Member <br />adoption: <br />Bergeson <br />introduced the following resolution and moved its <br />LINO LAKES CITY COUNCIL <br />RESOLUTION NO. 97-94 <br />EMINENT DOMAIN RESOLUTION <br />WHEREAS, the City of Lino Lakes proposed to develop 25 acres in the Lino Lakes <br />Village project for a public facilities complex, and <br />WHEREAS, Anoka County has agreed to covey title of the 25 acres currently within the <br />Rice Creek Chain of Lakes Regional Park Reserve to the City in exchange for <br />approximately 100 acres of parkland in the southern portion of the park preserve, and <br />WHEREAS, the City needs to acquire the 100 acres of parkland from the property owner, <br />and <br />WHEREAS, the Metropolitan Council has approved the land exchange within the park <br />preserve, and <br />WHEREAS, Lino Lakes has the authority to acquire land for public park purposes by <br />eminent domain pursuant to Minn Stat. No. 117; <br />NOW THEREFORE BE IT RESOLVED, that the City Council hereby authorizes the <br />acquisition of said land by eminent domain, pursuant to Minn. Stat. No. 117, and <br />BE IT FURTHER RESOLVED, that the City Attorney is requested to file the necessary <br />petition therefore, and to prosecute such action to a successful conclusion or until it is <br />abandoned, dismissed, or terminated. <br />Dated: August 11, 1997 <br />ATTEST: <br />�1/1 <br />.�n,L <br />r [arilyn G.
