RESOLUTION NO. 16-132
A RESOLUTION CLARIFYING LICENSING REQUIREMENTS FOR OWNER
INSTALLED INDIVIDUAL SEWAGE TREATMENT SYSTEMS
WHEREAS, Minnesota Rules, 7083.0700 established licensing requirements for the installation of
Individual Subsurface Sewage Treatment Systems (ISTS); and
WHEREAS, rules provide that individuals of property may construct an ISTS to serve a
dwelling that is owned by the that individual; and any assistance to the owner must be performed
by a licensed installation business; and
WHEREAS, for purposes of administration of the rules the City Council finds it is necessary to
clarify the responsibility of the owner and the circumstances in which the assistance must be
performed by a licensed installation business.
NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Lino Lakes that:
1. Where an owner applies for and receives a permit under the provisions of 7083.0700 the
owner or the owner's designated representative shall be on-site during construction of the
system.
2. Individuals assisting or helping the system owner with installation, without
compensation, are not required to be licensed.
Adopted by the Council of the City of Lino Lakes this 10th day of October, 2016.
The motion for the adoption of the foregoing resolution was introduced by Council Member
Rafferty and was duly seconded by Council Member Manthey and upon
vote being taken thereon, the following voted in favor thereof:
Rafferty, Manthey, Kusterman, Reinert
