HomeMy WebLinkAbout2016-043 Council ResolutionCITY OF LINO LAKES RESOLUTION NO. 16-43 RESOLUTION APPROVING THE PUD FINAL PLAN/FINAL PLAT FOR CENTURY FARM NORTH 6TH ADDITION WHEREAS, the City has received an application for PUD Final Plan/Final Plat approval for Century Farm North 6th Addition hereafter referred to as "Development"; and WHEREAS, City staff has completed a review of the proposed "Development" based on the following plans and information: • Revised plan set prepared by Plowe Engineering, Inc. dated April 1, 2016 and received by the City on April 5, 2016; and • Robinson Drive Street & Utility Improvements prepared by WSB WHEREAS, a public hearing was held before the Planning & Zoning Board on April 9, 2014 and continued to the May 14, 2014 meeting and the Board recommended approval of the Amended PUD Development Stage Plan/Preliminary Plat; and WHEREAS, the City Council approved the rezoning from R, Rural to PUD, Planned Unit Development with Ordinance No. 06-14 and the PUD Development Stage Plan/Preliminary Plat Amendment with Resolution No. 14-43; and WHEREAS, the Planning & Zoning Board reviewed and recommended approval of the Century Farm North 66 Addition PUD Final Plan/ Final Plat at the March 11, 2015 meeting; and WHEREAS, the proposed development is not considered premature and meets the performance standards of the subdivision and zoning ordinance; and WHEREAS, the final plat is consistent with the Amended PUD Development Stage Plan/Preliminary Plat; and NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Lino Lakes hereby approves the PUD Final Plan/Final Plat for Century Farm North Addition, subject to the following conditions: 1. All comments from City Engineer letter dated May 18, 2016 shall be addressed. 2. The following executed documents shall be recorded with Anoka County within 90 days of City Council approval of final plat: a. Development Agreement and Planned Unit Development Agreement b. Final Plat c. Consent to Plat d. Declaration Establishing Wetland Buffer 1 e. Conservation Easements f. Easements for public drainage and utilities as required by RCWD g. Deed for Outlot A and Outlot B h. Public street, drainage and utility easement for the northbound CR 53/Sunset Avenue right turn lane onto Robinson Drive. i Public drainage and utility easements across property owned by developer abutting CR 53/Sunset Avenue to accommodate proposed water main improvements. 3. The following items shall be submitted to the City prior to issuance of a Grading Permit: a. Revised plans based on staff comments. b. Executed Declaration for Maintenance of Storm Water Facilities. c. NPDES Permit. d. RCWD Permit. e. Securities and Escrows as detailed in the Development Agreement. f. Grading Permit Fee of $150. 4. The following items shall be submitted to the City prior to issuance of a Building Permit: a. Revised plans based on staff comments. b. Building Permit Fee as determined by the Building Official. c. An as -built survey of the grading. Adopted by the Council of the City of Lino Lakes this 13th day of June, 2016. Consider Resolution No. 16-45 Approving Maintenance Agreement for Stormwater Management Facilities VOTE REQUIRED: 3/5 INTRODUCTION Staff is requesting City Council consideration of the Final Plat, Development Agreement and Maintenance Agreement for Century Farm North 6th Addition. Complete Application Date: February 9, 2015 Environmental Board Meeting: February 25, 2015 Park Board Meeting: March 2, 2015 Planning & Zoning Board Meeting: March 11, 2015 Council Work Session Meeting: May 23, 2016 Council Meeting: June 13, 2016 Final Plat Extension: July 31, 2016 BACKGROUND Century Farm North is a residential Planned Unit Development (PUD) in northwest Lino Lakes and was approved in 2003. In July 2014, the Planning & Zoning Board and City Council reviewed and approved an amendment to the PUD Development Stage Plan/Preliminary Plat of Century Farm North to include a 0.991 acre parcel located 7880 Sunset Avenue owned by Jeff Morell. The parcel was rezoned to PUD, Planned Unit Development to be consistent with 1 Century Farm North. The project also includes the realignment and extension of Robinson Drive to CR 53/Sunset Avenue. The applicant has submitted a land use application for PUD Final Plan/Final Plat of Century Farm North 6th Addition. The following staff report is based on the revised plan set prepared by Plowe Engineering, Inc. dated April 1, 2016 and received by the City on April 5, 2016. Previous Council and Board