Minnesota Rules Chapter 8410, subd. 9b. requires a schedule for implementation of local water plans that requires all local water plans to be adopted not more than two years before the local comprehensive plan is due. The following timeline summary indicates that the City has completed the requirements pursuant to the entirety of Minn. Stat. 103B.235 for Local Water Management Plans, including Subd.1 and Subd. 2: As referenced in the letter the City provided the Rice Creek Watershed District (RCWD) with the LWSMP on June 6, 2013. On July 16, 2013, and within the required 60 day review period pursuant to section 103B.235 Subd. 3, the City of Lino Lakes received the attached comments from RCWD on the LSWMP dated March 25, 2013 (See Attachment A). On July 11, 2013, and within the required 45 day review period pursuant to section 103B.235 Subd. 3a the City of Lino Lakes, the Vadnais Lakes Area Watershed Management Organization (VLAWMO), and RCWD received the attached comments on the LSWMP from the Metropolitan Council (See Attachment B). Prior to and culminating on December 15 and 23, 2015 EOR submitted to the City of Lino Lakes, and forwarded to RCWD, a response to the most recent RCWD comments pursuant to 103B.235 Subd. 5 (See Attachment C). This memo was reviewed by RCWD and later revised to reflect suggested changes (reflected in redlines). On January 13, 2016, RCWD Board of Managers approved the City of Lino Lakes LSWMP pursuant to Minn Stat. 103B.235 Subd. 3 (See Attachment D). Pursuant to Minn. Stat. 103B.235 Subd. 4 and as a result of the approval by RCWD and Metropolitan Council, as described above, the City of Lino Lakes shall adopt and implement its plan within 120 days of watershed adoption (no later than May 12, 2016) and shall amend its official controls accordingly within 180 days (no later than July 13, 2016).
