Lino Lakes NE Drainage Area Study Update DRAFT MINUTES Evironmental Board May 25, 2016 Page 2 Ms. Thompson from WSB & Associates presented an update on the NE Area Drainage. The NE Area Drainage feasibility study models the drainage for 1400 acres of land on the east and west side of I-35E, and north of Main Street. The study evaluates water quality improvements and a new surface water outlet to Peltier Lake. Implementation of the plan will require approval from Rice Creek Watershed District (RCWD). The draft feasibility study was completed in January 2016 and submitted to City staff for review. After review by the Environmental Board and City staff, a new greenway option is now being considered. The new option includes the new culvert crossing under I-35E, storm sewer and regional storage facilities, and an open - channel greenway between Peltier Lake and 20th Ave. The greenway option also provides additional water quality treatment opportunities for the study are, above and beyond the City's and RCWD's development requirements. The new alignment takes advantage of existing culvert crossing under Peltier Lake Drive and utilizes an existing drainage way. Is in line with City's AUAR and proposed trail and greenway alignments. Also most flexible option for future development because of an earthen channel it can be moved when the land becomes available for future development. There has been two meetings with the affected landowners to discuss impacts to property and drainage systems, as well as to hear their opinions on the project alignments. After the meeting with Rice Creek Watershed District, it was determined that at the conceptual level, water quality impacts could be evaluated using a simple land use analysis. The analysis is based on a 1.1 inch rainfall depth, which corresponds to the RCWD volume treatment requirements. Ms. Bor asked if there were going to be improvements to Peltier Drive because of the road being under water in the spring time. Ms. Thompson said yes there may be some road improvements that my need to be done. It may be raised in order to get the culvert in and since it is a City road the city would be reasonable for maintaining the road. Ms. Thompson then said the next steps are finalize the feasibility study with the new alignment and present to the City Council on June 6. Submit Comprehensive Stormwater Management Plan to RCWD for review. Which really the governing rules for design and development, then begin final design of system. To continue grant applications. And then hoping to start construction 2017. DRAFT MINUTES Evironmental Board May 25, 2016 Page 3 Ms. Bor asked will this study come back to the Environmental Board. Ms. Thompson said we can have to come when the feasibility study is finalized for review. Mr. Asleson stated that RCWD also has to review, approve the numbers and comment on the Comprehensive Stormwater Management Plan for this feasibility study. Ms. Bor mentioned that this last report does not state an improvement in the water quality and being a member of the Environmental Board, the intent of the board is to be looking for opportunities to improve the environment. Ms. Thompson said this is true but the study does not take into effect the benefits of an open channel. That the channel is flat and long enough that there will be some filtration to the water before it enters Peltier Lake. Ms. Andrzejewski made a MOTION that the Council accept the feasibility study and pursue an open channel design alternative. Ms. Kaufenberg seconded. Amendment to the recommendation is as part of this proposal is to look at any and all opportunities to improve the phosphorus level coming off of this development. Motioned carried 6 — 0. B. Preliminary Plat, PUD Site Plan Review Woods Edge Woods Edge is a proposed 112 unit attached townhome development on 11.2 acres, located north of Village Drive and south east of Town Center Parkway. Back in January 2003 the Environmental Board reviewed "Legacy Holdings", today called Woods Edge. The project was approved at that time with Environmental Board recommendations. Recommendations from 2003 are unchanged except for new rules in surface water, wellhead protection, landscape requirements, Stormwater Pollution Prevention Planning requirements, and Tree Preservation. There are new design standards for development which are now in effect from the Rice Creek Watershed District. City staff are now in the process of updating the overall "Legacy at Woods Edge" development Stormwater Management report to conform to the current standards of the Rice Creek Watershed District. Additional features will likely be needed to incorporate additional stormwater management practices and features in to the project design. Mr. Sullivan asked what the time line for this development is and are these single level townhomes. DRAFT MINUTES Evironmental Board May 25, 2016 Page 4 Mike Suel from DR Horton Inc., stated that they are hoping to get started this fall and the townhomes are three level. Ms. Kaufenberg asked if the city was working with home owners association's in regards to best management practices on chemical usage, irrigation and recycling as well as organics recycling. Mr. Suel said there will be a HOA for the whole site. As far as water conservation practices there will be soil sensors as part of the water usage for this project. Ms. Bor thanked Mr. Suel for his openness to the suggestions of the Woods Edge development. Mr. Suel said if the Board has any more ideas or suggestions please share them with Mr. Asleson for it will be easier and more cost effective to input the changes up front instead of after the development is in. Mr. Asleson mentioned that part of the recommendation should be that the native areas around the ponds should be a company that is approved by the City in the installing and maintaining of this area for five years. Ms. Bor made a MOTION to recommend approvable of this project with the changes suggested by the Environmental Board as it goes on to the P&Z Board and then the project should come back to the Environmental Board. Amendments to the recommendations is to