RESOLUTION NO. 96 - 47 <br />Page -2- <br />4. This Agreement shall be automatically renewed annually unless it is terminated in <br />whole or in part by either party upon 30 days written notice. <br />5. The Cities of Centerville and Lino Lakes hereby release from liability and waive <br />any claims against each other for any injuries, damages or loss to any person or <br />property arising from the work to be performed in the context of this agreement. <br />The parties further agree that each entity will be responsible for its own personnel, <br />equipment, and for injuries or death to such personnel or damage to any such <br />equipment. Insurance coverage and any financial compensation shall be the <br />responsibility of the governmental entity performing the work. Each party waives <br />the right to sue any other party for any workers compensation benefits to its own <br />employees even if the injuries were caused wholly or partially by the negligence <br />of any other party. <br />Adopted by the Lino Lakes City Council this 13th day of May, 1996. <br />L. Landers, Mayor <br />Marilyn G. derson, Clerk -Treasurer <br />The motion for the adoption of the foregoing resolution was duly seconded by Council <br />Member Lyden and upon vote being taken thereon, the following voted in favor thereof: <br />Bergeson, Kuether, Lyden, Landers. <br />The following voted against same: Council Member Neal. <br />Whereupon said resolution was declared duly passed and adopted. <br />
