CITY OF LINO LAKES <br />RESOLUTION NO. 96-142 <br />RESOLUTION VACATING A PERPETUAL PONDING AND FLOWAGE EASEMENT OVER <br />LOT 11, BLOCK 1, LINO AIR PARK NORTH AND ACCEPTING A REVISED <br />PERPETUAL PONDING AND FLOWAGE EASEMENT OVER SAID LOT. <br />WHEREAS, Carl Johnson, owner of the property legally described <br />as Lot 11, Block 1, Lino Air Park North, has requested that the a <br />perpetual ponding and flowage easement over his lot be reduced in <br />size, and <br />WHEREAS, the Rice Creek Watershed District originally <br />requested said ponding and flowage easement and has since <br />recommended its revision, and <br />WHEREAS, a public hearing was held on October 14, 1996 before <br />the City Council in the City Hall after due published and posted <br />notice had been given and all persons interested were given an <br />opportunity to be heard; and, <br />WHEREAS, it appears it will be for the best interest of the <br />City to vacate said perpetual ponding and flowage easement and <br />accept a revised easement over Lot 11, Block 1, Lino Air Park <br />North, and <br />WHEREAS, four fifths of all the members of the Council concur <br />in this resolution, <br />NOW, THEREFORE, BE IT RESOLVED, that the perpetual ponding and <br />flowage easement legally described by Kurth Surveying on August 15, <br />1996 be vacated and replaced by the following described perpetual <br />ponding and flowage easement: <br />All of Lot 11, Block 1, Lino Air Park North, Anoka <br />County, Minnesota, except the following: Commencing at <br />the northwest corner of said Lot 11; thence South 01 <br />degree 10 minutes 25 seconds West, assumed bearing, along <br />the west line of said Lot 11, 57.52 feet, thence North 88 <br />degrees 45 minutes 51 seconds East, 15.01 feet to the <br />actual point of beginning; thence continue North 88 <br />degrees 45 minutes 51 seconds East, 90.00 feet; thence <br />South 01 degree 14 minutes 09 seconds East, 174.00 feet; <br />thence South 88 degrees 45 minutes 51 seconds West, 7.50 <br />feet; thence South 01 degree 14 minutes 09 seconds East, <br />40.00 feet; thence South 88 degrees 45 minutes 51 seconds <br />West, 90.00 feet; thence North 01 degrees 14 minutes 09 <br />seconds West, 40.00 feet; thence North 88 degrees 45 <br />minutes 51 seconds East, 7.50 feet; thence North 01 <br />degree 14 minutes 09 seconds East, 174.00 feet to the <br />actual point of beginning. <br />Adopted by the Council of the City of Lino Lakes this 14th day of <br />October, 1996. <br />Landers, Mayor <br />Marilyn G.rAnderson, Clerk -Treasurer <br />