add nature plantings by the ponds and Ms. Kaufenberg suggestion to add a plan for recycling and to use best management practices. Ms. Andrzejewski seconded. Motioned carried 6 -0. VI DISCUSSION ITEMS A. Minnesota Bird Talk, Liz Kaufenberg Ms. Kaufenberg has talked to Monica Bryand and it looks like September 28 Environmental Board meeting is when she would like to present her findings and also invite the public to this meeting. Minnesota Birds and Endangered Species is what the talk would be about. Ms. Bor mentioned that it should be advertised in the City's newsletter, web site and in the newspaper. Mr. Heiskary suggested that Ms. Bryand can present at the board and then she can do some additional talks at other locations. We will put it first on the agenda. B. Recycling Day Discussion, Marty Asleson DRAFT MINUTES Evironmental Board May 25, 2016 Page 5 Mr. Asleson mentioned that at the annual city wide recycling there was not as many people. We offer tires, carpet and paper shedding which is not offered at our Saturday monthly event. Mr. Asleson suggested a shorter hours for the annual recycling day for next year. C. Recycling Updates, Aubrey Fonfara Ms. Fonfana was happy to announce that the City of Lino Lakes recived a award called Reuse Pioneer from Anoka County for starting the program of donating furniture to Bridgeing and St. Vincent De Paul. Organic drop off program partitipation is at 89 households which is about 1.4% of the population of the City of Lino Lakes. So far 205 bags of organics has been collected. As of those particting in the program 52% heard about it from the recycling flyer, 32% from the city newsletter and 8% from their neighbors. A lot of the people are within the 2 miles raduis of the organics drop off sites. Mr. Heiskary would like to have the information published somewhere. Such as the Quad, web site and city newsletter. Also add questions and answer about orgainics recycling. Ms. Bor would like to see the recycling information presented to the City Council. Next Recycling Saturday will be June 18, 2016. VII. Respectfully submitted, Mary Fogarty DRAFT MINUTES STAFF ORIGINATOR: MEETING DATE: REQUEST: APPLICANT: ENVIRONMENTAL BOARD AGENDA ITEM 5A Marty Asleson, Environmental Coordinator June 29, 2016 Review: Clearwater Creek Business Park -United Properties Distribution Facility Rezoning and PUD Development Stage Plan/Preliminary Plat. United Properties Distribution 3600 American Boulevard W #750 Bloomington, MN 55401 OWNERS: Rehbein Properties PROPOSED DEVELOPMENT United Properties has submitted a request for rezoning to Planned Unit Development, Development Stage Plan Approval and Preliminary Plat approval for the 56 acre Clearwater Creek Business Park. The proposed plat includes one 30-acre lot for a proposed distribution center and two out lots for future development. The Planning and Zoning board held a public hearing for the proposal on June 8, 2016. Based on revisions to the site plan the proposed distribution facility is approximately 402,552 square feet in area. The applicant is proposing to pursue a rezoning to Planned Unit Development to allow for design flexibility related to the proposed storage of semi- trailers on the site. Development of the site will require the extension of 21st Avenue, from Commerce Avenue to approximately 2,100 feet south. Extension of the street includes the crossing of Clearwater Creek and filling and mitigation of floodplain areas adjacent to the creek. 21 st Avenue is planned to be extended to Cedar Street, further to the south, in the Comprehensive Plan. The project proposes to dedicate right of way for the entire length of the roadway. 1 ANALYSIS Existing Site Conditions The survey shows the Judicial Ditch No. 3 (Clearwater Creek) and adjacent floodplain. There appear to be numerous wetlands on site, a wetland delineation has been submitted. There are a number of wetlands scattered throughout the site and many of those are shown as being impacted by improvements. See Attachment. The site is relatively flat and is primarily cultivated fields. There are small wooded areas in the southwest corner, adjacent to the ditch and within the wetlands. Xcel Energy has an easement across the south portion of the site for an electric transmission line. There is an existing billboard (off -premise sign) in the northeast portion of the site. Off - premise signs are prohibited by Section 1010 of the City Code. This appears to be a legal, nonconforming sign, which is allowed to remain. A sewage lift station is located in an easement in the northwest portion of the site. The site is most likely drain -tiled. Soils All of the soils on the Lino Lakes Business Park site are flat to flat concave, or with depressanal areas, higher pH, mostly poorly drained. These soils supported wet grass species and trees to some extent. Soils management in Clearwater Business District proposal site is most important consideration from a water management and plant growth perspective. The soils in the proposal site are very thick glacial deposits of unconsolidated glacial till. These soils are clay with everything else including rocks, boulders and gravel areas. The Soils are classified as B/D soils that signifies the soils are drained, and have little infiltration. (See Attachment). Area subsoils consist of sandy clay with some sand seams. Water elevations in some the test borings show up around 2 -3 feet and go down as deep as 20 feet. From the Geotechnical Report for the Site, Braun Intertech discusses soils in the infiltration basin on the north side of the proposal. They say that based on their experience, actual infiltration rates on this site may be less that what is predicted in the design manual portion of the Minnesota Stormwater Manual. They recommend that the Minnesota Stormwater Manual should be consulted for further design best practices. Water reuse may be a good alternative BMP if infiltration rates are inadequate. 