I. II. CALL TO ORDER AND ROLL CALL: APPROVAL OF MINUTES: Gelbmann made a MOTION to approve the minutes of the March 8, 1995 meeting as submitted and was supported by Johnson. All voted aye. Motion carried. APPROVAL OF AGENDA: Chair Schaps noted an addition to the agenda, Item VI. A. Conflict of Interest Forms. Al Robinson made a MOTION to approve the agenda as amended and was supported by Guy Herr. All voted aye. Motion carried. ELECTION: Schaps called for a nomination for Chairman for the 1995 year. Al Robinson made a MOTION to nominate Jamie Schaps as Chairman for the 1995 year, and was supported by Guy Herr. All voted aye. Motion carried. Chair Schaps accepted the position of chair and thanked the Board for their support. Chair Schaps called for a nomination for Vice -Chair for the 1995 year. Jamie Schaps made a MOTION to nominate Al Robinson as Vice -Chair for the 1995 year, and was supported by Guy Herr. All voted aye. Motion carried. Robinson accepted the position of Vice -Chair and thanked the Board for their support. IV. OPEN MIKE: Kim Sullivan from 20/20 Vision gave the Board a brief update of the community group. PLANNING & ZONING BOARD April 12, 1995 Ms. Sullivan indicated some items that have been addressed are: * Items discussed at Council Meetings will be available with decisions, the day after the meeting is held. * Minutes of City meetings will be on a subscription basis, due to cost and time. * The Citizen's Library has been rearranged and updated at City Hall. * Work Session chair arrangement has been changed to accommodate public opinion. Ms. Sullivan indicated other various items are also under discussion and the Board is welcomed to attend meetings, but she want to continue to update the Board on the desires of the Advisory Group. Ms. Sullivan thanked Mary Kay Wyland, Brian Wessel and Mary LaForest for attending meetings and making themselves available to the citizens. She indicated this is much appreciated by the citizens and is a good reflection upon City Hall. Ms. Sullivan indicated there will be a Mid Term 20/20 Advisory Group meeting on April 29, from 8:30 a.m. to 11:30 a.m. and all are invited. Mr. Herr inquired if the meeting would be on cable for those unable to attend. Ms. Sullivan indicated she would check to see if that is possible. Chair Schaps declared the Open Mike portion of the meeting opened at 6:40 p.m. Hearing no public comment, Al Robinson made a MOTION to close the Open Mike portion of the meeting and was supported by Tom Mesich. All voted aye. Motion carried. Open Mike portion was closed at 6:41 p.m. V. PLANNING ITEMS: A. 95-9-S, Living Waters Church, 685 Birch Street Planning Coordinator Wyland briefly reviewed a request to add an area of either 1,016 square feet or 1,536 square feet to be used as open space for gathering and/or classrooms at the Living Waters Church located at 685 Birch Street. Planning Coordinator Wyland indicated staff has reviewed this request and would recommend approval with all 2 PLANNING & ZONING BOARD April 12, 1995 conditions outlined in the original Conditional Use Permit and the additional condition that proper building permits be obtained prior to construction. Chair Schaps inquired if there are items yet to be completed from the first permit. Ms. Wyland indicated there are items to be completed, but the items had been unavoidably delayed due to utility construction. Mr. Mesich asked if the parking will be sufficient to serve the addition. Ms. Wyland indicated this was taken into consideration and there will be adequate parking. Al Robinson made a MOTION to approve application 95-9-S, Living Waters Church, 685 Birch Street, Site Plan Review with the outlined conditions, and was supported by Guy Herr. All voted aye. Motion carried. B. 95-10-P, City of Lino Lakes, Minor Subdivision for Apollo Business Park (Nol-Tec), Apollo Drive Economic Development Director Wessel presented a brief introduction to the property located within the Apollo Business Park and Zoned General Industrial. Mr. Wessel indicated the City is very pleased that Nol-Tec has chosen Lino Lakes for their business location. Planning Coordinator Wyland reviewed the requested Minor Subdivision for Apollo Business Park (Nol-Tec Site) Apollo Drive. She indicated that when the business park was originally platted the City had prospects for Lots 2 and 3 of Block 1, however, those prospects fell through. Nol-Tec wishes to located in this area but requires a slightly larger parcel of property than either of the platted lots. Therefore, a minor subdivision is being requested which will add the southwesterly two/thirds of Lot 3 to Lot 2 for a total area of 3 acres. The remainder of Lot 3 will be added to Outlot A for future platting. Ms. Wyland indicated staff would recommend approval of the minor subdivision to facilitate the development of Nol-Tec Systems Inc. The target date for Nol-Tec to be in their new building is set for September. Bill Johnson made a motion to approve application 95-10- P, City of Lino Lakes, Minor Subdivision for Apollo Business Park (Nol-Tec) Apollo Drive, and was supported by Al Robinson. All voted aye. Motion carried. C. 95-11-S, Nol-Tec, XXX Apollo Drive, Site Plan Review Planning Coordinator Wyland reviewed the request for site 3 PLANNING & ZONING BOARD April 12, 1995 plan review for a 16,256 square foot building to be located in the Apollo Business Park. Ms. Wyland noted the EDAB and City staff would recommend approval of the Site Plan as submitted with the following conditions: 1. The applicant shall sign a development agreement and post financial guarantees as specified by City Staff prior to issuance of any building permits. 2. The City Engineer shall review and approve utility, drainage and storm sewer plans. 3. Proper sign permits shall be obtained prior to installation of signage. 4. The Site Plan signed and dated 4/5/95 shall be made a part of this approval and shall incorporate all landscaping, parking, building location, trash handling, loading docks, etc. 5. The parking area shall be provided with a hard surface with concrete curb surrounding all access drives and parking areas. 6. Handicapped parking shall be provided according to ADA Rules and Regulations. 7. Access drives off 4th Avenue shall be located as far north of the intersection of Apollo Drive and 4th Avenue as possible. Mr. Johnson asked if there is any outside storage. Ms. Wyland indicated there is no outside storage. Mr. Phil Nolen, president of Nol-Tec Systems briefly explained his business. He indicated his business is an engineering and light assembly company which designs pneumatic conveying systems. Chair Schaps asked if all machinery is contained within the building. Mr. Nolen indicated this to be true, any noise would be the compressor within the building and an exhaust fan from a dust collecting system. Chair Schaps asked if the applicant understood and agreed to the conditions set forth in the report. Mr. Nolen indicated he understood and agreed to the conditions. Mr. Mesich inquired if there is a sprinkler system on site. Mr. Nolen indicated that was true. Mr. Herr asked if there is rooftop machinery. Mr. Nolen indicated there was. Mr. Herr inquired if there is a requirement for screening regarding this. Mr. Wessel indicated there is not a requirement in place, but a condition could be added to address this issue.Mr. Herr suggested a condition could indicate design to minimize 4 PLANNING & ZONING BOARD April 12, 1995 visual impact and/or screening added to mask the appearance of equipment. Mr. Gelbmann asked what size trucks would be traveling on site. Mr. Nolen indicated full size semi -trucks. Mr. Herr asked if all employee counts for all phases had been included in parking plans. Mr. Nolen stated the future expansions have been taken into consideration, and parking should be adequate. Guy Herr made a motion to approve application 95-11-S, Nol-Tec, XXX Apollo Drive, Site Plan Review with added condition number eight limiting visible impact of rooftop equipment and provide screening around that equipment, and was supported by Al Robinson. All voted aye. Motion carried. D. 95-7-C, Teleport, 6221 Holly Drive, Amended Conditional Use Permit Chair Schaps OPENED the Public Hearing at 7:07 p.m. Planning Coordinator Wyland briefly reviewed a request to install two satellite antenna's within an existing telecommunication compound on Holly Drive. Ms. Wyland indicated staff has reviewed the request and would recommend approval with all conditions contained in the original and subsequent permits and the condition that proper building permits be obtained prior to installation. Bill Johnson made a MOTION to CLOSE the Public Hearing, and was supported by Al Robinson. All voted aye. Motion carried. The Public Hearing was CLOSED at 7:10 p.m. Rick Gelbmann made a MOTION to approve application 95-7- C, Teleport, 6221 Holly Drive, Amended Conditional Use Permit, and was supported by Al Robinson. All voted aye. Motion carried. E. 95-8-P, Art LaCasse, 6609 24th Avenue, Minor Subdivision Planning Coordinator Wyland indicated this item has been before the Board, once in February of 1994 and again in January of 1995. Ms. Wyland indicated the property owner has now determined that he would prefer a slightly different configuration to facilitate the sale of the property to his grandchildren. 5 PLANNING & ZONING BOARD April 12, 1995 Ms. Wyland indicated this is somewhat a confusing arrangement and has provided the Board with all three site plans. Ms. Wyland indicated staff has reviewed the request and would recommend approval. Mr. Emmerich has agreed to the rearrangement of lot lines, and Mr. LaCasse is dividing his property as he wishes. Ms. Wyland noted this would not change the park dedication area, she has discussed this with the Park Director who has no concerns. Mr. Robinson indicated the zoning would be inconsistent. Ms. Wyland indicated the area is wetland and would not be developed. Mr. Gelbmann asked if there is any concerns regarding out buildings on site without a primary building. Mr. Brixius indicated if the use is farm related there is no concern. Al Robinson made a MOTION to approve application 95-8-P, Art LaCasse, 6609 24th Avenue, Minor Subdivision (Rearrangement of Lot Lines), and was supported by Guy Herr. All voted aye. Motion carried. F. 95-5-P, PDO, Z, and Comprehensive Plan Amendment, Behm's Century Farms, Rezoning, Preliminary Plat, Planned Development Overlay for Air -park lots, and Comprehensive Plan Amendment for MUSA Exchange. Chair Schaps declared the Public Hearing OPEN at 7:21 p.m. Planning Consultant Brixius reviewed the various items to be discussed. 1. Comprehensive Plan Amendment (MUSA Boundary and Sewer Plan. 2. Rezoning of northern portion of the site (Airpark lots) from R, Rural to R-1, Single Family Residential. 3. PDO overly of those lots provided Airpark access. 4. Preliminary plat. Mr. Brixius indicated the City's 1991 Comprehensive Plan suggests single family residential use of the subject property. In this regard, the proposed development is consistent with the provisions of the Comprehensive Plan. The proposed Airpark component is considered a unique and creative concept which can most effectively be accommodated via a Planned Development Overlay. 6 PLANNING & ZONING BOARD April 12, 1995 Mr. Brixius continued with a review of each item that the Board will take action on and identified conditions the consultants deem necessary. Mr. Johnson inquired about the trail. Mr. Brixius indicated this is the responsibility of the developer, and they are trying to set a trail near the wetlands. This trail would need to be approved also by the Rice Creek Watershed District and the City's Park Board. Mr. Mesich asked the status of the MUSA requests. Mr. Brixius indicated the City Council gave final approval and copies of the report will be sent on April 13. Mr. Johnson inquired in regards to the comments of the staff and consultants, should the comments be more specific. Mr. Brixius indicated the developer will give a brief presentation and also comments will be added by the Rice Creek Watershed District. Chair Schaps indicated for clarification regarding the MUSA land trade, the owner to the south would give up his MUSA identification and then be added to area identified as potential growth area. Mr. Brixius indicated this is correct. Mr. Brixius indicated the owner is in agreement because the land has no immediate future development. Mr. John Johnson gave a brief update to the proposal. He indicated the applicant is currently working with the Rice Creek Watershed District regarding wetland mitigation. Mr. Johnson in response to comments made in the consultant's report, indicated: * work is ongoing with Rice Creek Watershed District regarding wetland mitigation * buffering will be provided between the homes and the Airpark * link between the two cul-de-sacs is still under Rice Creek Watershed District advisement * lot #18, block 5, developer does not feel the cul-de-sac is necessary Mr. Johnson also provided the Board with a memo detailing the protective covenants the Airpark holds now and additions that the new development would contribute. Mr. Bill Johnson inquired as if the hanger has to be used only by the resident. Mr. John Johnson indicated use is restricted to the property owner and the Airpark wants to discourage oversized recreational vehicles in the hangers. 7 PLANNING & ZONING BOARD April 12, 1995 Mr. Brixius expressed concern that the protected covenants set forth for the Airpark may not apply to the development, due to the lot size difference and other differences. He would feel more comfortable if the covenants were more precise regarding the new development. Chair Schaps inquired as to the phasing plan. Mr. John Johnson indicated the goal of the developer is to start grading in July creating 55 lots in the first phase, with the second addition of 60 lots to begin in 1997. Chair Schaps asked about the neighborhood meeting. Mr. John Johnson indicated no negative comments or concern arose during the meeting, in fact some neighbors wished to be included in the development. Chair Schaps indicated he agreed with setting forth more specific language regarding hanger size, and also location on the lot. Mr. John Johnson indicated it may be difficult, since the market is unknown. Mr. Gary Uhde indicated in their covenants of the Association, no one other than the owner may use the hangers. Chair Schaps inquire if measures were being taken to prevent any arguments of disclosure in the future. Mr. Uhde stated in all advertisements, all documentation it will fully disclose the location of the lots near an Airpark and the responsibilities of the new buyer. He indicated that copies of the purchase agreement will be on file with the City Administrator, Mr. Uhde's office and the Airpark Association, so no litigation would arise in the future. Mr. Herr asked regarding noise levels. Mr. John Johnson indicated this is not a concern. Mr. Bill Johnson asked regarding fuel storage. Mr. John Johnson indicated there is no fuel storage at this location. Mr. Bill Johnson inquired if a resident would keep fuel in their hanger. Mr. John Johnson indicated it would be very costly due to insurance. Chair Schaps inquired as to an anticipated price range for lots and homes. Mr. Uhde indicated lot rates would range from $27,000 outside the Airpark to $60,000 within the Airpark. He noted home packages would range from $125,000 to $200,000. Johnson made a MOTION to CLOSE the Public Hearing, and was supported by Al Robinson. All voted aye. Motion carried. The Public Hearing closed at 8:29 p.m. 8 PLANNING & ZONING BOARD April 12, 1995 Mr. Mesich expressed concern regarding the MUSA amendment and the land trade. He indicated if the MUSA exchanged is not approved, the second phase could not proceed and that would jeopardize the support for utility extension. Mr. Brixius indicated if the Metropolitan Council approves the MUSA land exchange, they would do so only if they felt comfortable they would be also approving the MUSA Land Amendment. Therefore he did not have any concerns. Discussion was held regarding utility extension and the expense. Mr. Mesich expressed concern that the City would handle the costs of the extended utility, and not receive reimbursement if the MUSA exchange was not approved. Mr. Powell in reference to Mr. Mesich's concern indicated Mr. Uhde would accept all risks involved for the assessments of utility extension, he will be responsible for the assessments regardless of lot sales. Discussion continued regarding assessments. Chair Schaps indicated the Board will take action on each item in the order presented by Mr. Brixius. Bill Johnson made a MOTION to approve the Comprehensive Plan Amendment, subject to Metropolitan Council approval, and was supported by Rick Gelbmann. All voted aye. Motion carried. Al Robinson made a MOTION to approve Rezoning of northern portion of the site (Airpark lots) from R, Rural to R-1, Single Family Residential with stated conditions, subject to City staff review and City Council approval, and was supported by Guy Herr. All voted aye. Motion carried. Rick Gelbmann made a MOTION to approve PDO overly of those lots provided Airpark access with noted amendments subject to City staff review and City Council approval, and was supported by Bill Johnson. All voted aye. Motion was carried. Mr. Brixius indicated the conditions will be clearly defined by staff and reviewed with the applicant, then forwarded for City Council approval. Al Robinson made a MOTION to approve the Preliminary Plat with conditions regarding lot #18, "butt" lot to be removed and cul-de-sac included, subject to City staff review of definitions and City Council approval, and was supported by Bill Johnson. Vote: 5 ayes - 1 nay. With Tom Mesich in opposition. Motion carried. 