RESOLUTION NO. 16-19
APPROVING FIRST AMENDMENT- JOINT POWERS AGREEMENT
BETWEEN THE CITY OF LINO LAKES AND THE CITY OF CENTERVILLE
REGARDING 21st AVENUE STREET AND UTILITY IMPROVEMENTS AND
MAINTENANCE
WHEREAS, 21' Avenue between Main Street and a point approximately 1,400 feet
north of Main Street is a line road between Lino Lakes and Centerville, with the
corporate boundary in the center of the street, as platted; and
WHEREAS, The City of Centerville and the City of Lino Lakes paved 21' Avenue
between Main Street and a point approximately 1,400 feet north of Main Street pursuant
to a Joint Powers Agreement; and
WHEREAS, the two Cities also desire to enter into a Joint Powers Agreement for the
ongoing maintenance of 21' Avenue.
NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Lino
Lakes that the Joint Powers Agreement with the City of Centerville concerning the
ongoing maintenance of 21' Avenue between Main Street and a point approximately
1,400 feet north of Main Street.
Adopted by the Council of the City of Lino Lakes this 11th day of April, 2016.

Member Manthey and was duly seconded by Council Member Maher

INTRODUCTION
Staff is requesting City Council consideration of a First Amendment - Joint Powers Agreement
with the City of Centerville for 21' Avenue Street and Utility Improvements and Maintenance.
BACKGROUND
On August 6, 2013 the City Council approved Resolution No. 13-91, for a Joint Powers
Agreement with the City of Centerville regarding the 21' Avenue Improvement Project. The
21" Avenue Improvement project was from Main Street (CSAH 14) to a point approximately
1,400 feet to the north. The project included a new roadway, storm sewer, water main, sanitary
sewer, and pedestrian facilities.
21' Avenue is centered on the corporate limits of Lino Lakes and Centerville. Accordingly an
agreement between both cities was required for construction; and this amendment addresses the
ongoing maintenance. The City of Centerville approved the agreement at their March 9, 2013
City Council meeting.
RECOMMENDATION
Staff is recommending approval of Resolution No. 16-19.

between Main Street and a point approximately 1,400 feet north of Main Street pursuant
to a Joint Powers Agreement; and
WHEREAS, the two Cities also desire to revise that Joint Powers Agreement for the
ongoing maintenance of 21 sI Avenue.
NOW, THEREFORE BE IT RESOLVED by the City Council of the City of
Centerville that the Joint Powers Agreement with the City of Lino Lakes does adopted
the FIRST AMENDMENT- JOINT POWERS AGREEMENT BETWEEN THE CITY
OF LINO LAKES AND THE CITY OF CENTERVILLE REGARDING 21st AVENUE
STREET AND UTILITY IMPROVEMENTS AND MAINTENANCE.

FIRST AMENDMENT- JOINT POWERS AGREEMENT
BETWEEN THE CITY OF LINO LAKES
AND THE CITY OF CENTERVILLE
REGARDING 21d AVENUE STREET AND UTILITY IMPROVEMENTS AND
MAINTENANCE
THIS AGREEMENT is made and entered into on the latest date set forth below by and
between the City of Centerville and the City of Lino Lakes, governmental subdivisions of
the State of Minnesota.
RECITALS
1. The City of Centerville (hereinafter described as "Centerville") and the City of
Lino Lakes (hereinafter described as "Lino Lakes") have entered into a Joint
Powers Agreement for the construction and maintenance of 21st Avenue between
Main Street and a point approximately 1,400 feet north of Main Street; and
2. Section 5 addresses the street maintenance responsibilities between Lino Lakes
and Centerville; and
3. It is in the best interest of Centerville and Lino Lakes to identify the specific street
maintenance responsibilities and cost share of each City.
AGREEMENT
In consideration of the mutual undertakings herein expressed, Lino Lakes and Centerville
agree that Section 5 shall be amended and the existing language is replaced with the
following:
A. Lino Lakes shall, at its expense, perfonn annual street sweeping, pothole filling,
snow plowing and winter sanding/de-icing.
B. Lino Lakes and Centerville will crack fill and sealcoat the roadway on a 5-7 year
interval.
C. Lino Lakes shall perform periodic inspections of the storm sewer conveyance
system/pond and by undertake any necessary corrective action.
D. Mowing and landscape maintenance shall be the responsibility of each City
within their City limits.
E. A City is obligated to pay a debt under this Agreement only if it approves the cost
or estimated cost of work performed pursuant to this Agreement before any work
is performed or any cost is incurred.
IN WITNESS WHEREOF, Centerville and Lino Lakes have caused this Agreement to be
executed on behalf of the proper officers.
