CITY OF LINO LAKES <br />RESOLUTION NO. 15-86 <br />RESOLUTION APPROVING THE FINAL PLAT <br />FOR NORTHPOINTE 3rd ADDITION <br />WHEREAS, the City has received an application for final plat approval for NorthPointe <br />3rd Addition hereafter referred to as "Development"; and <br />WHEREAS, City staff has completed a review of the proposed "Development" based on <br />the street and utility plan set and final plat dated June 22, 2015 and prepared by Carlson <br />McCain; and <br />WHEREAS, a public hearing was held before the Planning & Zoning Board on <br />December 11, 2013 and continued to the February 12, 2014 meeting and the Board <br />recommended approval of the PUD Development Stage Plan/Preliminary Plat; and <br />WHEREAS, the City Council approved the rezoning from R, Rural to PUD, Planned <br />Unit Development with Ordinance No. 02-14 and the PUD Development Stage <br />Plan/Preliminary Plat with Resolution No. 14-21; and <br />WHEREAS, Planning & Zoning Board reviewed and recommended approval of the 3`d <br />Addition final plat at the August 12, 2015 meeting; and <br />WHEREAS, the proposed development is not considered premature and meets the <br />performance standards of the subdivision and zoning ordinance; and <br />WHEREAS, the final plat substantially conforms to the preliminary plat. There is a <br />modification from the phasing plan. The original phasing plan for Phase III was for 92 <br />lots and included dedication of the parkland. The proposed Phase III (3`d Addition) is for <br />41 lots and parkland will be dedicated in Phase IV. <br />NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Lino <br />Lakes hereby approves the final plat for NorthPointe 3rd Addition, subject to the <br />following conditions: <br />1. All comments from City Engineer letter dated August 4, 2015 shall be addressed. <br />2. All comments from MNDOT letter dated July 20, 2015 shall be addressed. <br />3. A Development Agreement shall be drafted by the City, executed by the City and <br />the developer and recorded by the developer. <br />4. The Phasing Plan shall be revised to reflect changes from the original plan. <br />5. A south bound by-pass lane on 20th Avenue/CSAH 54 at Red Oak Lane shall be <br />constructed. <br />a. The applicant shall coordinate with Anoka County on design and <br />approval. <br />b. The approved construction plans shall be submitted to the City. <br />i <br />