Actions: • Ordinance No. 06-14 to Rezone Property located at 7880 Sunset Avenue from R, Rural to PUD -Planned Unit Development • Resolution No. 14-43 Approving Amendment to PUD Development Stage Plan/Preliminary Plat • Resolution No. 14-49 Approving Petition and Waiver Agreement from Century Farm North Development, Inc. and Jeffrey E. Morell for Robinson Drive Improvements • Resolution No. 14-68 Approving the Deposit Agreement for Robinson Drive Improvement Project • Resolution No. 14-57 Authorizing the Preparation of Plans and Specifications, Robinson Drive Improvements • Resolution No. 15-140 Extending Time for the Submittal of the PUD Final Plan/Final Plat Analysis The Planning & Zoning Board staff report dated March 11, 2015 details the project's consistency with the Comprehensive Plan and compliance with the zoning and subdivision ordinances. Blocks and Lots The final plat creates 29 lots and 3 outlots. Outlot A is a wetland. Outlot B is a stormwater management facility. Outlot C is for future townhome development. Street and Public Utilities In July 2014, the developer signed a Petition and Waiver Agreement for road construction, utility extension and right-of-way dedication for Robinson Drive. The Agreement authorized the City Engineer to prepare plans and specifications for the improvements and allowed the City to levy construction improvement costs against the property. 2 In January 2015, the developer decided to use the City's plans and specification and complete the construction improvements on their own and not have assessments. The developer shall convey a public street, drainage and utility easement at a sufficient width, as determined by the city, for the northbound Sunset Avenue right turn lane to Robinson Drive. The developer shall also provide public drainage and utility easements across property owned by developer abutting Sunset Avenue to accommodate proposed water main improvements. The developer has come to an agreement with Anoka County Highway Department to construct a northbound right tum lane from CR 53/Sunset Avenue onto Lilac Street in lieu of constructing a southbound by-pass lane on CR 53/Sunset Avenue at Robinson Drive. Easements Standard drainage and utility easements are being dedicated on individual lots and over stormwater management facilities. Twenty foot wide drainage and utility easements are shown along the rear lot lines for storm water management. Conservation easements will also be dedicated over Outlots A & B for protection of the wetlands and wetland buffers. RCWD also requires separate easements for public drainage and utilities. Public Land Dedication and Fees The original Century Farm North fulfilled the public land dedication requirements for the entire development through parkland dedication and trail construction. The PUD amendment created 8 additional lots that are subject to the City's Park Dedication fee at $2,500 per lot. The following park dedication requirements shall be met: Park Land Dedication and Fees 8 lots x $2,500 payment in lieu of land dedication = $20,000 TOTAL 520,000 Zoning Century Farm North 6th Addition is zoned PUD, Planned Unit Development as approved by the City Council with Ordinance No. 06-14. Comprehensive Plan The PUD Final Plan/Final Plat is in compliance with the Comprehensive Plan in terms of the Resource Management System, Land Use Plan, Housing Plan, and Transportation Plan as detailed in previous staff reports. Development Agreement 3 A Development Agreement has been drafted by the City and shall be executed by the developer. Title Commitment The City Attorney reviewed the title commitment and final plat and notes consent to plat documents will be required by the mortgage companies. Stormwater Maintenance Agreement A Maintenance Agreement for Stormwater Management Facilities has been drafted and shall be executed. Earth Moving/Borrow Pit Conditional Use Permit In September 2015, the Council approved with Res. No. 15-91 a conditional use permit for earth moving/borrow pit for Jeff Morell. The borrow pit was to be utilized during the development of Century Farm North 6th Addition. It is staff's understanding the borrow pit will no longer be used for this development. RECOMMENDATION The Planning & Zoning Board reviewed the PUD Final Plan/Final Plat on March 11, 2015. The Board and staff recommend approval of the following items with conditions as listed: 1. Resolution No. 16-43 Approving PUD Final Plan/Final Plat 2. Resolution No. 16-44 Approving Development Agreement 3.