9 PLANNING & ZONING BOARD April 12, 1995 Mr. Uhde thanked the Planning and Zoning Board for their cooperation through this application period. VI. DISCUSSION: A. Conflict of Interest Forms Planning Coordinator Wyland indicated forms should be signed and returned to City Hall as soon as possible, they are per the request of the City Auditors. Chair Schaps inquired as to the status of Country Lake Estates. Mr. Powell indicated Phase One utilities are in; Phase Two, bids will be opened on April 24; with construction to follow shortly there after. Chair Schaps asked if there was a connecting trail and/or park between Captains Place and Quail Ridge. Ms. Wyland explained that the boardwalk leads to the west property line of Quail Ridge and terminates. A park area was dedicated in the south/west corner of the Quail Ridge plat but it is not the developers responsibility to improve the park - that is up to the Park Board and is dependent on funding sources. The trail may eventually lead to Captains Place, but not at this time. VII. ADJOURNMENT: Al Robinson made a MOTION to adjourn and was supported by Tom Mesich. All voted aye. Motion carried. The meeting was adjourned at 9:10 p.m. 10 AGENDA ITEM B STAFF ORIGINATOR Mary Kay Wyland DATE May 10, 1995 TOPIC 95-13-S, Blue Heron Project, 3XX Apollo Drive, Site Plan Review The Blue Heron Project involves the construction of a 20,196 square foot building containing 6,720 square feet of office and 13,440 square feet of warehouse. The property is located in the Apollo Business Center which is Zoned Light Industrial. Office and warehousing are permitted uses within this Zoning District. It is the developers intent to offer space for rent in 2500 square foot increments. A dock ` area is provided to access the warehousing portion of the building. Phase 11 involves a similar building planned for future construction. This phase will also require a subdivision and site plan review. SITE AND BUILDING REVIEW: Staff has reviewed the submitted site plan and would recommend approval with the following conditions: 1. Proper building permits shall be obtained prior to construction. 2. The proposed construction shall meet all building and parking setback and height requirements. 3. A minimum of 10% green area shall be provided. 4. Landscaping shall be provided according to the site plan dated 5/7/95. A sprinkler system shall be provided for maintenance of all green areas. The City Forester shall review said Landscaping plan to insure suitability of selected species. 5. The exterior construction will be rock face block with breakoff block design. 6. An interior sprinkling system will be provided per State Fire/Building Code. 7. B6-12 curbing shall be provided around perimeter of parking area and access drives. 8. Parking areas shall be surfaced and stripped with handicapped parking provided per ADA requirements. Adequate parking has been provided on site (50 parking spaces shown). 9. Trash shall be stored behind seven foot masonry enclosures which match the building. 10. Screening to match building shall be provided for rooftop heating/ventilating equipment. 11. All drainage, utility and grading plans shall be submitted to review and approval by the City Engineer. 12. Access to the site shall be provided by one (1) shared access drive. The developer shall sign a "shared driveway agreement" prior to occupancy. 13. A development agreement shall be signed by the developer and made a part of this site plan review. The City Staff and the EDAB Board has reviewed this request and would recommend approval with the conditions outlined above. OPTIONS .............................. .............................. 1. That may change, depending upon the tenants. It also calls for the zoning to be light industrial, the -site area being 2.38 acres, the green area is 26,000 square feet, with 25% for GENERAL landscaping and green and sod areas. The code in this particular project is the 1994 UBC code. The construction type of this building is V and it will have an CONTRACTOR automatic sprinkler system for the green areas. It will also have fire protection or fire sprinkling inside of the building. It will be located on Apollo Drive in the city property of Lino Lakes. This will be a shared driveway for a project that will be 1600 going west of this particular building. This building is to be broken down into a 2500 square foot base, where as any one tenant can take 2500 square feet, 5000, 10,000, 15,000, or the whole building. It also has a dock level height in the back JACKSON for semi's to drive up to for unloading and it also has drive in doors for the other tenants. It has black top, which is five inches of base, two inches of wearing surface, and an inch and a half of top surface. It also, depending upon the civil STREET N.E. engineering, will have a medigation pond ori lower area for drainage in the northeast corner of the lot. Outside'construction will be rock face block and breakoff block design. It also will have reflective colored glass and colored MINNEAPOLIS frames. It will have B6-12 curb in all of the sod areas and the parking areas. The parking area will be 47 cars, which more than meets the standard for Lino Lakes, MINNESOTA and the stripes will be painted white in accordance with the other parking sites in the City of Lino Lakes. Please also note on this proposed project for the Blue Heron 20,000 square foot building that all exterior trash areas are to be stored in 55413 seven foot high masonry enclosures to match the building. All rooftops HVAC units will be screened with standings seam metal panels to match the building. Has submitted a request to construct a 48 unit elderly residential development upon a 13.6 acre site located east of Sunset Road between Interstate 35W and Elm Street (County Road 12). The development itself consists of four 12 unit multiple family structures and ten single family residential lots. In August of 1992, the City approved an elderly tttultiple family development that included 90 is upon the subject site upon condition that final site plans be submitted and approved by the City. The proposal now being considered has been down scaled from that conditionally approved development proposal. Single family homes are now being proposed on the western one-half of the property. To accommodate the proposed development, the following approvals will ultimately be necessary: l . Rezoning of the western portion of the site from R-4, High Density Residential/PDO to R-1, Single Family Residential. 2. Preliminary plat. 3. Site and building plan review. At this time, only approval<of site and building plans (multiple family component) has been formally requested. "Typical" building elevations and floor plans are submitted which identify structure height, exterior finish materials, and proposed dwelling unit areas. 2. A landscape plan be submitted which identifies the location, variety, and size of all proposed site landscaping. Specific attention should be given to that portion of the site abutting Interstate 35 and area east of the proposed single family homes. 3. To provide an assurance that parking supply shall meet parking demand, the following conditions should be upheld through deed restriction: A. The dwelling units are occupied only by elderly residents (55 years and over). B. All garage spaces are provided without fee. C. There shall be no dwelling unit conversions for family use. D. No outdoor storage be allowed in the designated parking spaces. 4. Deadend driveway concerns are resolved. i 5. Following formal application and proper public hearing notification, our office recommends the following: 1. Approval of the requested rezoning from R-4/PDO to R-1, Single Family Residential for the western single family portion of the proposed subdivision subject to the following conditions: A. City approval of the Willow Ponds Subdivision. 2. Approval of the Willow Ponds preliminary plat subject to the following conditions: A. All access points from County Road 12 are subject to approval by the Anoka County Highway Department. B. The submitted grading plan is subject to review and approval of the City Engineer. C. The submitted utility plan is subject to review and approval of the City Engineer. D. The Fire Chief provide recommendation in regard to preferable fire hydrant locations. E. Comments from other City staff. 3 ISSUES ANALYSIS Rezoning As noted previously, a rezoning of the western portion of the subject site from R-4/PDO to an R-1 designation will ultimately be necessary to accommodate the single family home component of the proposed development. While it is recognized that a formal rezoning application is pending, it is considered appropriate to examine the rezoning issue as it will impact ultimate land uses in the area and design of the proposed multiple family component. In August of 1992, the City rezoned the entire site from an R-1 designation to the current R- 4/PDO designation in anticipation of a 90 unit senior housing project. The current submission represents a change from the originally considered development proposal in that a single family residential component is now being offered. Single family homes are not permitted under the property's current R-4 zoning. Judgement Criteria. In review of rezoning requests, the Planning Commission and City Council should consider its possible adverse effects. Judgement should be based upon, but not limited to, the following factors: a. The proposed action has been considered in relation to the specific policies and provisions of and has been found to be consistent with the official City Comprehensive Plan. b. The proposed use is or will be compatible with present and future land uses of the area. c. The proposed use conforms with all performance standards contained herein. d. The proposed use can be accommodated with existing public services and will not overburden the City's service capacity. e. Traffic generation by the proposed use is within capabilities of streets serving the property. Comprehensive Plan. The City's Land Use Plan (attached as Exhibit B) designates the subject site as "urban residential" or low density single family development. The intent of the urban residential designation is to provide a development density which will provide a high level of public services (sewer, water, parks, police, fire). Acknowledging the proposed use's consistency with the City's Land Use Plan, the proposed R-1 zoning designation is consistent with the provisions of the City's Comprehensive Plan. 4 Land Use Compatibility. To determine the appropriateness of the proposed use, it is considered beneficial to examine adjacent land uses and zoning designations. The following is a listing of uses and zoning designations which surround the subject site: Direction T Tse Zoning North Undeveloped/low density residential R-1 (Interstate 35W) South Low density residential R-1 East Undeveloped (Future multiple family residential) R-4 West City of Blaine Recognizing that low density residential development exists south of the subject site and that buffering is to be provided to the north and east of the proposed R-1 District, the proposed single family residential use is considered compatible with surrounding uses. Public Services. As noted previously, a determination should be made that the proposed use will not overburden the City's service capacity. Considering that a recent finding was made that multiple family residential use of the property would not overburden the City's service capacity, a less intense single family residential use is not anticipated to overburden City services. Traffic Generation. In consideration of the requested rezoning, an evaluation of anticipated traffic generation should be conducted. Traffic generated by the proposed single family dwellings is within the capabilities of Elm Street, which serves the subject property. In review of the submitted site plan, direct single family lot access is proposed onto County Road 12. As a result, some concern does exist in regard to the desirability of such access condition. This item will be discussed later in this report. Performance Standards. As a condition of plat approval, the proposed single family residential portion of the development will be required to comply with applicable performance standards. Specific issues will be discussed in latter sections of this report. Preliminary Plat Review In addition to the rezoning request, ultimate approval of the Willow Ponds subdivision will also be necessary to accommodate the proposed development (see Exhibit C). The subject subdivision includes ten single family residential lots within the western portion of the site (R-1 zoning area), and a single larger lot within the eastern half of the site (R-4 zoning area). The larger lot (Lot 1, Block 1) is to accommodate four 12 unit multiple family structures. 