Council Member Kuether introduced the following resolution and moved its adoption: CITY OF LINO LAKES RESOLUTION NO. 95 - 150 RESOLUTION RECEIVING REPORT AND APPROVE PLANS AND SPECIFICATIONS - SUNSET ROAD. WHEREAS, pursuant to resolution of the council adopted November 13, 1995, a report has been prepared by the City Engineer with reference to the improvement of Sunset Road between Elm Street and the south line of 7164 Sunset Road by constructing sanitary sewer and water mains and services, and this report was received by the council on November 13, 1995. WHEREAS, the property owners at 7164 Sunset Road and 7172 Sunset Road have waived there right to a public hearing and appeal of assessment. WHEREAS, the property owners at 7164 Sunset Road and 7172 Sunset Road waive fifty (50) of the sixty (60) day waiting period as provided in section 8.06 of the Lino Lakes City Charter. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LINO LAKES, MINNESOTA: 1. The council will consider the improvement of such street in accordance with the report and the assessment of abutting property for all or a portion of the cost of the improvement pursuant to Minnesota Statutes, Chapter 429, and Chapter 8 of the Lino Lakes Charter, at an estimated cost of $38,380. 2. Plans and specifications prepared by the City Engineer, engineer for such improvement pursuant to council resolution, a copy of which plans and specifications is attached hereto and made a part hereof, are hereby approved and shall be filed with the city clerk. 3. Such improvement is hereby ordered as proposed in the council resolution adopted the 13th day of November, 1995.