2 Recommendation: Soils should be monitored for impacts to the Drinking Water Service area contamination, and existing wetland resources. Impacts can be created by uncovering a "gravel -vein" or sand seams where polluted water can enter into a DWSMA water source, and where wetlands can be drained by creating a "drain situation" for close proximity wetlands. Gravel and or other pervious areas encountered in excavation areas for ponds and created wetlands and general excavation must be sealed. Special consideration must be given to site horticultural practices, and compacted soils discussed later in this report. Recommendation: That infiltration areas be further tested and that water reuse be considered as an additional BMP if, as suggested by Braun Intertec, the soils are slower infiltrators than the Minnesota Stormwater Manual predicts. Minnesota Stormwater Manual be consulted for further design best practices. As with all developments environmental concerns for soil compatibility has been a recommendation that no soils shall be imported on to the site without City staff approval. Land Cover The MLCCS has most of the site listed as corn, or cultivated farmland. There are small wooded areas in the southwest corner, adjacent to the ditch and within the wetlands of the site. Pre -vegetation and the soil survey indicates that at pre -settlement time the land was mostly wet grasses and some tree areas. Significant Resources The closest know unique resource is 3000 feet away from this site. The soils are not conducive to rare plants. Tree Preservation The applicant must provide a detailed tree preservation plan to the city. Landscaping Where screening is required, the code suggest that a combination of landscaping and berms be used to provide screening. The PUD flexibility is requested to allow outside storage adjacent to I-35E and we would like to see a more comprehensive screening plan to screen the outside storage from I-35E, 21st Avenue and the residential area south of Cedar Avenue. A staggered double row of trees and/or fencing or berming could be used to increase this screen. All continuous year round planting screens shall require at a minimum a double row of plants with triangulated spacing. Planting plans shall include species which are sized to appropriately screen visibility within five years of planting. Small shrubs shall be a planted at a maximum interval of 3' on center; medium shrubs 3 shall be planted at a maximum interval of 4' on center; and large shrubs shall be planted at a maximum interval of 6' on center unless; otherwise authorized by the City. The applicant should provide a cross section or elevation showing the effectiveness of the screen. Other recommendations: 1. Plants that are intolerant of higher pH soils should not be used on this site. 2. Evergreens must not be used in any of the native seed mix areas. Evergreens may be planted in the sod and any irrigated cultured seed areas 3. MNDOT seeding methods as in the MNDOT Seeding Manual must be used for Native seed areas. 4. Native Seed areas must be planted and maintained by a City approved contractor that has experience and knowledge in the planting of a native seed area. 5. A 5-year maintenance plan must be written for the site and accepted by the City. 6. All cultured seed and sod areas must be irrigated. 7. Seed types must be identified on the landscape plan. 8. Seed types must be approved by the City. Wetlands There are number of wetlands delineated on site and in the area where the 21st Avenue improvements are planned. It appears that there are wetland impacts from the street project and the development on Lot 1. The Rice Creek Watershed District (RCWD) is the LGU for the Wetland Conservation Act. At the May 31st meeting with the city and RCWD, the applicant indicated that they intended to prepare a full watershed application on June 6th for a July 27th RCWD board review. 21 st Avenue is proposed to be a temporary cul du sac ending at the south parking lot. The roadway would be extended down to Cedar Street in the future. As part of the future road extension RCWD is requiring a wetland sequencing plan for the roadway alignment all the way to Cedar. The applicant is to work through the process with the RCWD. 4 Wetland Management Corridor The site is located within the limits of the RCWD Lino Lakes Comprehensive Wetland Protection and Management Plan (CWPMP) boundary. The RCWD CWPMP landscape scale Wetland Management Corridor (WMC) is shown to extend through the site along the banks of Clearwater Creek, with a slight overlap of the southern edges of delineated Wetlands 8 and 9 WMC. According to RCWD Rule F.6.(b)3)(ii) - The District, in its judgment, may retract the WMC boundary on the basis of site -level information demonstrating that the retraction is consistent with the associated CWPMP and does not measurably diminish the existing or potential water resource functions of the WMC. In making such a decision, the District may consider relevant criteria including wetland delineation, buffer and floodplain location, WMC connectivity, protection of surface waters and groundwater recharge, and whether loss would be reduced by inclusion of compensating area supporting WMC function. Field observations suggest that the site level WMC should not extend any further than the eastern property line. Within the subject site, Clearwater Creek/Anoka County Ditch No. 3 is a channelized public ditch (not wetland) with no adjacent floodplain wetland. Additionally, extension of the WMC into the subject site does not result in the gain of a corridor encompassing high priority wetland resources — either onsite or nearby. Wetlands 8 and 9 are partially -drained ditches that contain wetland vegetation and their immediate surroundings have been manipulated in the past by farming and construction activities. Retraction of WMC limits to the east property line will not measurably diminish the existing water resource functions of the WMC, or result in a disconnect/gap in the landscape scale WMC. Retraction will also not result in the exclusion of high value wetlands, or the loss of high value existing wetland buffer areas. As proposed, the project will require a total of 0.3637 acres of impact to wetlands. The proposed plan meets the project purpose, need, goals, and requirements