5 Density. As noted previously, the proposed subdivision is to accommodate two differing dwelling unit types and densities. Within R-1 Zoning Districts, the maximum number of dwelling units per buildable area must not exceed 3.2. The proposed density of the single family residential component of the subdivision is 3.2 DU/acre and meets maximum allowable density requirements of the R-1 District (10 DU divided by 3.2 acres). . is y app c . In review of the site plan, the multiple family component of the development proposes a density of 8.3 dwelling units per acre (48 DU divided by 5.8 acres) and complies with applicable density requirements. Lot Sizes. Proposed single family residential lots range in size from 13,360 to 16,018 square feet and satisfy minimum R-1 District lot area requirements of 10,800 square feet. At + 10.5 acres in size, the multiple family component of the development (Lot 1, Block 2) greatly exceeds the ordinance requirement. Lot Width. In the R-1 District, a minimum interior lot width of 80 feet is required. All single family lots have been found to meet such lot width requirements. Within R-4 Districts, a minimum lot width of 150 feet is required. At 650+ feet in width, Lot 1, Block 1, as illustrated upon the preliminary plat, greatly exceeds minimum lot width requirements of the R-4 District. Lot Depth. All proposed R-1 lots (Block 2) have been found to meet applicable 135 foot minimum lot depth requirements. No minimum lot depth requirements are imposed in R-4 Zoning Districts. Streets. The subject site is to receive its access via Elm Street (County Road 12) from the south. As a County road, all access points must be approved and issued permit by the Anoka County Highway Department. While Elm Street is currently classified as a County road, it is anticipated that at some future point, the street will be turned over to the City. The anticipated loss of County designation relates directly to the street's function and traffic volumes. In consideration of the street's current and anticipated function, the proposed direct single family lot access being proposed is considered acceptable. The plat shows a 7' street right-of-way dedication along Elm Street to bring the full right-of-way to an 80' width which complies with City standards for a collector street. 6 The submitted site plan calls for the construction of a privately owned interior street. According to the City Code, private streets are not to be permitted and that pavement widths (curb to curb) for residential streets less than 32 feet. In recognition of such requirements, a PDO, Planned Development Overlay zoning designation has been applied to the subject property. While the PDO designation may provide for deviances from the strict provisions of the Ordinance, in no case may proper site functioning or safety be compromised via the application of the PDO. Specific issues relating to the private street will be discussed under the site and building plan review section of this report. Grading and Drainage. In accordance with Ordinance requirements, a grading plan has been submitted for review. As a condition of preliminary plat approval, such plan should be subject to comment/recommendation by the City Engineer. Utilities. As required by Ordinance, a utility plan has been submitted for review. As a condition of preliminary plat approval, such plan shall be subject to review and approval by the City Engineer. Additionally, the Fire Chief should provide specific comment in regard to fire hydrant locations. Park Dedication. As a condition of subdivision approval, the applicant must satisfy City park dedication/cash contribution requirements, as determined by the Lino Lakes Park Board. Site and Building Plan Review As noted previously, the applicant wishes to construct four 12 unit multiple family structures upon the subject R-4 site with a PDO Overlay District to accommodate some design flexibility.. As per Ordinance requirements, a review of project site and building plans is required. R-4 Zoning. The site is zoned R-4, Multiple Family. The proposed Cottage townhomes are permitted land uses within this zoning district. Building Design. Generally speaking, the proposed building configuration is considered positive and presents some design diversity. Prior to final project approval, however, "typical" building elevations and floor plans should be submitted which identify structure height, exterior finish materials, and proposed dwelling unit areas. All dwelling units must meet minimum floor area requirements stipulated in the Ordinance. Landscaping. In accordance with Ordinance requirements, a landscape plan should be submitted. Such plan should identify all planting locations, varieties and sizes proposed on the property. Particular attention should be given to that area of the site which abuts Interstate 35 (i.e., berming) and are between the single family residential component and higher intensity uses to the east. 7 Setbacks. In review of the proposed development, the following principal setbacks apply: Front Yard Side Yard Rear Yard R-1 District 40 feet 10 feet 30 feet R-4 District 40 feet 20 feet 30 feet NOTES: 40 foot front yard setback applicable to collector streets * R-4 setbacks apply to site perimeter All proposed lots illustrate an ability to conform to the aforementioned setback requirements. Section 6, Subd. 8.E of the Zoning Ordinance stipulates that within PDO Districts, no structure may be closer than 36 feet to another building. The proposed building placements upon Lot 1, Block 1 conform to this separation requirement. Off -Street Parking. According to Section 8, Subd. 1.(2)(B), an off-street parking requirement of two and one-half spaces per unit is required in the R-4 District. As calculated below, a total of 120 spaces are required of the proposed multiple family component of the project. Parking Units Ratio Requirement 48 2.5 per dwelling unit 120 The subject proposal illustrates 128 spaces of which 48 are considered tandem. It should be noted that tandem stalls typically are not considered in the off-street parking supply. Considering, however, that 1) the subject development caters toward the elderly, 2) the tandem stalls meet minimum dimensional requirements, and 3) the City has control over the use of the subject property via the PDO, the tandem stall arrangement is considered acceptable. To provide an assurance that the parking supply will meet demand, the following conditions should be upheld: 1. The dwelling units should be occupied only by elderly residents (55 years and over). 2. Garage stalls should be provided without fee. 3. There should be no dwelling unit conversions for family use. 4. Parking spaces will not be used for storage of recreational vehicles, boats or trailers. 8 To allow efficient vehicular movement throughout the site, no parallel parking should be allowed. All parking stalls have been found to conform to minimum dimension standards of the City Zoning Ordinance. According to Section 8, Subd. 4 of the Zoning Ordinance, all off-street parking areas must be designed in conformance with the following standards: 1. Bituminous surfacing. 2. Perimeter curbing. 3. Striped stalls. 4. Designated handicapped stalls (per State requirements). 5. Parking lot lighting. Open Space. According to the Zoning Ordinance (Section 6, Subd. 8.2.E.(iv), at least 35 percent of the site must be devoted to open space. In review of the submitted site plan, it is estimated that ± 48 percent of the R-4 District (Block 1) is devoted to open space. Site Circulation. Several concerns exist in regard to site circulation, as listed below. 1. Several multiple family structures (Buildings 2 and 4) are accessed by dead-end driveways without vehicular turnaround space. Such an arrangement does not provide for traffic turnaround without use of the designated parking area. While this arrangement may not present a concern for automobiles, it will complicate the egress of large vehicles servicing the site. It should be noted that van -type trucks (17 to 35 feet in length) require a minimum inside turning radius of approximately 25 feet. In many instances, turning radii, as illustrated on the site plan, will not allow for turning maneuvers of such. As a condition of site and building plan approval, this dead-end driveway should provide for truck turn around areas. 2. The subject site is to be accessed via two points from Elm Street (County Road 12). While the location of such access drives appear acceptable, the site plan will be subject to review by the Anoka County Highway Department and City Engineer in regard to access requirements. Trash Handling. If applicable, the site plan should be modified to identify specific trash handling areas. All trash handling areas must be demonstrated to be accessible to trash handling equipment. Signage. According to the submitted site plan, a monument sign is to be erected in the southeastern corner of the subject property. Prior to the erection of any site signage, detailed sign plans must be submitted and approved by the City. Such plans should specify the location, size, and type of all site signage. 9 Drainage and Utilities. Prior to final site plan approval, the submitted drainage and utility plans (referenced in preliminary plat review) should be subject to approval of the City Engineer. Development Agreement/Covenants. As a condition of project approval, the applicant should enter into a PDO development agreement with the City and post all the necessary security required by it. Additionally, any restrictive covenants applicable to the property should be submitted subject to City review and approval. According to the City Zoning Ordinance, public buildings for county and state government are permitted uses in this Zoning District. Additionally, any construction other than single family requires site plan review. The proposed request is to allow six components of construction/reconstruction including the following: 1. Replacement of one boiler 2. Upgrade of existing perimeter fence with supplemental wire barrier and replacement of electronic perimeter surveillance 3. Remodeling and addition for the reception/segregation unit (2,450 square foot addition) 4. Construction of a new 232 bed minimum security chemical dependency unit (approximate footprint 34,425 square feet) 5. Increase capacity and remodeling of existing food service and dishwashing area 6. Remodeling to pr vide space for new dental exam room and x- ray unit in existing infirmary Areas to be constructed and/or remodeled are shaded on the attached site plan" The Building Inspector and Fire Chief have reviewed the proposed construction plans with the`Correctional Facility. Because this is a State owned prison facility, extensive review is conducted on the State level. Addtionally, numerous items are considered highly confidential and not for public information. Staff would comment that plans meet all requirements imposed by the Uniform Building Code and Fire Code. Engineering plans have been reviewed by the City Engineer and utilities are adequate to serve the proposed expansion. Staff would reconuaend approval of the construction/remodeling with the following conditions: Proper building permits be obtained prior to construction. 2. BUILDING DESCRIPTION General "B" Building is a 53,000 square foot former living facility currently used for a combination of office, dormitory and industry space. The scope of this project is to add a secure vehicle sallyport and to convert portions of the existing building for intake, visiting and segregation housing functions. Vehicle Sallyport This part of the project consists of a 2,450 square foot addition to the north end of "B" Building. Provided is a 20' wide by 50' long drive-thru sallyport, large enough to accommodate two vans or police vehicles, an ambulance, or school bus. The vehicle sallyport is connected to "B" Building by a 64' long link, which allows staff, inmates and public visitors to securely pass through the perimeter fence. Also provided is locked equipment storage for the Emergency Response Team, who would assemble in the vehicle sallyport before entering the secure perimeter, and a utility closet for storage of hoses and vehicle cleaning supplies. Security is provided by interlocked vehicle doors at either end of the sallyport and secure personnel doors at both ends of the link, operated by Central Control. Control observes the sallyport and its approaches by means of security cameras, and has a direct view of both the staff and public corridors. Visiting Unit The visiting unit will occupy 3,300 square feet of currently vacant industry space in the northeast corner of "B" Building. It provides nine secure, non -contact visiting booths for segregation residents and space for up to 30 "contact" visits in an informal lounge setting. Two search rooms provide secure access for residents to the contact visiting room, and two professional visiting rooms provide space for authorized private visits. An open staff work station provides for direct supervision of the visiting area. Central Control has direct views of the public waiting room and non -contact visiting area, and controls access for both public and residents. The waiting room has a phone, drinking fountain, coin-operated lockers and adjacent public toilet rooms. Visitors must pass through a metal detector before being permitted entry into the visiting area. Page 46 Reception Unit The reception unit provides 3,000 square feet of space for intake processing of new residents and those in transit to or from other institutions. Facilities include an open staff workstation with visibility into all areas, photo and fingerprint identification area, an informal waiting area, secure individual and group holding rooms, shower and clothing change room, and an exam room for medical screening. Inmate property would be collected and temporarily stored here, but moved to a central property room on a daily basis for long-term storage. Segregation Unit This unit provides short-term secure housing for administrative segregation, transients and secure medical isolation. Provided are two modules totaling 8,258 gross square feet constructed within the existing print shop space, each with 21 single -occupancy "wet" cells of 80 square feet each for a total of 42 segregation beds. The cells open onto a central dayroom space which also provides access to showers, janitor closet and outdoor recreation. Entry to the unit will be from the main hall through a secure sallyport. A group counseling room off the dayroom provides limited professional visiting and programming capability. A secure control station provides electric control of all cell and sallyport doors and electronic monitoring and communications for the unit. The control station also has indirect observation of one of the two dayrooms, with roving staff providing additional, more direct supervision of the housing areas. Cells are single occupancy, with steel bunk, desk, stool and combination toilet/lavatory. Access to natural light will be by means of windows and skylights in the dayrooms, with glass in and above the door providing borrowed light into each cell. CHEMICAL DEPENDENCY UNIT ("CD" BUILDING) 1. BUILDING DESCRIPTION General The proposed Chemical Dependency Unit is a two-story building, with partial basement and penthouse space for mechanical and electrical equipment. Resident bedrooms, together with housing support services, are clustered around four dayrooms, each of which open to a circulation system which is visible from the Central Security desk. Program services are accommodated in the multi-purpose room and within each of the four dayrooms. Staff office accommodations are dispersed within the housing units and the Administrative area. Housing Two levels of single and double rooms provide minimum security in a normalized living environment. Each bedroom has a door with glass vision panel; metal bed or bunk, wardrobe and desk with chair; tempered glass mirror; towel rods; and an operable, screened exit window. Finishes are painted fiber -reinforced gypsum wallboard on walls, and vinyl tile floors. Three bedrooms in each of four housing unit meets ADA requirements for handicap accessibility. Each unit of bedrooms opens to a dayroom for activities such as dining, television viewing and passive recreation, and for meetings of educational and support groups. The dayroom has sturdy, movable