RESOLUTION NO. 16-08
RESOLUTION APPROVING
LOCAL SURFACE WATER MANAGEMENT PLAN
WHEREAS, Emmons & Olivier Resources, Inc., has prepared the City's Local Surface Water
Management Plan in accordance with Minnesota Statutes, Section 103B.235; and
WHEREAS, the City has completed the requirements pursuant to the entirety of Minn.
Stat. 103B.235 for Local Water Management Plans.
NOW, THEREFORE BE IT RESOLVED by The City Council of The City of Lino Lakes
that the Local Surface Water Management Plan is hereby approved
Adopted by the Council of the City of Lino Lakes this 8th day of February, 2016.
The motion for the adoption of the foregoing resolution was introduced by Council Member
Kusterman and was duly seconded by Council Member Maher and upon
vote being taken thereon, the following voted in favor thereof:

INTRODUCTION
Staff is requesting City Council authorization to distribute the draft Local Surface Water
Management Plan for review in accordance with Minnesota Statutes.
BACKGROUND
The City of Lino Lakes is required to prepare a Surface Water Management Plan that must, at a
minimum, meet the requirements for local plans in Minnesota Statutes, Section 103B.235 and
be in conformance with Watershed District, Management Organization, and Metropolitan
Council plans. The Rice Creek Watershed District (RCWD) completed an update to their
watershed management plans in June of 2010 which subsequently required an update to the
City's plan.
The plan provides an assessment of the City's land and water resources, identifies issues and
establishes goals and policies for 12 management categories, identifies proposed actions to
implement the plan and estimated costs, as well as describing the process to administer the plan
and coordinate with other local and regional agencies.
The City Council authorized preparation of the plan in June of 2011. The City's Environmental
Board reviewed the plan, prepared by EOR, Inc., at their March 27, 2013 regular meeting and
recommended approval of the plan. Under state law the plan must be distributed for review
and comment to RCWD, VLAWMO, Metropolitan Council, and Anoka County prior to City
approval of the document. The plan was approved for distribution by the City Council on May
13, 2013 (Resolution 13-64).
No comments were received from the Vadnais Lake Area Water Management Organization
(VLAWMO) or Anoka County. Metropolitan Council completed its review in June of 2013
and commended the City on its proactive approach to water management. The City received
comments from the RCWD in July of 2013 requesting modification to the plan primarily
related to intercommunity surface water flows. This led to continued discussions with the
RCWD regarding the NE Drainage Area. Additional language was added to the plan to
acknowledge the City's work on the NE Drainage Area and that implementation of planning for
the area would be subject to RCWD rules and approvals. The RCWD Board of Managers
approved the plan on January 13, 2016.
Pursuant to Minn. Stat. 103B.235 Subd. 4 and as a result of the approval by RCWD and
,, Metropolitan Council, as described above, the City of Lino Lakes shall adopt and implement its
plan within 120 days of watershed adoption (no later than May 12, 2016) and shall amend its
official controls accordingly within 180 days (no later than July 13, 2016).
Staff does not anticipate the need for any further amendments to official controls, outside of the
NE Drainage Area, as a result of the plans adoption. The City's Stormwater, Erosion and
Sediment Control ordinance was amended in 2015.
RECOMMENDATION
Staff is recommending approval of Resolution No. 16-08