as described previously. The proposed project represents an orderly and logical use of the subject property and is compatible with applicable land use and policy plans. Impacted Wetland Replacement Plan: Onsite wetland replacement was rejected because: 1) there are no wetland restoration opportunities, and 2) wetland creation within the project area (between stormwater features and Clearwater Creek) would not be hydrologically sustainable. Under RCWD Rule F, wetland bank credits may be used for CWPMP replacement if the chosen bank is located within a CWPMP or CWPMP Contributing Drainage Area. The U.S. Army Corps of Engineers (USACE) requires that the wetland bank chosen be within 5 the same Bank Service Area as the wetland impacts, and that the credits used be Corps certified. The Hair Wetland Bank meets the requirements for WCA, CWPMP, and USACE regulatory requirements and was therefore selected to meet mitigation obligations. Because the majority of wetland impacts are to Type 3 ditch wetland, Subgroup B was chosen. Flood Plain The applicant is proposing to fill 1.670 acres of floodplain, and mitigate 11.024 acres of flood plain.through the creation of the two ponds on the north side of the building. See Attachment. The Natural Resources based City Open Space Suitability Analysis Modal shows the proposed area as Moderately Suitable for Development, with a small corridor area along the creek and flood plain area to the north as Marginally Suitable. See Attachment. Natural Resources Greenway and Wetland Preservation Corridor Overlay The Lino Lakes Natural Resources and Wetland Preservation Corridor Overlay shows the Clearwater Creek area as part of the overlay on the Lino Lakes Business Park site. The developer must provide at least a 50 foot buffer, 25 foot average buffer along the corridor depicted on the attached map. The Developer is proposing to place this buffer area along the creek with a conservation easement placed over it. The Easement must name both the City and the Rice Creek Watershed as easement holders. Waste and Recycling The plans must be revised to show trash/recycling areas. The ordinance requires all refuse, recyclable materials, and necessary handling equipment including but not limited to garbage cans, recycling bins and dumpsters shall be stored within the principal structure, within an accessory building, or totally screened from eye level view from all neighboring uses and the public right-of-way. Exterior storage of refuse and recyclable material shall require the following: 1. Exterior wall or fence treatment shall be similar and/or complement the principal building. 2. The enclosed trash and/or recycling receptacle area shall be located in the rear or side yard and shall observe all applicable setback requirements and easements. 3. The trash and/or recycling enclosure must be in an accessible location for pick up hauling vehicles. 6 4. The trash and/or recycling receptacles must be fully screened from view of adjacent properties and the public right-of-way by a fence or wall of at least six (6) feet in height and a minimum opaqueness of eighty (80) percent. Storm Water WSB reviewed the Stormwater Drainage Report for United Properties, dated May 16, 2016, and provided by Plowe Engineering, Inc. and have the following comments: 1. Provide drainage area maps for existing and proposed conditions. 2. The HydroCAD total drainage areas between existing and proposed conditions do not match. 3. The stormwater treatment basins shall be separate for the site and street impervious areas. AUAR Review An AUAR was completed for the project area in 2005 and updated in 2015. Please Find attached the AUAR Review and Mitigation Plan for the Clearwater Creek Business Park, completed by WSB. Drinking Water Protection After searching the County Well Index, there does not appear to be any private wells on this site. The site is however in a moderately susceptible area of contamination to groundwater in our new Drinking Water Service Management area. Precautions should be taken to contain fueling stations for equipment used to construct this site. This is also required in the SWPPP. Lighting A photometric plan must be submitted to the City to ensure compliance with the ordinance standards: 1. Any lighting used to illuminate a structure, an off-street parking area, or other area shall be arranged so as to deflect light away from any adjoining residential property or from any public right-of-way. All lighting shall be installed in accordance with the following provisions: a. The luminaire shall contain a cutoff which directs and cuts off the light at an angle of ninety (90) degrees or less. 7 b. Light sources shall not be permitted so as to light adjacent property in excess of the maximum intensity defined in § 1007.043 (6)(d) of this Ordinance. c. Architectural/historical light fixtures that feature globes that are not shielded, or lighting of entire facades or architectural features of a building may be approved by the City Council. In no case shall the light affect adjacent property in excess of the maximum intensity defined in § 1007.043 (6)(d) of this Ordinance. d. The maximum height of the fixture and pole above the ground grade permitted for light sources is thirty (30) feet. A light source mounted on a building shall not exceed the height of the building. In no case shall the height of a light source mounted on a pole or on a building exceed the height limits of the zoning district in which the use is located, unless allowed by conditional use permit. e. The light source of an outdoor light fixture shall be set back a minimum of ten (10) feet from a street right-of-way and five (5) feet from an interior side or rear lot line. f. No light source shall be located on the roof unless said light enhances the architectural features of the building and is approved by administrative permit. g. The use of outdoor lighting for parking lots serving commercial and industrial businesses shall be turned off one (1) hour after closing, except for approved security lighting. h. All illuminated on premise signs for advertising purposes shall be turned