dining and lounge furniture, television and a stand-up staff work station. Finishes include carpet on floors with vinyl tile in heavy traffic areas. The dayroom is designed for direct supervision by staff counselors. Off the dayrooms are toilets/lavatories, showers and janitor closets. Housing Support Staff Offices: Staff counselors will have offices inside each housing unit directly adjacent to the dayrooms. Included is a meeting/counseling room. Kitchenette: Equipment will be provided for recreational use, including a refrigerator/freezer, microwave oven, utility sink and storage shelving. Meal preparation and dining facilities are not provided in the proposed Chemical Dependency Unit, but these services are available at a central facility. Laundry: A residential -sized, commercial -grade washer and dryer, utility sink and layout table are provided for resident use. Exercise Room: A central exercise room is provided to serve each of the four housing units. Page 53 Program Services Administrative Offices: Open offices, a Director's office, staff meeting room and clerical storage are located in a separate area off the main entrance corridor. The area will be finished with carpet on floors with an acoustic ceiling for sound control. Two Group Supervisor offices are located in the common area, each near the entrance to two housing units. A Central Security desk (free-standing) provides direct visual surveillance of the main entrance, all corridors in the common area, the exercise room, entrances to each housing unit and the multi-purpose room. The Central Security desk will provide electronic monitoring for the building, including security intercom, closed circuit television monitoring and fire alarm annunciation. Multi -Purpose Room: This 2500 square foot room with movable partitions provides for various gatherings, including small group therapy and educational activities for up to 132 residents plus staff, and large group assemblies for up to 270 people. The room will be finished with carpet on floors with an acoustic ceiling for sound control. There is an adjacent storage room for equipment. Toilets and janitor closets are located off the corridor outside the main door to the multi-purpose room. Outdoor Recreation: One asphalt -surfaced basketball/volleyball court is provided outside the main entrance. Building Support An entrance vestibule will be visible from the Central Security desk. A partial basement will be directly connected to the campus utility tunnel system. Here are located the water and gas service, hot water conversion equipment, electrical panels, electronic security system cabinets and computer room. A mechanical/electrical equipment room on the first level provides access to the basement. On the second level there is a mechanical penthouse for heating and ventilation equipment, with exterior gravity hoods for fresh air and exhaust; on air-cooled chiller is located on the first level roof behind the mechanical penthouse. BUILDING DESCRIPTION General The proposed remodeling of the Infirmary will provide a new x-ray unit and dental examination room. The remodeling includes reuse of existing rooms, as well as some demolition and new construction. X -Ray Unit The new X-ray Unit is entered off of the waiting area adjacent to the Laboratory. The existing toilet in this area will remain and be reused in the X-ray Unit. Rooms to be added in the new space include two changing cubicles, an x-ray room, a control booth with viewing window, and a dark room. Perimeter walls and door are shielded with a lead lining. Finishes include vinyl tile on floors and paint on new gypsum board walls and plaster ceilings. Dental Examination Room An existing office will be remodeled to accommodate a dental utility chair, sink cabinet, dental x-ray, and an area for sterilization. Page 66 STAFF ORIGINATOR Alan Brixius, DATE May 5, 1995 Northwest Associated Consultants TOPIC 95-16-S, Marshan Condominiums, Lake Drive/Aqua Lane, Site Plan Review Hokanson Development Inc. has requested site plan approval of a 112 unit town home development entitled Marshan Lake Condominiums. The proposed development overlays a 29.9 acre parcel of land located north of Aqua Lane and east of Lake Drive. development itself proposes an interior loop street (public easement) from Aqua Lane which would access 14 individual multiple family structures. The development also includes a acs# acre park along the site's northern border. Because the proposed development application pre -dates the enactment of the City's updated shoreland regulations, the City's site and building plan review procedures and the State Shoreland Standards for multiple family development are applicable. The subject property is zoned R-4, High Density Residential and lies within the Shoreland Overlay District of Marshan Lake. R-4 District provisions list multiple family dwellings such as that being proposed as permitted uses. Attached for reference: Exhibit A - Site Location Exhibit B - Site Plan Exhibit C - Grading, Drainage and Utility Plan Exhibit D - Park Dedication Requirements Recommendation Based on the following review, our office recommends approval of the Marshan Lake Condominium site plan subject to the following conditions: 1. Typical building plans (floor plans and elevations) are submitted for City review and approval. The submission of such plans is necessary to determine compliance with City height and dwelling unit area requirements. 2. Either buildings/off-street parking areas or the proposed loop street right-of-way are relocated such that all applicable 30 foot front yard setbacks are satisfactorily met. If such options are not viewed as viable, a setback variance may be pursued. 3. The City Engineer provide comment/recommendation in regard to street construction standards, street lighting and street signage. 4. The Fire Chief provide recommendation in regard to preferable fire hydrant locations. 5. No off-street parking is to be allowed along the development's private parking area drive aisles. 6. The site plan is revised to designate required handicap parking stalls. 7. The City Park Board provide comment/recommendation in regard to the adequacy of the proposed park land dedication. 8. A landscape plan is submitted which identifies the location, variety and size of all proposed plantings. Comments from other City staff. ISSUES ANALYSIS Zoning. The subject property is zoned R-4, High Density Residential. The R-4 District is intended to provide settings for multiple family housing in areas that have good thoroughfare access, have proper relationship to other uses, and are accessible to major activity centers, recreation areas and shopping areas. The proposed multiple family development is consistent with both the intent of the property's R-4 zoning designation and the provisions of the City's Comprehensive Plan. Density. According to Section 6, Subd. 8.2.E.IV.a of the Zoning Ordinance, the maximum number of dwelling units allowed per acre of buildable land in an R-4 Zoning District is 15. With a total of 112 units proposed upon 19.7 net acres of land, a density of 5.7 dwelling units per acre results. Such density complies with applicable R-4 District requirements. 3 According to Mr. Tom Hovey, a DNR Hydrologist, shoreland standards applicable to the subject property allow a maximum of 115 units upon the subject site. The proposed dwelling unit distribution (via tiers) on the site has also been found to satisfy State Shoreland Ordinance requirements. Multiple Structures. As shown on the submitted site plan, a total of 14 individual structures are proposed to be erected upon the subject property. According to Section 6, Subd. 8 (2) (E) of the Zoning Ordinance, two or more multiple dwelling structures may be erected on a single site provided the following requirements are met: 1. No building shall be closer to another building than thirty-six (36) feet. 2. No building over thirty-six (36) feet in height shall be closer to another building than twice the height of the tallest building. 3. The distance between buildings shall not be required to exceed one hundred (100) feet measured at ground level. While all proposed buildings are provided a separation of not less than 36 feet, compliance with the aforementioned provisions cannot be determined until such time as building heights are specified. As a condition of site and building plan approval, a typical building plan elevations and floor plans should be submitted for City review and approval. Setbacks. Within the R-4 Zoning District, the following setbacks apply: From Lake Drive Front Yard Side Yard - Principal Building - Parking Lot Rear Yard - Principal Building - Parking Lot From Marshan Lake OHWM Requirement 40 feet 30 feet 20 feet 5 feet 30 feet 5 feet 200 feet* NOTE: In the case of the dual application of setbacks, the most restrictive requirement shall apply. * State Standard. 4 While all perimeter setback requirements have been satisfactorily met, the majority of structures and off-street parking areas along side the site's interior loop street do not meet required setbacks. In review of the site plan, it appears that the required setbacks from the interior street have been positioned from the street's curb line rather than the outer dimension of the street easement/right- of-way. As a condition of site and building plan approval, principal buildings and off-street parking areas (30 feet) should be repositioned so as to satisfy required 30 foot front yard setbacks. If such repositioning is not viable, a setback variance may be pursued. Streets. As noted previously, the subject site's interior loop street is to be dedicated as a public street easement. At 60 feet in width, appropriate right-of-way is being provided. While the proposed street layout and width are considered appropriate, the following street related items should be addressed: 1. A slight repositioning of the street may be necessary to allow site structures to meet applicable 30 foot front yard setback requirements. 2. The City Engineer provide comment/recommendation in regard to street construction standards, street lighting and street signage. 3. The City Fire Chief provide recommendation in regard to fire hydrant locations. Off -Street Parking. According to Section 8, Subd. 1.(2)(B) of the Zoning Ordinance, an off- street parking requirement of two and one-half spaces per unit is required in the R-4 Zoning District. As calculated below, a total of 280 spaces is required upon the subject site: Units Ratio Parking Regnirement 112 2.5 spaces per unit 280 In satisfaction of the City's off-street parking requirements, a total of 285 off-street parking spaces have been proposed, 224 of which are indoor garage spaces. It should be noted that tandem driveway parking (in front of indoor garage) are not to be counted in the development's off-street parking supply. Additionally, off-street parking is not to be allowed along private drive aisles to ensure safe and efficient vehicular movement. All off-street parking stalls have been found to meet minimum dimensional requirements (9 feet by 18 feet) as specified in the Zoning Ordinance. 5 According to Section 8, Subd. 4 of the Zoning Ordinance, all off-street parking areas must be designed to provide the following: Bituminous surfacing. Perimeter curbing. Parking light lighting. Striped stalls. Designated handicap parking stalls. Compliance with the aforementioned performance standards shall be a condition of site and building plan review. Parks. As shown on the submitted site plan, a 30 acre park and a 0.6 acre walkway have been proposed. The designation of such park is consistent with the City's Park and Trail System Plan which proposes an off-street trail along the site's northern boundary. Attached Exhibit D illustrates an alternative park dedication which has been submitted by the applicant for City consideration. As a condition of site and building plan approval, the Lino Lakes Park Board should review the proposal and determine whether the proposed land dedication is appropriate. Open Space. According to State shoreland requirements, at least 50 percent of the site must be devoted to open space. Of the total 29.9 acres which encompass the subject site, 22.5 acres are devoted to green space. In compliance with ordinance requirements, 75 percent of the site is devoted to open space. Structure Coverage. According to Section 6, Subd. 8.2.E (IV) (b) of the Zoning Ordinance the area covered by any structures upon the site may not exceed 35 percent of the total land area. The applicant is proposing 3.3 acres of structure coverage upon the subject site. This results in a total structure coverage of 11 percent and satisfies the ordinance requirement. Landscaping. As a condition of site and building plan approval, a landscape plan must be submitted subject to review and approval by the City. Such plan should identify location, type and size of all proposed plantings. Specific landscaping/buffering efforts should be provided along the subject property's northern and western borders. Property Exception. As shown on the submitted site plan, structure #11 partially overlays property not under the ownership of the applicant. While it is understood that the applicant is attempting to purchase the excepted property, the site plan must be revised to either: 1) relocate structure #11 within the confines of the subject property, or 2) include the exception in the development site via lot combination (minor subdivision). 6 Trash Handling. It has not been indicated whether individual unit trash pick up is to be provided. If a consolidated trash area(s) is to be provided, containers must be placed at the rear of the premises, may not be placed next to the street or curb, nor be placed to interfere with the use of adjoining property or cause nuisance. The ordinance further states that trash areas must be screened from eye level view. If applicable, the site plan should be revised to identify all consolidated trash handling areas. All trash handling areas must be fully accessible to trash service vehicles. Snow Removal. As a condition of site and building plan approval, the applicant must submit a snow removal plan which identifies snow storage areas. Snow storage areas may not take up any required parking spaces. Grading, Drainage and Utilities. In accordance with the City's subdivision regulations, a grading, drainage and utility plan has been submitted for review. Such plan shall be subject to review and approval of the City Engineer. Recreational Activities. According to site and building plan review requirements, the planned use of all yards must be specified. According to the site plan, lake access is to be provided. As a condition of site and building plan approval, detailed plans/bylaws governing the use of such access should be submitted to the City for review and approval. If any additional outdoor activities, such as tennis courts, swimming pool, are planned for the large open space between the site's loop street, such activities should be specified on the site plan. Additionally, any covenants governing the use of outdoor recreational activities should be subject to City review and approval. Signage. If any signage is to be erected upon the subject property, such signage must comply with applicable provision of the City Sign Ordinance. Agreement. According to Section 6, Subd. 4 (5) of the Zoning Ordinance, site and building plan review applicants must enter into an agreement with the City which guarantees performance of various site improvements. Performance security of such contracts shall be secured by the amount submitted at application or additional amount as may be required by the City Council. Our comments are as follows: Streets 1. The entire site is accessed exclusively via Lake Drive and Aqua Lane. Although Aqua Lane was recently resurfaced it is substandard for the amount of traffic expected to be generated by the site. Aqua Lane will require upgrading including storm sewer, to accommodate the turning movements for this site as well as for any fixture business development an the northeast comer of Lake Drive/Aqua Lamle. The developer should be responsible for the cost of the required upgrading. 