Council Member Elliott <br />resolution and moved its adoption: <br />CITY OF LINO LAKES <br />RESOLUTION NO. 95-104 <br />introduced the following <br />RESOLUTION ORDERING IMPROVEMENT OF CLEARWATER CREEK <br />WHEREAS, a resolution of the City Council adopted the 10th day of July, 1995, <br />fixed a date for a Council hearing on the proposed improvement of <br />Clearwater Creek, and <br />WHEREAS, ten days' mailed notice and two weeks' published notice of the <br />hearing was given, and the hearing was held thereon on August 14, <br />1995 at which all persons desiring to be heard were given an <br />opportunity to be heard thereon, and <br />WHEREAS, A petition signed by 100% of the property owners proposed to be <br />assessed for the improvements has been received to waive fifty (50) <br />of the sixty (60) days waiting period, and <br />WHEREAS, per City Charter Section 8.06 the City Council may immediately order <br />the proposed project, <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />LINO LAKES, MINNESOTA: <br />1. Such improvement is hereby ordered as proposed in the Council resolution <br />adopted the 10th day of July, 1995. <br />Adopted by the City Council this 9th day of October, 1995. <br />Vernon F. Reinert, Mayor <br />MarilynAnderson <br />Clerk -Treasurer <br />The motion for adoption of the foregoing resolution was duly seconded by Council <br />Member Kuether and upon vote being <br />taken thereon, the following voted in favor thereof: Elliott, Kuether, Neal, Reinert. <br />The following voted against same: None, Council Member Bergeson was absent. <br />Whereupon said resolution was declared passed and adopted. <br />CERTIFICATION <br />I hereby certify that the above is a correct copy of a resolution duly passed, adopted <br />and approved by the City Council on October 9 , 95. <br />Marilyn G.