off between 12:00 AM and sunrise except that said signs may be illuminated while the business facility on the premise is open for service. i. Direct or reflected glare from high temperature processes such as combustion or welding shall not be visible from any adjoining property. Erosion and Sediment Control The submitted plan is site specific. The developer is responsible for all aspects of the MPCA requirements for construction site sediment and erosion control. There must not be any disturbance of the soils on this site until the SWIPP is fully engaged and authorized by City environmental and engineering. For reference please see notes on the Mitigation checklist enclosed, along with the following comments. FISH, WILDLIFE ECOLOGICALLY SENSITIVE RESOURCES 1. AUAR Mitigation Item 11.1. The AUAR highlights this area as part of the Conservation Design Framework (CDF) with a future greenway corridor and trail from Cedar Street north through the property. Clearwater creek is located within the parcel and a 100 foot buffer is required per the mitigation plan. The plans indicate less than 60 feet within the proposed conservation easement adjacent to the creek. It is unclear if this conservation easement is representative of the creek buffer, and if so it is inadequate. 2. AUAR Mitigation Item 11.8. The AUAR requires an eagle nest survey. At the time of the AUAR update (June 2015); the DNR did not have records of any eagle nests within 1 mile of the project area. There are not many trees on the site, but those that are present are primarily adjacent to Clearwater creek. The presence of an eagle's nest seems unlikely, but city environmental staff should confirm. 3. AUAR Mitigation Item 11.10. The AUAR requires a rare plant survey to be completed in wetlands and other designated areas. There are wetlands present within the development area. Has the developer completed a rare plant survey yet? 4. AUAR Mitigation Item 11.12. The AUAR requires that the CDF include consideration of, among other things, protection of ecologically significant natural resources from adjacent land uses by implementing buffering. Clearwater creek bisects the development parcel, and per the AUAR requires a 100 foot buffer. The plans indicate less than 60 feet within the proposed conservation easement adjacent to the creek. AUAR Mitigation Section 12.1. Wetlands exist within the development area and confirmation of boundary approval by the Wetland Conservation Act (WCA) Local Government Unit (LGU) should be obtained. 2. AUAR Mitigation Sections 12.2 — 12.6. The project proposes 0.36 acres of wetland fill. An application has been prepared by Kjolhaug Environmental Services. The application will need to be reviewed and approved by the WCA LGU and US Army Corps of Engineers (ACOE). The application should include sequencing measures and a replacement plan and will also need to conform to the wetland alteration requirements set forth by the Rice Creek Watershed District (RCWD). 3. AUAR Mitigation Section 12.7. Clearwater creek is not proposed to be impacted. WATER USE 1. AUAR Mitigation Section 13.5. The AUAR requires that abandoned private wells be sealed in accordance with Minnesota Department of Health (MDH) regulation. There are no known wells on the property, but if any undocumented wells are encountered they should be sealed in compliance with MDH regulations. EROSION AND SEDIMENTATION The plans submitted June 17, 2016 do not include erosion or sediment control plans. The grading plans and Stormwater Pollution Prevention Plan (SWPPP) were reviewed for compliance with the AUAR. 1. AUAR Mitigation Section 16.1. Project proposers are required to obtain a NPDES/SDS General Stormwater Permit for Construction Activity from the MPCA prior to initiating earthwork. This permit should be obtained and filed with the city prior to construction. 2. AUAR Mitigation Section 16.2. Project proposers are required to meet the erosion and sediment control regulations in all applicable regulations, ordinances, and rules of the city and MPCA and RCWD. A SWPPP has been prepared for the project. A sediment and erosion control plan should also be prepared and reviewed by the applicable regulatory agencies for compliance with rules. 3. AUAR Mitigation Section 16.3. Project proposers are required to minimize runoff, improve the quality of runoff, and provide erosion control through BMPs and other low impact development techniques. The SWPPP provided with the plans outlines various BMPs, but specific use of BMPs should be shown on an erosion and sediment control plan. 4. AUAR Mitigation Section 16.4. Project proposers are required to provide construction oversight to ensure designed sediment and erosion control measures are being implemented. The SWPPP indicates that an individual has not yet been identified to provide this oversight. The individual(s) providing this oversight should be identified and contact information provided in the SWPPP. 5. AUAR Mitigation Section 16.5. This section requires the implementation of the CDF. The AUAR highlights this area as part of the Conservation Design Framework (CDF) with a future greenway corridor and trail from Cedar Street north through the property. CR 140 (80th Street )/I-35E 1 CSAH 14 Alternative Analysis Report — July, 2004, SRF Consulting Group, 16 Mitigation Plan Update - 2015 June 3, 2015 Interchange 4. CSAH 14 across Peltier Lake (Northerly Bypass/Connector) 5. CSAH 14/I-35W Interchange As part of these improvements, the following steps should be taken as the opportunity is presented: • Inclusion of the northerly bypass and proposed interchanges in future transportation and comprehensive plans • Preservation of right of way through official mapping or other process • Right of way dedication through the platting process 21.3 Require a traffic impact analysis for all development projects within the AUAR area. The traffic impact analysis will assist the City and other road authorities in determining the appropriate mitigation measures that are required to mitigate impacts of a specific development proposal. This mitigation measure is ongoing N/A21.4 Work with appropriate road authorities to mitigate the impact of the additional traffic on the on the regional system, specifically Interstates 35W and 35E, by reconstructing each to provide a six -lane cross-section consistent with the recommendations outlined in the I-35 IRC. It should be noted that it was determined that an expansion will be necessary even without the development scenarios used in this analysis. As the interstates serve a much larger area, the projected growth of the entire Twin Cities region should warrant expansion by the year 2030. This mitigation measure is ongoing 17 Mitigation Plan Update - 2015 June 3, 2015 21.5 Prioritize alternative travel modes within the AUAR study area and require project proposers to address alternative travel modes (e.g., buses, bicyclists, and pedestrians) by identifying appropriate accommodations. This mitigation measure is ongoing. 