2. According to this site plan a cul-de-sac is proposed at the south end of Stagecoach Trail. This cul- de-sac should be built along with the other site improvements. 3. All roadways within the subdivision are to be constructed to City standards including a 32' wide (B -B) roadway and a 60' right-of-way. 4. Around the radiuses of the horseshoe the centerline slope will have to be increased to provide for a minimum gutter line slope" of 0.50%. 5. Similar to the Shores of Marshan subdivision, the developer will be required to dedicate additional right-of-way along the east side of Lake Drive. The exact amount of this additional right--of-way will be determined by MnDOT. 6. The access driveways to condominium No_ 6, 8-11, are to be constructed to City Street Standards. Sanitary Sewer 1. A feasibility study must be prepared to determine adequacy of the existing sanitary sewer system and the impacton the system due to this development. A preliminary review has been prepared by OSM for the developer which indicated the lift station at the south end of Stagecoach Trail would need significant improvements to accommodate the flows generated by this development. Though the capacity of the lift station is limited, sewer stubs should be provided to serve the remainder of the area northeast of the Lake Drive/Aqua Lane intersection. 4. The minimum sanitary sewer lateral size diameter is 8". Watermain 1. A feasibility study must be prepared to evaluate the adequacy of the existing water system and the impact of the proposed development on the systema. 2. If each condominium unit is not served individually, gate valves will be required at each building lateral. 3. As part of the Shores of Marsha= improvements, a 12" trunk watermain was installed along the east side of Lake Drive. The site currently contains an existing bus storage building of 12,950 square feet and a 5,940+ square foot shop/office. The property is Zoned General Business and is located at 6298 Hodgson Road (immediately north of the Fox Trace Development). ccording to the City Zoning Ordinance Sec. 5, Subd. 4. (iii), "Pole barn construction aknd sheet metal exteriors may be permitted in all commercial, industrial and public semi-public zoning districts as a conditional use under the following circumstances: (a) The n storage of buses. pole barns are accessory structures used for boats, lumber and' building supplies, and Rehhein Transit provides transportation services to the Centennial School District. The School Districts' expansion plans will required the need for approximately 40 more buses to be stored at the Rehbein site. The proposed construction will provide interior storage for these buses. The City's EDAB Board has reviewed the site plan. The applicant has indicated that the exterior, although metal, will contain brick treatment along the front of the building similar to that existing on the office/shop building. City Staff has reviewed the request and would comment that the proposed construction meets the Setback requirements, building height standards, and green space requirements. The Minnesota Department of Natural Resources has provided a model ordinance for communities to use as a guide in this process. Attached for your information is a copy of our existing Floodplain Management Ordinance which was adopted in 1988 and the draft ordinance being proposed for adoption. This Ordinance is very similar to the DNR model with few modifications. Changes from the DNR Model will be outlined at the Planning & Zoning meeting. Some of these changes relate to consistency with our Zoning Ordinance. Staff has met with Tom Hovey, Area Hydrologist with the DNR, to review our proposed ordinance. Although we do not have official comment at this time, he appeared 'to be in agreement with our recommendations: 1. Approve draft ordinance subject to final review and approval by the DNR. 2. Continue Public Hearing pending final review and approval of draft ordinance by DNR. 3. Return to staff for further consideration and reschedule Public Hearing for later date. Regional flood is synonymous with the term "Lase flood” used in the Flood Insurance Study. 2.6 Regulatory Flood Protection Elevation. The Regulatory Flood Pro- tection Elevation shall be an elevation no lower than one foot above the elevation of the regional flood plus any increases in flood elevation caused by encroachments on the flood plain. 3.0 FLOOD PLAIN DISTRICT USES 3.1 Permitted Uses. The following uses have a low flood damage pot- ential and do not obstruct flood flows. These uses shall be per- mitted within the Flood Plain District to the extent that they are not prohibited by any other ordinance and provided they do not re- quire structures, fill, or storage of materials or equipment. In addition, no use shall adversely affect the capacity of the dhannels or flood plains or any tributary to the main stream or of any drain- age ditch, or any other drainage facility or system. 3.11 Agricultural uses such as general farming, pasture, graz- ing, outdoor plat nurseries, horticulture, truck faLuiing, forestry, sod farming, and wild crop harvesting. 3.12 Industrial -Commercial uses such as loading areas, parking areas, and airport landing strips. 3.13 Private and public recreational uses such as golf courses, tennis courts, driving ranges, archery ranges, picnic grounds, boat launching ramps, swimming areas, parks, wildlife and nature preserves, game farms fish hatcheries, shooting pre- serves, target ranges, trap and skeet ranges, hunting and fishing areas, and single or multiple purpose recreational trails. 3.14 Residential uses such as lawns, gardens, parking areas, and play areas. 3.2 Conditional Uses. The following uses and structures may be permitted in the Flood Plain District only after the issuance of a Conditional Use Permit as provided in Section (.H of this Ordinance. All other uses or structures not listed as permitted or conditional uses in the Flood Plain District shall be prohibited. Specifically, mobile homes are prohibited in the Flood Plain District. 3.4 Non -Conforming Uses. A structure or theuse of a structure or premises which was lawful before the passage or amendment of the Section but which is not in conformity with the provisions of this Section may be continued subject to the following conditions: 3.41 No such use shall be expanded, changed, enlarged, or altered in a way which increases its nonconformity. 3.42 No structural alteration or addition to any nonconforming structure over the life of the structure shall exceed 50 percent of its assessed value at the time of its becoming a nonconforming use, unless the entire structure is perman- ently changed to a conforming use or unless the alteration or addition would substantially reduce potential flood damages for the entire structure. 3.43 Any alteration or addition to a nonconforming use which would result in substantially increasing the flood damage potential of that use shall be accomplished in accordance with Section 4.0. 3.44 If any nonconforming use is discontinued for twelve (12) consecutive months, any future use of the building premises shall conform to this Ordinance. The assessor shall notify the Zoning Administrator in writing of instances of non- conforming uses which have been discontinued for a period of twelve (12) months. 4.0 STANDARDS FOR FLOOD PLAIN DISTRICT USES 4.1 All Uses. No structure (temporary or permanent), fill (including fill for roads and levees), deposit, obstruction, storage of mat- erials, or equipment, or other uses may be allowed as a Conditional Use which, acting alone or in combination with existing or reason- ably anticipated future uses, adversely affects the capacity of the Flood plain or increases flood heights subject to the provis- ions of Section 6.3. In addition, all Conditional Uses shall be subject to the standards contained in Section 6.5 and the follow- ing standards (Sections 4.2 and 4.8). 42 Principal and Accessory Structures. Residences and other struct- ures shall be constructed on fill ao that the basement _floor or first floor. if there is no basement, is at or above the Regulatory Flood Protection Elevation. The finished fill elevation shall be no lower than one (1) foot below the Regulatory Flood Protection Elevation and shall extend at such elevation at least fifteen (15) feet beyond the limits of any structure or building erected thereon. Fill shall be compacted and the slopes shall be protected by riprap or vegetative covering. Residences that do not have vehicular access at or above an elevation not more than two feet below the Regulatory Flood Protection Elevation shall not be permitted unless granted a variance by the (-i-y (-,,,Q,,) . In granting a variance the C+T y Ccw„,c,L shall specify limitations on the period of use or occupancy of the residence. 4.3 Commercial Uses. Accessory land uses, such as yards, railroad tracks, and parking lots may be at elevations lower than the Regulatory Flood Protection Elevation. However, a permit for such facilities to be used by the employees or the general public shall not be granted in the absence of a flood warning system that pro- vides adequate time for evacuation if the area would inundate to a depth greater than two (2) feet or be subject to flood veloc- ities greater than four (4) feet per second upon occurrence of the regional flood. 4.4 Manufacturing and Industrial Uses. Measures shall be taken to minimize interference with normal plant operations especially along streams having protracted flood durations. Certain accessory land uses such as yards and parking lots may be at lower elevations subject to requirements set out in Section 4.3 above. In consider- ing permit applications, due consideration shall be given to needs of an industry whose business requires that it be located in flood plain areas. 4.5 Fill. Any fill deposited in the Flood Plain District shall be no more than the minimum amount necessary to conduct a Conditional Use listed in Section 3.2. The effects of any fill on the stage of the regional flood shall be analyzed as required by Section 6.3. Fill shall be protected from erosion by vegetative cover. 4.6 Storage of Materials and Equipment. 4.b1 The storage or processing of materials that are, in time of flooding, flammable, explosive, or potentially injur- ious to human, animal, or plant life is prohibited. 4.62 Storage of other materials or equipment may be allowed if readily removable from the area within the time avail- able after a flood warning. 4.7 Public Utilities. All public utilities and facilities such as gas, electrical, sewer, and water supply systems to be located in the flood plain shall be flood -proofed in accordance with the State Building Code or elevated to above the Regulatory Flood Protection Elevation. 4.8 Public Transportation Facilities. Railroad tracks, roads, bridges to be located within the Flood Plain District shall comply with Section 4.1. Elevation to the Regulatory Flood Protection Elevat- ion shall be provided where failure or interruption of these tran- sportation facilities would result in danger to the public health or safety or where such facilities are essential to the orderly functioning of the area. Minor or auxiliary roads or railroads may be constructed at a lower elevation where failure or interrupt- ion of transportation services would not endanger the public health or safety. 5.0 SUBDIVISIONS IN THE FLOOD PLAIN DISTRICT No land shall be subdivided which is held unsuitable by the City of Lino Lakes for reason of flooding, inadequate drainage, water supply or sewage treatment facilities. All lots within the Flood Plain District shall contain a building site at or above the Regulatory Flood Protection Elevation. All subdivisions shall have water and sewage disposal facilites that comply with the provisions of this Ordinance and have road access both to the subdivision and to the individual building sites no lower than two (2) feet beloti. the Regulatory Flood Protection Elevation_ 6.0 ADAMINISTRATION 6.1 Interpretation of Flood Plain District Boundaries. The boundaries of the Flood Plain District shall be deter- mined by scaling distances on the Official Zoning Map. Where interpretation is needed as to the exact location of the boundaries of the district as shown on the Official Zoning Map, as for example where there appears to be a conflict between a mapped boundary and actual field conditions, the Zoning Official shall make the necessary interpretation based on the elevations on the regional (100 -year) flood profile and other available technical data. Persons contesting the location of the district boundaries shall be given a reasonable opportunity to present their case to the Board and to submit technical evidence. Where data or the elevation of the regional flood are availabe, the provisions of Section 6.3 shall be applied. 6.2 Duties of the Zoning Official. 6.21 State and Federal Permits. Prior to processing an application for a Conditional Use Permit or 'Variance, the Zoning Official shall determine that the applicant has obtained all necessary She and Federal Permits. 6.22 Record of First Floor Elevation. B. The City Local Water Management Plan (LWMP) is a comprehensive planning tool that specifically identifies goals and policies for water management. Standards for flood control, erosion and sediment control, water quality enhancement, and the preservation of natural features have been identified. The plan also includes flood plain delineation, necessary freeboard requirements and recommended building elevations. This ordinance is based upon the recommendations of the LWMP, which is hereby adopted into this ordinance by reference and incorporated in its entirety, including all amendments. C. Methods Used to Analyze Flood Hazards. This ordinance is based upon a reasonable method of analyzing flood hazards which is consistent with the standards established by the Minnesota Department of Natural Resources. D. Statement of Purpose. It is the purpose of this ordinance to promote the public health, safety, and general welfare and to minimize those losses described in A above by provisions contained herein. 