RESOLUTION NO. 16-64
RESOLUTION APPROVING THE PUD FINAL PLAN/FINAL PLAT
FOR NORTHPOINTE 4Tn ADDITION
WHEREAS, the City received an application for PUD Final Plan/Final Plat approval for
NorthPointe 4th Addition hereafter referred to as "Development"; and
WHEREAS, City staff completed review of the proposed "Development" based on the
NorthPointe 4th Addition Sanitary Sewer, Watermain, Storm Sewer and Street
Construction Plans dated May 12, 2016 and final plat received on June 23, 2016 and
prepared by Carlson McCain; and
WHEREAS, a public hearing was held before the Planning & Zoning Board on
December 11, 2013 and continued to the February 12, 2014 meeting and the Board
recommended approval of the PUD Development Stage Plan/Preliminary Plat; and
WHEREAS, the City Council approved the rezoning from R, Rural to PUD, Planned
Unit Development with Ordinance No. 02-14 and the PUD Development Stage
Plan/Preliminary Plat with Resolution No. 14-21; and
WHEREAS, Planning & Zoning Board reviewed and recommended approval of
NorthPointe 4th Addition PUD Final Plan/Final Plat on June 8, 2016; and
WHEREAS, the proposed development is not considered premature and meets the
performance standards of the subdivision and zoning ordinance; and
WHEREAS, the PUD Final Plan/Final Plat substantially conforms to the PUD
Development Stage Plan/Preliminary Plat.
NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Lino
Lakes hereby approves the PUD Final Plan/Final Plat for NorthPointe 4th Addition,
subject to the following conditions:
1. All comments from City Engineer letter dated June 2, 2016 shall be addressed.
2. The Development Agreement shall be executed by the City and the developer and
recorded by the developer.
3. The developer shall draft the deed for Outlot D, NorthPointe 4th Addition to the
City for parkland dedication.
4. The Phasing Plan shall be revised to reflect changes from the original plan.
5. A FEMA Letter of Map Revision shall be required by the City prior to any
building permits being issued on lots affected by the floodplain.
6. No permanent enclosed structures will be allowed in the park pursuant with the
City's Floodplain Management Ordinance
7. Title Commitment:
a. Consent of the Mortgagees shall be obtained
Adopted by the Council of the City of Lino Lakes this 11th day of July, 2016.
The motion for the adoption of the foregoing resolution was introduced by Council
Member Maher and was duly seconded by Council Member
Nanthey and upon vote being taken thereon, the following voted in favor
thereof:
Maher, Manthey, Rafferty, Kusterman, Reinert