21.6 Consider the need for additional infrastructure improvements (see item #21.2) in future updates or amendments to the Comprehensive Plan. Submit the plan update to the appropriate agencies (i.e., FHWA, MnDOT, Met Council, etc.). This mitigation measure is ongoing 21.7 Require project proposers to follow all appropriate guidelines and policies related to traffic nose and noise walls. This mitigation measure is ongoing 21.8 Require that site plans for each of the developments include measures such as appropriate setback distances, earthen berms, noise walls, and appropriate site design to reduce the impact of traffic noise to residential areas. CULTURAL RESOURCES 18 Mitigation Plan Update - 2015 June 3, 2015 Item No. Mitigation Description Update Plan Review 25.1 Consult the map that shows areas with a high potential for archaeological sites when development applications are submitted for review. Given the sensitive nature of this information, this map cannot be included in the AUAR document, nor can it be made available to the public. If a development application falls within an area that is considered to have a high potential for archaeological sites, the city will require that the following steps and procedures involved in the identification and analysis of any archaeological sites is followed prior to development: ■ Conduct a Phase I archaeological survey within the area of potential effect (APE). The objective of the archaeological fieldwork is to determine if there are archaeological sites in the areas identified as having high potential for such, and define the extent of those sites that may be impacted by development plans. ■ Conduct a Phase II archaeological survey. If archaeological resources are uncovered within the APE that may be eligible for listing on the National Register of Historic Places (NRHP) a Phase II survey should be conducted. The proposed development is a 35 lot single family residential subdivision located north of CSAH 34/Birch Street and east of Hokah Drive. The development contains one 30.47 gross acre parcel and is called as St Clair Estates. ANALYSIS Existing Site Conditions The 30 acre site is bordered by the Rice Creek Chain of Lakes Regional Park Reserve on the north, Rice Lake Elementary School on the east, single family homes and CSAH 44/Birch Street on the south and a residential subdivision to the west. The site consists of grasslands, woodlands and wetlands and is in the Anoka sandplain. Elevations range from 880 feet (wetland area) to 900 feet. A stormwater management pond for CSAH 34 owned by Anoka County and maintained by the City is located on PID #29-31-22-32- 0004 (473 Birch Street) and drains east into an open ditch. Soil borings indicated sandy and silty materials. Soils are classified as a hydrologic group and not hydric that signifies the soils are suitable for infiltration. Shenandoah 3rd Addition along Hokah Drive was platted in 1979 with 48 single family lots. Hokah Drive existed as a long cul-de-sac until 2012 when Sioux Lane was extended to the west. Hokah Drive was reconstructed in 2015. Spirit Hills along Sioux Lane was platted in 2001 with 51 single family lots and the retail center. 1 The City and County undertook an extensive reconstruction project of the intersection at Ware Road and Birch Street and installed traffic signals to address traffic issues. The intersection of Hodgson Road and Birch Street is also signalized. The Resource Management System Plan identifies the following needs in the area: • Proposed designated bike route • Existing Trails • Greenway system connectivity A separate, at -grade, bituminous trail exists along the north and south side of CSAH 34/Birch Street and is a designated bike route and regional trail. The existing trail provides pedestrian connectivity to the Rice Lake Elementary School, Rice Creek Chain of Lakes Regional Park and Sprit Hill Center, a multi -tenant retail center. A new trail will be constructed off the end of the cul-de-sac south to Birch Street to provide addition connectively. The greenway corridor extends north -south incorporating the wetland and floodplain areas. This corridor will be preserved with a conservation easement. Soils Soils in the proposed St Clair Estates location are Zimmerman Sand on the west side of the project where the road and housing pads are located. Most of the proposed ponds and infiltration areas are located within this Zimmerman soil profile. The Zimmerman soils on this site have a deep profile and has plenty of separation from the water table making it ideal for infiltration and safe in the DWSMA area. On the East side of the project there are some Lake Beach and Muck soils that enter in to the buffer area, and a bit where the 2 proposed middle pond is located. The pond should be designed for the separation needed from the water table, and/or lined. Land Cover The MLCCS Land Cover for St Clair classifies the majority of the St Clair site as it has Cultivated herbaceous vegetation, and some seasonally flooded altered/non-native dominated emergent vegetation on the east side. There is a grouping of trees in the center of the project, and trees on the boarder of the west and south boundaries. Significant Resources With each additional