1103.02 General Provisions. Subdivision 1. Jurisdiction. This ordinance shall apply to all lands within the jurisdiction of the City of Lino Lakes shown on the Official Zoning Map and/or the attachments thereto as being located within the boundaries of the 100 -year regional flood. Subd. 2. Establishment of Official Zoning Map. The Official Zoning Map together with all materials attached thereto is hereby adopted by reference and declared to be a part of this ordinance. The attached material shall include the Flood Insurance Study for the City of Lino Lakes prepared by the Federal Insurance Administration dated November 11, 1981, and the Flood Boundary and Floodway Map and Flood Insurance Rate Map dated May 17, 1982 therein. The Official Zoning Map shall be on file in the office of the City Clerk -Treasurer and the Building Inspector/Zoning Official. Subd. 3. Rules for Interpretation of District Boundaries. The boundaries of the Floodplain Overlay District shall be determined by scaling distances on the Official Zoning Map. Where interpretation is needed as to the exact location of the boundaries of the district, as shown on the Official Zoning Map as for example, where there appears to be a conflict between a mapped boundary and actual field conditions, the City Engineer shall make the necessary interpretation. The persons contesting the locations of the district boundary shall be given a reasonable opportunity to present their case and to submit their own technical evidence. Subd. 4. Regulatory Flood Protection Elevation. The regulatory flood protection elevation shall be an elevation no lower than one foot above the elevation of the 100 year base regional flood elevation plus any increases in flood elevation caused by encroachments on the floodplain that result from designation of a floodway. Subd. 5. Compliance. No new structure or land shall hereafter be used and no structure shall be located, extended, converted, or structurally altered without full compliance with the terms of this ordinance and the applicable regulations which apply to uses within the jurisdiction of this Page 2 ordinance. All uses not listed as permitted uses or conditional uses in Sections 1103.06 shall be prohibited. In addition, a caution is provided here that: A. New manufactured homes, replacement manufactured homes and certain travel trailers and travel vehicles are subject to the general provisions of this ordinance and specifically Section 1103.09 and Section 6, Subd. 10 and Subd. 11 of the City Zoning Ordinance. B. Modifications, additions, structural alterations or repair after damage to existing nonconforming structures and nonconforming uses of structures or land are regulated by the general provisions of this ordinance and specifically Section 1103.06, Subd. 4 and Section 4, Subd. 5 of the City Zoning Ordinance. C. As -built elevations for elevated or flood proofed structures must be certified by ground surveys and flood proofing techniques must be designed and certified by a registered professional engineer or architect as specified in the general provision of this ordinance and specifically as stated in Section 1103.04 of this ordinance. Subd. 6. Penalties for Violation. A. Violation of the provisions of this ordinance or failure to comply with any of its requirements (including violations of conditions and safeguards established in connection with grants of variances or conditional uses) shall constitute a misdemeanor and shall be punishable as defined by law. B. Nothing herein contained shall prevent the City of Lino Lakes from taking such other lawful action as is necessary to prevent or remed any violation. Such actions may include, but are not limited to: 1. In responding to a suspected ordinance violation, the Zoning Administrator and City of Lino Lakes may utilize the full array of enforcement actions available to it including but not limited to prosecution and fines, injunctions, after -the -fact permits, orders for corrective measures or a request to the National Flood Insurance Program for denial of flood insurance availability to the guilty party. The community must act in good faith to enforce these official controls and to correct ordinance violations to the extent possible so as not to jeopardize its eligibility in the National Page 3 Flood Insurance Program. 2. When an ordinance violation is either discovered by or brought to the attention of the Zoning Administrator, the Zoning Administrator shall immediately investigate the situation and document the nature and extent of the violation of the official control. As soon as is reasonably possible, this information will be submitted to the appropriate Department of Natural Resources and Federal Emergency Management Agency Regional Office along with the Community's plan of action to correct the violation to the degree possible. 3. The Zoning Administrator shall notify the suspected party of the requirements of this ordinance and all other Official Controls and the nature and extent of the suspected violation of these controls. If the structure and/or use is under construction or development, the Zoning Administrator may order the construction or development immediately halted until a proper permit or approval is granted by the Community. If the construction or development is already completed, then the Zoning Administrator may either: a. issue an order identifying the corrective actions that must be made within a specified time period to bring the use or structure into compliance with the official controls, or b. notify the responsible parry to apply for and after -the -fact permit/development approval within a specified period of time not to exceed 30 days. 4. If the responsible party does not appropriately respond to the Zoning Administrator within the specified period of time, each additional day that lapses shall constitute an additional violation of this ordinance and shall be prosecuted accordingly. The Zoning Administrator shall also, upon the lapse of the specified response period, notify the landowner to restore the land to the condition which existed prior to the violation of this ordinance. Page 4 Subd. T. Interpretation. In their interpretation and application, the provisions of this ordinance shall be held to be minimum requirements and shall be liberally construed in favor of the governing body and shall not be deemed a limitation or repeal of any other powers granted by State Statutes. Where a specific use or performance standard is not specifically referenced in this Ordinance it shall be prohibited. Subd. 8. Abrogation and Greater Restrictions. It is not intended by this ordinance to repeal, abrogate, or impair any existing easements, covenants, or deed restrictions. However, where this ordinance imposes greater restrictions, the provisions of this ordinance shall prevail. All other ordinances inconsistent with this ordinance are hereby repealed to the extent of the inconsistency only. Subd. 9. Warning and Disclaimer of Liability. This chapter does not imply that areas outside of the Flood Plain Overlay District or land uses permitted within such districts will be free from flooding or flood damages. The chapter does not create liability on the part of the City of Lino Lakes or its officers or employees for any flood damage that may result from reliance on this chapter or any administrative decision lawfully made under it. Subd. 10. Severability. If any section, clause, provision, or portion of this ordinance is adjudged unconstitutional or invalid by a court of competent jurisdiction, the remainder of this ordinance shall not be affected thereby. 1103.03 Definitions. Unless specifically defined below, words or phrases used in this ordinance shall be interpreted so as to give them the same meaning as they have in common usage and so as to give this ordinance its most reasonable application. Subdivision 1. Accessory use or structure. "Accessory use or structure" means a use or structure on the same lot with, and of a nature customarily incidental and subordinate to, the principal use or structure. Subd. 2. Basement. "Basement" means any area of a structure, including crawl spaces, having its floor or base subgrade on all four sides, regardless of the depth of excavation below ground level. Subd. 3. Conditional use. A land use or development that may not be appropriate generally within a certain district but may be allowed in that district with appropriate restrictions, conditions or limitations as imposed by the City Council. Page 5 Subd. 4. Equal degree of encroachment. "Equal degree of encroachment" is a method of determining the location of floodway boundaries so that flood plain lands on both sides of a stream are capable of conveying a proportionate share of flood flows. Subd. 5. Flood. "Flood" means a temporary increase in the flow or stage of a stream or in the stage of a wetland or lake that results in the inundation of normally dry areas. Subd. 6. Flood frequency. "Flood frequency" means the frequency for which it is expected that a specific flood stage or discharge may be equaled or exceeded. Subd. 7. Flood plain "Flood plain" means the beds proper and areas adjoining a wetland, lake or watercourse which have been or hereafter may be covered by the regional flood. Subd. 8. Flood -Proofing. "Flood -proofing" means a combination of structural provisions, changes, or adjustments to properties and structures subject to flooding, primarily for the reduction or elimination of flood damages. Subd. 9. Obstruction. "Obstruction" means any dam, wall, wharf, embankment, levee, dike, pile, abutment, projection, excavation, channel modification, culvert, building, wire, fence, stockpile, refuse, fill, structure, or matter in, along, across, or projecting into any channel, watercourse, or regulatory flood plain which may impeded, retard, or change the direction of the flow of water, either in itself or by catching or collecting debris carried by such water. Subd. 10. Regional flood. "Regional flood" means a flood which is representative of large floods known to have occurred generally in Minnesota and reasonably characteristic of what can be expected to occur on an average frequency in the magnitude of the 100 -year recurrence interval. Regional flood is synonymous with the term "base flood" used in the Flood Insurance Study. Subd. 11. Regulatory flood protection elevation. "Regulatory flood protection elevation" is an elevation no lower than one foot above the elevation of the regional flood plus any increases in flood elevation caused by encroachments on the flood plain that result from designation of a floodway. Subd. 12. Variance. A modification of the strict provisions of this Ordinance as applied to a specific piece of property in order to provide relief Page 6 for a property owner because of undue hardship imposed upon the property by this Ordinance. A variance shall normally be limited to height, density and yard requirements. A modification in the allowable uses within a district shall not be considered a variance. 1103.04 Administration. Subdivision 1. Zoning Administrator. The Zoning Administrator shall administer and enforce this ordinance. The Zoning Administrator shall review all development proposals to determine whether the proposed use lies within the Flood Plain Overlay District. No development shall be permitted unless it complies with all provisions of this ordinance. If the Zoning Administrator finds a violation of the provisions of this ordinance, he shall notify the person responsible for the violation in accordance with Section 1103.02, Subd.3 of this ordinance. Subd. 2. Permit Requirements. A. Permit Required. A permit issued by the Zoning Administrator in conformity with the provisions of this ordinance shall be secured prior to the erection, addition, or alteration of any building, structure or portion thereof; prior to the use or change of use of a building, structure, or land; prior to the change or extension of a nonconforming use; and prior to the placement of fill, excavation of materials, or the storage of materials or equipment within the Flood Plain Overlay District. B. Application and Fee. A use permit shall be applied for from the Zoning Administrator. Said application shall be made in duplicate and shall include the following where applicable: plans in duplicate drawn to scale, showing the nature, location, dimensions, and elevations of the lot; existing or proposed structures, fill, or storage of materials; and the location of the foregoing in relation to the stream channel. An application fee amount will be in accordance with City resolution and shall be required for each use permit. C. State and Federal Permits. Prior to processing an application for a Conditional Use Permit or Variance, the Zoning Administrator shall determine that the applicant has obtained all necessary State and Federal permits. Subd. 3. Certificate of Zoning Compliance. It shall be unlawful to use, occupy, or permit the use or occupancy of any building or premises or part thereof hereafter created, erected, changed, converted, altered, or enlarged ion its use or structure until a Certificate of Zoning Compliance is Page 7 issued by the Zoning Administrator stating that the use of the building or land conforms to the requirements of this ordinance. Subd. 4. Permits, conditional use permits, or certificates of zoning compliance issued on the basis of approved plans and applications authorize only the use, arrangement, and construction set forth in such approved plans and applications, and no other use, arrangement or construction. Any use, arrangement construction at variance with that authorized shall be deemed a violation of this ordinance and punishable as provided by Section 1103.02, Subd3. of this ordinance. Subd. 5. Certification. The applicant shall be required to submit certification by a registered professional engineer, registered architect, or registered land surveyor that the finished fill ad building elevations were accomplished in compliance with the provisions of this ordinance. Flood - proofing measures shall be certified by a registered professional engineer or registered architect. Subd. 6. Record of First Floor Elevation. The Zoning Administrator shall maintain a record of the elevation of the first floor (including basement) of all new structures or additions to existing structures in the Flood Plain District. The Zoning Administrator shall also maintain a record of the elevations to which structures or additions to structures are flood -proofed. Subd. 7. Variances. A. The City Council may authorize upon appeal in specific cases such variance form the terms of this ordinance as will not be contrary to public interest, where, owing to special conditions, literal enforcement of the provisions of this ordinance will result in unnecessary hardship so that the spirit of the ordinance shall be observed and substantial justice done. No variance shall have the effect of allowing in any district uses prohibited in that district, permit a lower degree of flood protection than the Regulatory Flood Protection Elevation for the particular area, or permit standards lower than those required by State law. B. The City Council Shall hear and decide requests for variance in accordance with the rules that it has adopted for the conduct of business in Section 5, Subd. 7 of the City Zoning Ordinance. Subd. 8. Conditional Use Permits. The City Council shall hear and decide applications for conditional uses permissible under this ordinance. Page 8 A. Application. The applicant shall be required to furnish such of the following information and additional information as deemed necessary by the Zoning Administrator for determining the suitability of the particular site for the proposed use. 1. Plans. Plans in triplicate drawn to scale showing the nature, location, dimensions and elevation of the lot, existing or proposed structures, fill, storage of materials, flood -proofing measures, and the relationship of the above to the location of the Flood Plain Overlay District boundaries. 2. Specifications. Specifications for building construction materials, filling, dredging, grading, channel improvement, storage of materials, water supply and sanitary facilities. 