60 3A) Consider Approval of 2016-2017 Labor Agreement with AFSCME, Local 2454 —
61 Administrator Karlson explained that after several meetings and a mediation session, a labor
62 agreement has been reached with this bargaining unit. He recommends approval.

64 Council Member Maher moved to approve the 2016-2017 Labor Agreement as presented. Council
65 Member Rafferty, seconded the motion. Motion adopted on a voice vote.

67 3B) Consider First Reading of Ordinance No. 0146, Amending Chapter 505 of the Lino
68 Lakes Code of Ordinances - Administrator Karlson asked that the council consider first reading of
69 an ordinance amending the code to indicate that the Lino Lakes Public Safety Department will be
70 issuing burning permits for the city.

72 Council Member Rafferty moved to approve the first reading of Ordinance No. 01-16, as presented.

75 3C) Consider First Reading of Ordinance No. 0246, Amending Chapter 1002 of the Lino
76 Lakes Code of Ordinances — Administrator Karlson explained that this change would amend the
77 City Fire Code to indicate that the city's fire service is the Lino Lakes Public Safety Department and
78 authorizing them to carry out the state fire code.

80 Council Member Rafferty moved to approve the first reading of Ordinance No. 02-16, as presented.

83 3D) Consider First Reading of Ordinance No. 03-16, Amending Title 600, Chapters 601, 611,
84 612, and 615 of the Lino Lakes Code of Ordinances Relating to Business and Activity Licences
85 — City Clerk Bartell explained that Minnesota Statutes authorize the city's Public Safety Department
86 to conduct background checks for city licensing purposes. The Minnesota Bureau of Criminal
87 Apprehension allows access to their data base for this purpose but they expect that the city has proper
88 language in the code to allow that access. Staff has found that several changes to the city code are
89 needed in order to allow for continued access to the state data base. The changes are outlined in the
90 staff report before the council and are basically nonsubstantive in nature.

105 6B) Consider Resolution No. 16-38, Approving Amendments to the Designated Municipal
106 State Aid Street System- City Engineer Hankee explained that the proposed amendments would
107 maximize the city's use of these state funds.

109 Council Member Kusterman moved to approve Resolution No. 16-38 as presented. Council Member
110 Manthey seconded the motion. Motion carried on a voice vote.

112 6B) 2016 Mill and Overlay Project: i) Resolution No. 16-39, Accepting Bids and Awarding
113 Contract; ii) Resolution No. 16=40, Approving Construction Services Agreement with WSB &
114 Associates - City Engineer Hankee explained that the resolutions would authorize staff to accept the
115 bids and move forward with a construction contract for this year's project. The project includes
116 Holly Drive (reclamation), Holly Court (overlay) and Old Birch Street (overlay). She noted the low
117 bidder for the project, Park Construction.

119 Council Member Rafferty asked Ms. Hankee to review the project schedule.

121 Mayor Reinert noted that the city did have an issue with a street project last year and the city has
122 responded by tightening the system to ensure there will not be problems again.

124 Council Member Kusterman noted that the council has heard that the company is bonded and there is
125 full assurance they will do the job well.

127 Council Member Kusterman moved to approve Resolution No. 16-39 as presented. Council Member
128 Manthey seconded the motion. Motion adopted upon a voice vote.

130 Council Member Kusterman moved to approve Resolution No. 1640 as amended. Council Member
131 Manthey seconded the motion. Motion carried on a voice vote. Council Member Rafferty abstained
132 from voting.

134 6C) Saddle Club, Consider Resolution No. 1641, Approving the Conveyance of Conservation
135 Easement to Dupont Holdings, LLP -Community Development Director Grochala explained that the

136 city has already approved the final plat for the Saddle Club development. Wetland replacement is
137 required of the developer as part of the project. In this case, there is a wetland situation that requires the
138 developer to provide an easement to the state. The process of deeding the property didn't occur earlier
139 and now requires the city to give an easement back to the developer who can in turn fulfill his obligation
140 to the state. It doesn't impact the city but is more of a pass through.

143 Rafferty seconded the motion. Motion carried on a voice vote.
