />"Aye" or "Nay" on the proposed ordinance, and <br />the Lino Lakes Home Rule Charter states in Section <br />5.03 Determination of Sufficiency, that the required <br />number of signatures on the petition shall be <br />defined as five percent (5%) of the number of <br />registered voters at the time of the last regular <br />municipal election, and <br />the number of registered voters in the 1993 <br />Municipal Election was 5,824 which would require <br />that at least 292 signatures of registered voters <br />would be required to make the petition sufficient, <br />and <br />WHEREAS, the number of eligible signatures on this petition <br />was 186, <br />NOW THEREFORE, BE IT RESOLVED, that the City Council of the city of <br />Lino Lakes hereby determines that the petition is insufficient, and <br />BE IT FURTHER RESOLVED, that the City Clerk -Treasurer is hereby <br />directed to deliver a copy of the petition, together with a written <br />statement of its defects, to the sponsoring committee. <br />Adopted by the Lino Lakes City Council tris h day of March, <br />1995. <br />Vernon F.