3. Certification. The applicant shall be required to submit certification by a registered professional engineer, registered architect, or registered land surveyor that the finished fill ad building elevations were accomplished in compliance with the provisions of this ordinance. Flood -proofing measures shall be certified by a registered professional engineer or registered architect. B. Review. The City shall transmit one copy of the information described in subsection 1 above to a designated engineer or other expert person or agency for technical assistance, where necessary, to evaluate the proposed project in relation to flood heights and velocities, the seriousness of flood damage to the use, the adequacy of the plans for protection, and other technical matters. C. Based upon the technical evaluation of the designated engineer or expert, the City Council shall determine the specific flood hazard at the site and evaluate the suitability of the proposed use in relation to the flood hazard. D. Decisions. The City Council shall arrive at a decision on a conditional use within days. In granting a conditional use permit the City Council shall prescribe appropriate conditions and safeguards, in addition to those specified in Subsection 6 below, which are in conformity with the purposes of this ordinance. Violations of such conditions and safeguards, when made a part of the terms under which the conditional use permit is granted, shall be deemed a violation of this ordinance punishable under Section 1103.02, Subd.3. Page 9 E. Basis of Decision. In passing upon conditional use applications, the City Council shall consider all relevant factors specified in other sections of this ordinance and: 1. The danger to life and property due to increased flood heights or velocities caused by encroachments. 2. The danger that materials may be swept onto other lands or downstream to the injury of others or they may block bridges, culverts or other hydraulic structures. 3. The proposed water supply and sanitation systems and the ability of these systems to prevent disease, contamination, and unsanitary conditions. 4. The susceptibility of the proposed facility and its contents to flood damage and the effect of such damage on the individual owner. 5. The importance of the services provided by the proposed facility to the community. 6. The requirement of the facility for a waterfront location. 7. The availability of alternative locations not subject to flooding for the proposed use. 8. The compatibility of the proposed use with the existing development and development anticipated in the foreseeable future. 9. The relationship of the proposed use to the comprehensive plan and the Lino Lakes Local Water Management Plan. 10. The safety of access to the property in times of flood for ordinary and emergency vehicles. 11. The expected heights, velocity, duration, rate of rise, and sediment transport of the flood waters expected at the site. 12. Such other factors which are relevant to the purpose of this ordinance. F. Conditions Attached to Conditional Use Permits. Upon consideration of the factors listed above and the purpose of this ordinance, the City Council shall attach such conditions to the Page 10 granting of the conditional use permits as it deems necessary to fulfill the purpose of this ordinance. Such conditions may include, but are not limited to, the following: 1. Modification of waste treatment and water supply facilities. 2. Limitations on period of use, occupancy and operation. 3. Imposition of operations controls, sureties, and deed restrictions. 4. Requirements of construction of channel modifications, compensatory storage, dikes, levees, and other protective measures. 5. Flood -proofing measures, in accordance with the State Building Code and this ordinance. The applicant shall submit a plan or document certified by a registered professional engineer or architect that the flood -proofing measures are consistent with the Regulatory Flood Protection elevation, the Lino Lakes Local Water Management Plan and associated flood factors for the particular area. Subd. 9. Amendments. A. The floodplain designation on the official Floodplain Map shall not be removed from floodplain areas unless it can be shown that the designation is in error or that the area has been filled to or above the elevation of the regional flood and is contiguous to lands outside the floodplain. Special exceptions to this rule may be permitted by the Commissioner of Natural Resources if he determines that, through other measures, lands are adequately protected for the intended use. B. All amendments of this ordinance, including amendments to the official Floodplain Map, must be submitted to and approved by the Commissioner of Natural Resources prior to adoption. Changes to the official Floodplain Map must meet the FEMA's Technical Conditions and Criteria and must receive FEMA approval before adoption. The Commissioner of Natural Resources must be given (10) days written notice of all hearings to consider an amendment to this Ordinance and said notice shall include a draft of the Ordinance amendment or technical study under consideration. Subd. 10. Notification to the Department of Natural Resources. Page 11 A. Copies of all notices of any public hearings to consider variances, amendments, or conditional uses under local flood plain management controls must be sent to the Commissioner or the Commissioner's designated representative and postmarked at least ten (10) days before the hearings. B. A copy of final decisions granting variances or conditional uses under local flood plain management controls must be sent to the Commissioner or the Commissioner's designated representative and postmarked within ten (10) days of final action. 1103.05 Establishment of Zoning District. Subdivision 1. Flood Plain Overlay District. The Flood Plain Overlay District shall include those areas designated as unnumbered A Zones on the Flood Insurance Rate Map adopted in Section 1103.02, Subd. 2. Subd. 2. District Application. The FP, Floodplain Overlay District shall be applied to and superimposed upon all zoning districts as existing or amended by the text and map of this Ordinance. The FP, Floodplain Overlay District regulations shall not be construed to allow any use or structure otherwise not allowed in the underlying zoning district where the property is located. The regulations and requirements imposed by the FP, Floodplain Overlay District shall be in addition to those established by all other districts of this Ordinance. The FP, Floodplain Overlay District shall be established based upon the specific information contained in the Flood Boundary, Floodway, and Flood Insurance Rate Maps and the Flood Insurance Study for the City of Lino Lakes. All aforementioned official road maps and documents are hereby adopted by reference and declared to be an integral part of this Ordinance section. Subd. 3. Regulatory Flood Protection Elevation. The Regulatory Flood Protection Elevation shall be an elevation no lower than one foot above the elevation of the regional flood plus any increases in flood elevation caused by encroachments on the flood plain that result from designation of a floodway. 1103.06 Floodplain Overlay District Uses. Subdivision 1. Permitted Uses. The following uses have a low flood potential and do not obstruct flood flows. These uses shall be permitted within the Flood Plain Overlay District to the extent that they are allowed in the underlying base zoning district, they are not prohibited by any other ordinance and provided they do not require structures, fill, or storage of Page 12 materials or equipment. In addition, no use shall adversely affect the capacity of the channels or flood plains or any tributary to the main stream or of any drainage ditch, or any other drainage facility or system. A. Agricultural uses such as general farming, pasture, grazing, outdoor plant nurseries, horticulture, truck farming, forestry, sod farming and wild crop harvesting. B. Industrial -commercial uses such as loading areas, parking areas, and airport landing strips. C. Private and public recreational uses such as golf courses, tennis courts, driving ranges, archery ranges, picnic grounds, swimming areas, parks, wildlife and nature preserves, game farms, fish hatcheries, shooting preserves, target ranges, trap and skeet ranges, hunting and fishing areas, and single- or multiple -purpose recreational trails. D. Residential accessory uses such as lawns, gardens, parking areas and play areas as long as no permanent structures are constructed. E. Boat launching ramps and docks on riparian lots accessory to a permitted principal use. Subd. 2. Conditional Uses. A. The following use and structures may be permitted in the Floodplain Overlay District only after the issuance of a conditional use permit, as provided for in Section 1103.04, Subd. 9 of this Ordinance. These uses shaft be permitted within the Floodplain Overlay District to the extent that they are allowed in the underlying base zoning district, they are not prohibited by any other ordinance, and they comply with the provisions of Section 1103.07, which applies to all Floodplain Overlay District conditional uses. 1. Principal residential, commercial, and industrial structures. 2. Accessory structures. 3. Placement of fill. 4. Railroads, streets, bridges, utility transmission lines and pipelines. Page 13 5. Extraction and storage of sand, gravel and other materials. 6. Marinas, boat rentals, docks, piers, wharves and water control structures, 7. Storage yards for equipment, machinery or materials. 8. Travel trailers and travel vehicles either on individual lots of record or in existing or new subdivisions or commercial or condominium type campgrounds, subject to the exemptions and provisions of Section 1103.09, Subd. 4. 9. Structural works for flood control such as levees, dikes and floodwalls constructed to any height where the intent is to protect individual structures and levees or dikes where the intent is to protect agricultural crops for a frequency flood event equal to or less than the 10 -year frequency flood event. B. Determination of Flood Hazards. 1. Upon receipt of an application for a Conditional use Permit for a use within the Flood Plain Overlay District where the Regulatory Flood Protection Elevation is unknown, the applicant shall be required to furnish such of the following information as is deemed necessary by the Zoning Administrator for the determination of the Regulatory Flood Protection Elevation. a. A typical cross section showing the channel of the stream, elevation of land areas adjoining each side of the channel, cross-sectional areas to be occupied by the proposed development and high water information. b. Plan (surface view) showing elevations or contours of the ground; pertinent structures, fill or storage elevations; size, location and spatial arrangement of all proposed and existing structures on the site; location and elevation of streets; photographs showing existing land uses and vegetation upstream and downstream; and soil type. c. Profile showing the slope of the bottom of the channel Page 14 or flow line of the stream for at least 500 feet in either direction from the proposed development. 2. One copy of the above information shall be transmitted to a designated engineer or other expert person or agency for technical assistance in determining whether the proposed use adversely affects the capacity of the flood plain and to determine the Regulatory Flood Protection elevation. Procedures consistent with Minnesota Regulations NR 86-87 shall be followed in this expert evaluation. The designated engineer or expert shall: a. Estimate the peak discharge of the regional flood. b. Calculate the water surface profile of the regional flood based upon a hydraulic analysis of the stream channel and overbank areas. c. Compute the area necessary to convey the regional flood without increasing flood stages more than 0.5 feet. An equal degree of encroachment on both sides of the stream within the reach shall be assumed in computing the area of the regional flood. 3. Based upon the technical evaluation of the designated engineer or expert, the City Council shall determine whether the proposed use adversely affects the capacity of the flood plain or the Regional Flood Protection Elevation at the site. Subd. 3. Prohibited Uses. All other uses or structures not listed as permitted or conditional uses in the Flood Plain Overlay District shall be prohibited. Subd. 4. Nonconforming Uses. A structure or the use of a structure or premises which was lawful before the passage or amendment of the Section but which is not in conformity with the provisions of this section may be continued subject to the following conditions: A. No such use shall be expanded, changed, enlarged or altered in a way which increases its nonconformity. B. No structural alteration or addition to any nonconforming structure over the life of the structure shall exceed 50 percent of its Page 15 assessed value at the time of its becoming a nonconforming use, unless the entire structure is permanently changed to a conforming use or unless the alteration or addition would substantially reduce potential flood damages for the entire structure. C. Any alteration or addition to a nonconforming use which would result in substantially increasing the flood damage potential of that use shall be accomplished in accordance with Section 1103.07. D. If any nonconforming use is discontinued for twelve (12) consecutive months, any future use of the building premises shall conform to this ordinance. The assessor shall notify the Zoning Administrator in writing of instances of nonconforming uses which have been discontinued for a period of twelve (12) months. 1103.07 Standards for Flood Plan Overlay District Uses. Subdivision 1. All Uses. A. No structure (temporary or permanent), fill (including fill for roads and levees), deposit, obstruction, storage of materials or equipment or other uses may be allowed as a conditional use which, acting alone or in combination with existing or reasonably anticipated future uses, adversely affects the capacity of the flood plain or increases flood heights subject to the provisions of Section 1103.06, Subd. 2C. B. All conditional uses shall be subject to the standards contained in Section 1103.06, Subd. 2B5 and the following standards in Subd. 2 and Subd. 8 below. Subd. 2. Principal Use. A. Residential Use. 1. Principle and accessory residential structures shall be constructed on fill with the lowest floor (including basement) at or above the regulatory flood protection elevation. The finished fill elevation shall be no more than one (1) foot below the regulatory flood protection elevation for the particular area and shall extend at such elevation at least fifteen (15) feet beyond the limits of any structure or building erected thereon. 2. Residences that do not have vehicular access at or above an elevation not more than two (2) feet below the Regulatory Page 16 Flood Protection Elevation shall not be permitted unless granted a variance by the Board of Adjustment. In granting a variance, the Board shall specify limitations on the period of use or occupancy of the residence. B. Non -Residential Use. 1. Commercial, manufacturing, and industrial structures shall ordinarily be elevated on fill so that their lowest floor (including basement) is at or above the Regulatory Flood Protection Elevation, but may where floodplain fill may result in an increase in the regional flood elevation, change in the natural course of the floodplain drainage or result in potential flooding of neighboring properties be flood proofed in accordance with the State Building Code. Structures that are not elevated to above the Regulatory Flood Protection Elevation shall be flood proofed to FP -1 or FP -2 classification as defined by the State Building Code. Structures flood proofed to FP -3 or FP -4 classification shall not be permitted. 