subdivision review in the City, additional natural resources and rare features data are being documented, refined, and collected as part of local, state, and federal environmental review requirements and environmental regulatory programs. Environmental review of proposed subdivisions has resulted in the discovery and documentation of additional high quality natural community remnants and additional rare feature records (rare plant communities, state -listed plant and animal populations) that were not able to be accessed or documented during previous county -wide or city-wide surveys and inventories. Many of these new discoveries are a direct result of the City's Conservation Development policies and processes. Significant natural resources data that result from environmental reviews of proposed subdivisions and developments are incorporated into local and state databases and plans, and are used to help guide land development to help avoid, preserve, and enhance rare, sensitive, or otherwise important natural features within the City and to incorporate natural areas into contiguous city-wide greenway corridor systems. St Clair Estates has the soil and floodplain features of an area on the south and east side of the large wetland know as wetland 1. Rare plants were found in the beach sand/floodplain overlap areas south and east of the school. Similar profiles exist on the east edge of this development. Since this area is a buffer area, and will be under conservation easement, plants will be protected on the closest edge to wetland 1. Disturbance to the buffer area for stormwater modifications should have the organic soils (top soil) stockpiled and replaced as close as possible to the original site removal. Seed bank for native plants will be viable in this soil and can be re -applied to the buffer. Areas immediately east of any storm water modifications, must be protected from any disturbance by fence. Blanding's Turtle activity area is shown in the Lino Lakes Blanding's Turtle Modal on the St Clair Estates site. Recommend installing surmountable curb in the project to eliminate a road barrier to the Blanding's Turtle. Blanding's Turtle will travel a fairly large distance to lays eggs and always lay eggs in sandy areas. The green way proposed in the wetland preservation corridor should be a good nesting area for the Turtles, but if they decide to go further west, they could do that with street barriers eliminated. Surface Water/Storm Water 3 Per the Site Design Narrative and Storm Water Calculation report, the existing site is mostly undeveloped open field with minimal tree coverage. Soil borings generally indicate sandy materials (fine-grained sand — SP; fine-grained sand with silt — SP-SM) with some silty materials (silty fine sand — SM). The majority of the site drains east and north to Rice Lake. Three NURP ponds and one infiltration basin are proposed to manage stormwater. The proposed infiltration basin located in the "boulevard loop" shall be eliminated or shall be HOA maintained. Standard drainage and utility easements at least 10 feet wide are provided along all lot lines. Drainage and utility easements shall also be dedicated 10 feet above the high water level over stormwater drainage ponds. Drainage and utility easements are also shown as being dedicated over stormwater management out -lots. Conservation Easement Conservation easements shall be dedicated over the wetland management corridor. The conservation easement must name the city and the watershed district as easement holders. Signs that are acceptable to the RCWD and the City of Lino Lakes must be placed on the lot boundaries to the Conservation Easement area stating no encroachment allowed. Tree Preservation The goal of tree preservation is to minimize unnecessary loss of habitat, biodiversity and forest resource and to replace removed trees in areas where tree cover is most critical. The Tree Inventory identifies the basic use area (BUA), Environmentally Sensitive Areas (ESA) and trees proposed for removal. According to the plan, there are 104 total trees being removed within the BUA, 0 trees being removed outside the BUA and 15 new trees required for replacement. These 15 replacements trees will be satisfied through open space area landscaping requirements. All bordering trees on properties next to the project must be fenced off with orange fence to ensure there is no impacts to private trees on bordering properties. Landscaping Boulevard trees are required at the rate of one (1) tree per lot frontage for single family and two family lots. Thirty-eight (38) boulevard trees are proposed which is compliant with the ordinance. Open areas are being landscaped with 33 trees and 99 shrubs as required by Section 1007.043(16). Landscape screening and buffers are not required. 4 Pond area seed mix in their landscape plan is indicated as MNDOT mix 33-641. There is no such seed mix that I could find. The developer must submit a native seed mix that is acceptable to the City. All trees planted in pond areas with a native seed mix must be tolerant of fire. Fire is a tool used to maintain healthy native plant communities. This basically limits the species to Oak. The developer should submit a substitution for Fall Fiesta Sugar Maple. Fall Fiesta is a good urban tree but does not do well in sandplain soils. A red maple would be a better choice. The City will select the species for boulevard trees. Wetlands A wetland boundary delineation report was prepared by Jacobson Environmental, PLLC on April 18, 2016. An application for wetland boundary was submitted to RCWD and is pending approval. According to the report, 2 wetland types were found on the subject site. Two sample points were also taken west of the wetlands and were found to lack wetland hydrology. Per the preliminary plat, the wetland area is 13.6 acres. The development maintains a greenway corridor and does not propose any wetland impacts, therefore; no wetland mitigation is required. The wetland Preservation Corridor will require a 50 foot average buffer, 25 foot minimum buffer. The wetland preservation corridor is depicted on