Attached is an outline of the applicants for each of the boards or committee. Park Board — 2 seats, 2 applicants P &Z — 3 seats, 3 applicants Environmental Board — 4 seats, 4 applicants (one 2 -year term; three 3 -year terms) EDAC — 3 seats, 2 applicants At the December work session the council decided to interview only new applicants, of which there are two. Ms. Nancy Morin, applicant for the Environmental Board, was interviewed by the council on December 10. Mr. Thomas Colgin, applicant for EDAC, was not able to make it on December 10 but will be interviewed at the start of the work session on January 7. Requested Council Direction The council is requested to establish their preference for appointments /reappointments to the city's advisory groups. Since there are as many applicants as openings, staff proposes to forward all the applicants to the council for approval at the January 14, 2013 city council meeting. I n the city t here a re currently seven approved off -sale liquor licenses (including G -Will Liquor s that is n ot yet built) and one off -sale 3.2 (beer) license. There is one additional off - sale liquor license and one off -sale gr owler license that will be presented to the council in Janua ry. The locations of existing and proposed licenses ar e noted on the attached map. A survey of surround ing cities provided the following information regarding their regulations on off -sale lice nses:  Centerville (pop 3,792), no limitation on number/proximity other than state law;  Circle Pines (pop 4,918), no limitation on number/proximity other than state law;  Blaine (pop. 57,186), one license per 7,000; one license allowed within one -mile radiu s;  New Brighton (pop. 21,456), one license per 5,000; one license allowed within one - mile radius;  Shoreview (pop. 25,043), one license per 5,000, no restriction on proximity;  Coon Rapids (pop. 61,476), have Class A and Class B; Class A licenses limited to 8 and proximity limited to one -mile radius; Class B limited to 2 and proximity limited to two -mile radius;  Forest Lake (pop. 18,375), maximum of 10 licenses; no restrictions based on population or proximity;  White Bear Lake (pop. 23,797), no limitation on number/proximity other than sta t e law;  Anoka (pop. 17,142), municipal liquor only. Hammerheart Brewing Co. 7785 Lake Drive (55014) (Proposed Off-Sale Growler) 12/31/2012 WS – Item 5 WORK SESSION STAFF REPORT Work Session Item No. 5 Date: January 7, 2013 To: City Council From: Jeff Karlson Re: Minnesota Government Data Practices Act Background In a court decision last April, the Court of Appeals held that ele cted council members are not employees under the Minnesota Government Data Privacy Act (MGDPA). In this case, a citizen submitted a data request for the council members’ cell phone records, text messages, and emails. The deputy clerk obtained personal ph one records and redacted them before providing the records to the citizen. The council members sued the city arguing that their cell phone records were private personal data. The MGDPA defines personal data as “government data on individuals maintained b ecause the individual is or was an employee of . . . government entity.” The term employee is not defined by the MGDPA, but the Commissioner of Administration has issued a series of advisory opinions on how to classify elected officials. The Commission er opined that the classification of data about elected officials depends on whether the entity considers the elected official to be an employee. I received a legal opinion from City Attorney Joe Langel who advised that council members are generally not c ity employees under the Minnesota law, but all that would be needed to make that occur would be passage of a resolution. I contacted the League of Minnesota Cities to find out if other cities have designated council members as employees. The League in tur n sent an inquiry to its list serve. Robbinsdale is the only city we’re aware of that classifies council members as employees. Requested Council Direction This is for your consideration. Attachments None WS – Item 11 WORK SESSION STAFF REPORT Work Session Item No. 11 Date: January 7, 2012 To: City Council From: Mary Alice Divine Re: Letter of Support for HOME and CDBG grant s Background Dominium has proposed the development of an affordable tow nhome project of approximately 40 -50 units in the Legacy development. Staff has worked with the development team over the past several months to determine the financial feasibility of the project. Several sources of income are needed by Dominium for this p roject to move forward. Staff has negotiated with the developers from the point of view that it is imperative that the City receive of all or a substantial portion of outstanding special assessments on the parcel(s) that Dominium would acquire. One issue that was unresolved for the developer has since improved with the passage of the “Fiscal Cliff” legislation, extending a fixed 9% tax credit for affordable housing and improving the developer’s pro forma. While negotiations with Anoka County and the City a re still in early stages, Dominium would like to begin putting funding sources in place by applying for an Anoka County HOME grant and a CDGB grant, both which provide funding to affordable housing projects throughout the County. The deadline for these app lication s is January 14. Dominium has requested a letter of support from the City to include with the application s . This letter of support does not imply any future financial commitments on the part of the City, Anoka County or Dominium. Requested Council Direction Staff is seeking consensus of the Council to provide a letter of support for Dominium’s HOME grant and CDGB grant application. January 8, 2013 Nick Anderse n, Development Associate Dominium 2905 Northwest Blvd., Ste 150 Plymouth, MN 55441 Re: 2013 HOME Grant and Community Development Block Grant (CDBG) Application s – City of Lino Lakes, MN Dear Mr. Anderse n, The City of Lin o Lakes is writing this letter in support of Dominium’s application s to the Anoka County 2013 HOME Investment Partnerships and CDBG Program s for assistance with the construction of affordable townhomes in the City’s Legacy at Woods Edge project near the 35 W/Lake Drive interchange. Anoka County has lon g been supportive of this mixed -use development in Lino Lakes, including participation in the reconstruction of the 35W /Lake Drive interchange and providing HOME funds for the construction of the Lakewood Apar tments workforce housing in 2004 . That funding was needed to assist with construction of the first apartment building in Lino Lakes and the first family -oriented affordable housing. Its success, under Dominium ownership and management, was a major step in providing a diversity of housing choices within the City. The proposed Dominium townhome project will further adva nce the City’s Town Center Design and Development Guide standards for housing density in the Legacy development, as well as advancing the Cit y’s ability to meet Metropolitan Council’s Livable Communities goals. An award of HOME and CDBG funds is essential to make the project financially feasible and allow Dominium to continue pursuing the project. The City looks forward to working with Dominium and Anoka County to move this important project for the City of Lino Lakes forward and to provide additional diversity of housing in southeast Anoka County.