2. Commercial, Manufacturing and Industrial. Accessory land uses, such as yards, railroad tracks, and parking lots may be at lower elevations. However, a permit for such accessory facilities to be used by the general public shall not be granted, in the absence of a flood warning system, if the area is inundated to a depth greater than two (2) feet or subject to flood velocities greater than four (4) feet per second upon the occurrence of the regional flood. Subdivision 3. Accessory Uses. Accessory structures shall be elevated on fill or structurally dry flood proofed in accordance with the FP- I or FP -2 flood proofing classifications in the State Building Code. As an alternative, an accessory structure may be flood proofed to the FP -3 or FP -4 flood proofing classification in the State Building Code provided the accessory structure constitutes a minimal investment, does not exceed 500 square feet in the size, and for a detached garage, the detached garage must be used solely for parking of vehicles and limited storage. All flood proofed accessory structures must meet the following additional standards, as appropriate: A. The structure must be adequately anchored to prevent flotation, collapse or lateral movement of the structure and shall be designed to equalize hydrostatic flood forces on exterior walls; and B. Any mechanical and utility equipment in a structure must be elevated to or above the Regulatory Flood Protection Elevation or properly flood proofed. Page 17 C. Whenever possible, structures shall be constructed with the longitudinal axis parallel to the direction of flood flow. D. So far as practicable, structures shall be placed approximately on the same flood flow lines as those of adjoining structures. Subdivision 4. Structural Flood Proofing Standards. Alternative elevation methods other than the use of fill may be utilized to elevate a commercial and industrial structure's lowest floor above the Regulatory Flood Protection Elevation. These alternative methods may include the use of stilts, pilings, parallel walls, etc., or above grade, enclosed areas such as crawl spaces or tuck under garages. The base or floor of an enclosed area shall be considered above grade and not a structure's basement or lowest floor if 1) the enclosed area is above grade on at least one side of the structure; 2) is designed to internally flood and is constructed with flood resistant materials; and 3) is used solely for parking of vehicles, building access or storage. The above noted alternative elevation methods are subject to the following additional standards: A. Design and Certification. The structure's design and as built condition must be certified by a registered professional engineer or architect as being in compliance with the general design standards of the State Building Code and, specifically, that all electrical heating, ventilation, plumbing and air conditioning equipment and other service facilities must be at or above the Regulatory Flood Protection Elevation or be designed to prevent flood water from entering or accumulating within these components during times of flooding. B. Specific Standards for Above Grade, Enclosed Areas. Above grade, fully enclosed areas such as crawl spaces or tuck under gar- ages must be designed to internally flood and the design plans must stipulate: 1. The minimum area of openings in the walls where internal flooding is to be used as a flood proofing technique. When openings are placed in a structure's walls to provide for entry of flood waters to equalize pressures, the bottom of all openings shall be no higher than one foot above grade. Openings may be equipped with screens, louvers, valves, or other coverings or devices provided that they permit the automatic entry and exit of flood waters. 2. That the enclosed area will be constructed of flood resistant materials in accordance with the FP -3 or FP -4 classifications in Page 18 the State Building Code and shall be used solely for building access, parking of vehicles or storage. C. Basements, as defined in Section 1103.3 of this Ordinance, shall be subject to the following: 1. Residential basement construction shall not be allowed below the Regulatory Flood Protection Elevation. 2. Non-residential basements may be allowed below the Regulatory Flood Protection Elevation provided the basement is structurally dry flood proofed in accordance with Section 1103.07, Subd. 4 of this Ordinance. D. All areas of non-residential structures, including basements to be placed below the Regulatory Flood Protection Elevation, shall be flood proofed in accordance with the structurally dry flood proofing classifications in the State Building Code. Structurally dry flood proofing classification in the State Building Code and this shall require making the structure water tight with the walls substantially impermeable to the passage of water and with structural components having the capability of resisting hydrostatic and hydrodynamic loads and the effects of buoyancy. Structures flood proofed to the FP -3 or FP -4 classification shall not be permitted. Subd. 5 Fill. A. Any fill deposited in the Flood Plain Overlay District shall be no more than the minimum amount necessary to conduct a conditional use listed in Section 1103.04,Subd. 2. B. The effects of any fill on the stage of the regional flood shall be analyzed as required by Section 1103.04, Subd. 2C. C. Fill shall be protected from erosion by vegetative cover. D. Fill for Construction. Fill shall be adequately compacted and the slopes shall be protected by the use of rip rap, vegetative cover or other acceptable method. The Federal Emergency Management Agency (FEMA) has established criteria for removing the special flood hazard area designation for certain structures properly elevated on fill above the 100 year flood elevation. FEMA's requirements incorporate specific fill compaction and side slope protection standards for multistructure or multi -lot developments. These standards must be Page 19 investigated prior to the initiation of site preparation if a change of special flood hazard area designation will be requested. Subd. 6. Storage of Materials and Equipment. A. The storage or processing of materials that are, in time of flooding, flammable, explosive, or potentially injurious to human, animal or plant life is prohibited. B. Storage of other materials or equipment may be allowed if readily removable from the area within the time available after a flood warning and in accordance with a plan approved by the City Council. Subd. 7. Public Utilities. All public utilities and facilities such as gas, electrical, sewer and water supply systems to be located in the flood plain shall be flood proofed in accordance with the State Building Code or elevated to above the Regulatory Flood Protection Elevation. Subd. 8. Public Transportation Facilities. A. Railroad tracks, roads and bridges to be located within the Flood Plain Overlay District shall comply with Subd. 1 above. B. Elevation to the Regulatory Flood Protection Elevation shall be provided where failure or interruption of public transportation facilities would result in danger to the public health or safety or where such facilities are essential to the orderly functioning of the area. C. Minor or auxiliary roads or railroads may be constructed at a lower elevation where failure or interruption of transportation services would not endanger the public health or safety. Subd. 9. On-site Sewage Treatment and Water Supply Systems. Where public utilities are not provided: A. On-site water supply systems must be designed to minimize or eliminate infiltration of flood waters into the systems; and B. New or replacement on-site sewage treatment systems must be designed to minimize or eliminate infiltration of flood waters into the systems and discharges from the systems into flood waters and they shall not be subject to impairment or contamination during times of flooding. Page 20 C. Any sewage treatment system designed in accordance with the State's current statewide standards for on-site sewage treatment systems shall be determined to be in compliance with this section. 1103.08 Subdivisions. No land shall be subdivided which is held unsuitable by the City of Lino Lakes for the reason of flooding, inadequate drainage, water supply or sewage treatment facilities. Subdivision 1. All lots within the Flood Plain Overlay District shall contain a building site at or above the Regulatory Flood Protection Elevation. Subd. 2. All subdivisions shall have water and sewage disposal facilities that comply with the provisions of this ordinance and have road access both to the subdivision and to the individual building sites no lower than the elevation of the 100 -year regional flood. 1103.09 Manufactured Homes/Travel Trailers and Travel Vehicles. Subdivision 1. New manufactured home parks and expansions to existing manufactured home parks shall be subject to the provisions placed on subdivisions by Section 1103.08 of this ordinance. Subd. 2. The placement of new or replacement manufactured homes in existing manufactured home parks or on individual lots of record that are located in a Flood Plain Overlay District will be treated as a new structure and may be placed only if elevated in compliance with the L@ and Section 1103.07 of this ordinance. If vehicular road access for pre-existing manufactured home parks is not provided in accordance with Section 1103.08, Subd. 2, then replacement manufactured homes will not be allowed until the property owner(s) develops a flood warning emergency plan acceptable to the City Council. Subd. 3. All manufactured homes must be securely anchored to an adequately anchored foundation system that resists flotation, collapse and lateral movement. Methods of anchoring may include, but are not limited to, use of over -the -top or frame ties to ground anchors. This requirement is in addition to applicable sate or local anchoring requirements for resisting wind forces. Subd. 4. Travel trailers and travel vehicles that do not meet the exemption criteria specified below shall be subject to the provisions of this ordinance and as specifically spelled out in Subsections C and D below. A. Exemption. Travel trailers and travel vehicles are exempt from the provisions of this ordinance if they are placed in any of the area Page 21 listed in Subsection B below and further they meet the following criteria: 1. Have current licenses required for highway use. 2. Are highway ready meaning on wheels or the internal jacking system, are attached to the site only by quick disconnect type utilities commonly used in campgrounds and trailer parks and the travel trailer/travel vehicle has no permanent structural type additional attached to it. 3. The travel trailer or travel vehicle and associated use must be permissible in any pre-existing, underlying zoning district. B. Areas Exempted for Placement of Travel/Recreational Vehicles. 1. Individual lots or parcels of record. 2. Existing commercial recreational vehicle parks or campgrounds. 3. Existing condominium type associations. C. Travel trailers and travel vehicles exempted in Subsection A above lose this exemption when development occurs on the parcel exceeding dollars for a structural addition to the travel trailer/ travel vehicle or an accessory structures such as a garage or storage building. The travel trailer/travel vehicle and all additions and accessory structures will then be treated as a new structure and shall be subject to the elevation and flood -proofing requirements and the use of land restrictions specified in Section 1103.06 of this ordinance. D. New commercial travel trailer or travel vehicle parks or campgrounds and new residential type subdivisions and condominium associations and the expansion of any existing similar use exceeding five (5) units or dwelling sites shall be subject to the following: 1 . Any new or replacement travel trailer or travel vehicle will be allowed in the Flood Plain Overlay District provided said trailer or vehicle and its contents are placed on fill above the Regulatory Flood Protection Elevation and proper elevated road access to the site exists in accordance with Section 1103.08, Subd. 2 of this ordinance. All new or replacement travel trailers or travel vehicles not meeting the criteria of Subpart 1 above may, as an alternative, be allowed as a Conditional Use if in accordance with the following provisions and the provisions of Section 1103.06, Subd. 2 of this ordinance. a. The applicant must submit an emergency plan for the safe evacuation of all vehicles and people during the 100 - year flood. Said plan shall be prepared by a registered engineer or other qualified individual and shall demonstrate that adequate time and personnel exist to carry out the evacuation. b. All attendant sewage and water facilities for the new or replacement travel trailers or other recreational vehicles must be protected ' or constructed so as to not be impaired or contaminated during time so of flooding in accordance with Section 1103.07, Subd. 9 of this ordinance. 1103.10 Amendments. Subdivision 1. The flood plain designation of the Official Zoning Map shall not be removed from the Flood Plain Overlay District unless it can be shown that the designation is in error or that the area has been filled to or above the elevation of the regional flood and is contiguous to lands outside the flood plain. Special exceptions to this rule may be permitted by the Commissioner of Natural Resources if he determines that, through other measures, lands are adequately protected for the intended use. Subd. 2. All amendments to this ordinance, including amendments to the Official Zoning Map, must be submitted to and approved by the Commissioner of Natural Resources prior to adoption. Changes in the Official Zoning Map must meet the Federal Emergency Management Agency's (FEMA) Technical Conditions and Criteria and must receive prior FEMA approval before adoption. The Commissioner of Natural Resources must be given ten (10) days written notice of all hearings to consider amendment to this ordinance and said notice shall include a draft of the ordinance amendment or technical study under consideration. TOPIC 95-18-V, Bill Greene, 6693 East Shadow Lake Drive, Variance Mr. Bill Greene has applied for a building permit to add approximately 755 square feet to his property at 6693 East Shadow Lake Drive. In review of the permit application, it was determined that the lowest floor was constructed, in 1978, at an elevation of 886.57. This is .57 feet above the 100 year flood elevation. In 1982 the City adopted our current Flood Plain Ordinance which requires the lowest floor elevation to be 1' above the 100 year flood elevation or at an elevation of 887 in this location. Mr. Greene's property, therefore, became nonconforming. In order for Mr. Greene to meet the requirements of the Flood Plain Ordinance he would have to raise the proposed addition .43 feet. Mr. Greene believes this creates a hardship from both an aesthetic and functional standpoint. To allow the proposed construction at 886.57, the same elevation as the existing structure, requires a Variance from the Flood Plain Ordinance. According to the existing Flood Plain Ordinance, a "variance from the terms of this Ordinance" may be granted provided it "will not be contrary to the public interest, where, owing to special conditions, literal enforcement of the provisions of the Ordinance will result in unnecessary hardship...". Staff has determined that granting of this Variance is not contrary to the public interest and could be considered to create a hardship to the property owner. For P & Z information, the structure will meet all setback requirements of the R-1 Zoning District and the City's Shoreland Ordinance. We would, therefore, recommend approval of a Variance to allow construction of the proposed addition at an elevation of 886.53 the elevation of the existing structure. 1.