attachment. The Corridor is subject to change based on ground based actual delineation. It is believed that at this time there will be some changes to the corridor. The 1-2 wetland area has been determined to not be wetland so this will push the wetland corridor in this area to the east. The site is located within in the RCWD Lino Lakes Comprehensive Wetland Protection and Management Plan boundary and Wetland Management Corridor (WMC). A conservation easement covering approximately 2.6 acres of wetland buffer is proposed. Comments: 1. RCWD WCA Notice of Decision shall be provided to the City. Flood Plain Flood plain areas encroaching on to the site may support rare plant communities. Surface Water 5 The site is located within the Rice Lake resource management units (RMU). The majority of the site drains east and north to Rice Lake. A small portion drains west to Shenandoah Acres, which in turn drains to Hokah Drive and then to Rice Lake. Water diverted to a proposed infiltration basins on the site have the required 3 foot separation from the water table. According to our City Engineering review the following comments were made: 1. Rate control is being met. 2. All water quality requirements are being met. 3. The stormwater management design and calculations need to be updated and re- submitted with the proposed changes for review. We do not anticipate any significant changes to the proposed layouts with relation to the storm sewer system. 4. The side yard storm sewer on narrow lots needs to be coordinated with the building plans. No overhanging windows or window wells can be installed. A clear 20 feet needs to be provided. The applicant shall provide a summary of side yard storm sewer with pipe depths and a summary of how future access for maintenance will be accommodated. The developer's engineering report states there are 420,000 SF of wetlands on the proposed site. There will be no wetland impacts, including there will be no increase in 6 wetland bounce (increase in water elevation after a storm event). From our Engineer's report: 1. Provided the LGU approves the wetland delineation, there are no proposed wetland impacts. Therefore, no wetland mitigation approval is needed. 1. Wetland buffers are shown on the plan set. The RCWD will have regulatory authority over review and approval of the wetland buffer. 2. A conservation easement is recommended for parcels adjacent to the lake to protect the buffer area. Storm Water A Storm Water Management Plan submitted as part of the Civil Drawings has been submitted. Detail information on SWPPP construction site management must be submitted before ground is broken for the proposed project. Drinking Water Protection St Clair Estates has two DWSMA classifications associated with the land. For the most part as seen in the DWSMA attachment, the area has a Moderate Vulnerability. Vulnerability determines what types of potential contamination sources must be managed within the DWSMA or as determined by the Department of Health. In the Moderate vulnerability areas of the DWSMA wells and tanks must be managed. The small area on the south end of the development proposal is shown as high vulnerability and in that case all land uses and potential contaminant sources, including wells and tanks must be managed. There does not appear to be any wells on the site. Tree Preservation The goal of tree preservation is to minimize unnecessary loss of habitat, biodiversity and forest resource and to replace removed trees in areas where tree cover is most critical. The Tree Inventory identifies the basic use area (BUA), Environmentally Sensitive Areas (ESA) and trees proposed for removal. According to the plan, there are 104 total trees being removed within the BUA, 0 trees being removed outside the BUA and 15 new trees required for replacement. These 15 replacements trees will be satisfied through open space area landscaping requirements. Tree areas that border adjacent properties must be fenced off if the trees are privately owned. Fencing out to the driplines, or as much as feasible must be maintained to protect adjacent private trees from sustaining root damage. 7 According to our tree replacement standards, 15 trees will need to be replaced. Lighting Low intensity, downward focused lighting with cut off lenses to eliminate glare must be used. Recommend that LED smart type lighting be used. Landscape Plan Boulevard trees are required at the rate of one (1) tree per lot frontage for single family and two family lots. Thirty-eight (38) boulevard trees are proposed which is compliant with the ordinance. Open areas are being landscaped with 33 trees and 99 shrubs as required by Section 1007.043(16). Landscape screening and buffers are not required. Shoreland Management Overlay District The site is located in a Shoreland Management Overlay district. Rice Lake is a Natural Environment Lake with an 883.1 OWHL elevation. A setback of 150 feet from the OHWL is required for all primary and accessory structures. Impervious surface coverage of 30% applies to all lots within the overlay district. The plan submitted meets the setback requirement for the overlay District. That is 150 feet from the Ordinary High Water of (OHW) of Rice Lake, there can be no building. The OHW level of Rice Lake is 883.1. The site is designed to meet this requirement. The 150 foot no -build line comes right up to the back of a few proposed house pads. The developer must create an awareness of this no -build line, with written correspondence, copy the city and ensure all future sales of the property has the awareness document follow the sale. Storm Water Management and Erosion and Sediment Control Before any ground breaking occurs, a complete Stormwater Pollution Prevention Plan, (SWPPP) must be accepted by the city. At the time of ground breaking, all of the concerns of the Minnesota Pollution Control permit issuance must be met. A certified inspector must be in contact with the City. All weekly and post rainfall inspection reports, and follow up corrections made must be emailed to the City in a timely manner Failure to do so could result in a "Stop Work Order".
